The proposed change would be from Light Industrial (I-L) to Industrial Park (I•-P) . Pacific NW Properties (PNW) owns two of the sites;'Tax Lot 2400 which includes three buildings,two of which are being leased to Portland General Electric (PGE) and the third, an office building, is currently vacant. The second parcel owned by PNW is Tax L,ot &DO which is currently being leased to Ryder Truck. United Pipe and ;Supply owns the third parcel (Talc Lot 700). The attached letter from United Pipe and Supply acknowledges that they cuncur with this request. PNW is in the process of selling Tax :Lot 2440 to Alpha Computers. Xpha Computers is purchasing the entire site and will move into the now vacant 10, 00 square foot office building. They plan to use the space as a business equipment sales and service office. Two detached warehouses are also located on site(see Exhibit"C"). PGE is currently lersing the buildings for warehouse space and have just recently extended their lease for an additional S years. Under the 1-1. zone, an office use is only allowed when it is directly associated with the allowed use. With occupancy of the office building by Alpha Computers, the warehousing and office space are not associated and therefore Alpha Computer's intended use is not allowed under the current zone. The proposed zone change to Industrial Park (I-P) will allow Alpha Computers to occupy the office space and allow PGE to c.se the warehousing. Both uses are allowed under the I-P zone designation. PNW is also applying for a zone change on it's Ryder Truck Parcel (Tax IA-)t 600). The cccrrent automobile and equipment -epairs use is allowed under either zone. In fact, the closest residential development is approximately 600 feet to the west of the PGE site with the Southern Pacific Railroad tracks, S.W. 74th Avenue, and Fanno Creek in-between. All three sites have frontage access to S.W. 72nd Avenue, a Major Collector Street in the City of Tigard. S.W. 72nd Avenue is well connected with other collector streets and adjacent to 1-5. B. STATE WIDE PLANNING GOALS Since the Tigard Comprehensive Plan has been acknowledged by the Oregon Land Conservation and Development Commission, it is no logger necessary to address the statewide planning goals for a zone change that does not affect the Comprehensive Plan such as this proposal. C. APPLICABLE STANDARDS AND PROVISIONS OF THE COMMUNITY DEVELOPMENT CODE 1. PGE Site (Tax Lot 2400) This site hes three existing buildings; two warehouse buildings and one 10,000 square foot office building. A tributary drainage to Fanno creek runs along the north end of the property. The site itself and the buildings on the site are consistent with the minimum lot size, minimum building setback., landscaping,site coverage,and building height requirements of the Community Development Code Chapter 18.68 (1-P zone). 2. Ryder Truck Site (Tax Lot 600) This site has one service building for maintenance and repair of Ryder's truck fleet. The site itself and the building on the site are consistent with the minimum lot size, minimum building setback, and building height requirements of the Community Development Code Chapter 18.68 (1-P zone). Rogers Machinery retains a portion of undeveloped land on the BE corner of the intersection of SN 72nd Avenue and ON Bonita Road. Land to the south and east of the site is soned I-P and is developed as a portion of the Pacific Cor"rate Center complex. 2. BkBInforzistion As stated in the applicants narrative, Pacific Northwest. Properties 00 PNN) is the cwnelr of two of the three properties; tax lot 24and 600. Tax lot 2400 includes three buildings. Two of these buildings are being leased to Portland General Electric. The third building is an office building which currently stands vacant. Ball Creek (a tributary to Fanno Creek) runs along the north property line of t::i• parcel. The placement of the buildings and the paved areas does not interfere with the location of the creek. A Southern Pacific rail line runs along the west side of this parcel. The second parcel which is under the ownership of PNN is tax lot 600. This lot is currently being leased to Ryder Truck. United Pipe and Supply owns the third parcel (tax lot 700) and is using this as their own business location. These sites are adequately landscaped andprovide availability for employee and customer parking as well as on-site traffic circulation. Access is provided to tax lots 600 and 700 by both SN 72nd Avenue and SN Sequoia Parkway. Access Jo provided to tax lot 2400 by SN 72nd Avenue. 3. proposal Desgrintion The applicant has stated that Pacific Northwest Proportion is in the process of selling Tax Lot 2400 to Alpha Computers. Alpha Computers is purchasing the entire site and will move into the now vacant 10,300 square foot office building. They plan to mse the space as a business equipment sales and service office. Two detached warehouses are also located on the site. PGR is cucrently leasing these two buildings and is using them as warehGnme space and have recently extended their lease for an additional five years. Under the I-L none, an office use is only permitted when it is directly associated with the allowed use. The occupancy of the office building by Alpha Computers is not associated with the FINAL ORDRR - EON 93-0003 - PACIFIC NN PROPERTIES Page 2 warehousing and office use of the other two buildings. Therefore, Alpha Computer's intended use is not allowed under the current sone. The applicant's states that the intent of this request is to change the zoning designation on this 8.96 a--re site from Light Industrial (I-L) to Industrial Park (I-P) . This will allow Alpha Computers to occupy the office space and allow PGB to use the other two buildings for warehousing. Both uses are allowed under the I-P zoning deslgnetion. Pacific Northwest Properties is also applying for a zone change on the Ryder Truck parcl (tax lot 600) . The current Automobile and Equipment Repair use is allowed under either sone. In addition, United Pipe and Supply (tax lot 700) has requested a i:eno% change to I-P. Currently, United Pipe and Supply is surrounded on two sides with the I-P zoning designation. The resulting configuration of parcels which are requesting the I-P zoning designation willprovide compatibility and a further extension of the adjacent I-P zone which incorporates the Pactrust Business Park to the south. This provides continuity between the I-P sone and the I-L zone In this area. . Wnncy and NPO Cosiments The City of Tigard Engineering Department has reviewed this application and states that public facilities (road, sanitary sewer and storm sewer) are available to the site. The tone change will have little, if any, impact on the potential demand on existing facilities. The City of Tigard Building Department, Tigard Nater District, Northwest Natural Gas, Portland General Electric, and the Tualatin Valley lire and Rescue District have reviewed the proposal and have offered no comments or objections regarding the proposal . Tigard Nater District has returned comments stating that the Mater District shall requir,, each tax lot to be served by its own separate water meter. The owners should be advised to contact the Water District to apply for a new water service. 5. Public Hearing Cao■sents City of Tigard Assistant Planner Ron Pomeroy summarised the L application and findings forwarded a recommendation for approval to the Planning Commission. The proposed redesignation must also be consistent with the purpose section for the requested I-P zoning district. The redesignation should not create any non-conformities with regard to existing uses of the site or existing site improv eaeents. This conclusion is supported by the fact that this site and the area in the vicinity of the subject property is almost entirely developed with no evidence of develop int limitations . This application will have no effect upan Ball Creek which is located on the north side of tax lot 2400. 3. Plan Pollcy 5. 1 . 1 states that the City shall promote activities aimed at the diversification of the economic opportunities available to Tigard residents with particular emphasis glared on the growth of the local. job market. (2) Located on an arterial or collector street and that industrial traffic shall not be changed through residential areas. C. This site is separated from any residential development. Tito nearest residential development (or sone] is CL approximately 600 feet to the west of the PGG site (the a westernju-')st parcol) . The Southern Pacific Railroad •n tracks, SW 76th Avenin+ and Fanno Creek separate these zoning districts. All three sites have frontage access directly to SW 72nd Avenue which is classified as a Major Collector. Southwest 72nd Avenue is well connected with other Collector streets and is in close proximity to I-5. This in demonstrated by the cooperation of the property owners in the preparation of this application and the stated plane for the potential expansion of the uses on this site. The subject property has an average grade of approximately 3 percent, which is less than the maximum average grade for Light Industrial land recommended by the locational standard in the Comprehensive Plan. The contemplated expansion of the uses of any portion of these three parcels would require an application for site development review by the Planning Division under either the minor wodification or major modification Community Development, Code standards. Although th& issues of noise, external lights and other external effects and their possible interference with - 'ie activities and uses on surrounding properties shall be addressed at that time, it is doubtful that there would be any negative impacts upon Light Industrial property from land zoned lose intenuely as Industrial Park. The Planning Commission concurs with the applicant Lhat prior redesignations In the area constitute a change in circumstances affecting tax lots 2400, 600 and 700 that supports the applicant's assertion t:iat theso properties would be more suitably designated Industrial Park than the current Light Industrial designation currently applied to these sites. This redesignation would remove only agricultural v&lue and services, animal kennels and auctioning, and some automotive uses from this site. The I-P dosignatioa allows a broader range of less intensive potential services to be placed on thir ■its. This redeei.gnation would compll"nt the uses in existence in the surrounding area. For combining uses which have no off-site impacts in terms of noise, odor, glare, lights, vibration, smoker dust, or other types of off-spite impacts; 3. for combining perking, landscaping Lnd other design featurep which physically and visually link structures and uses within one development; 4 . Which prohibit residential use; CL 5 . Which utilise a basic street and utility pattern which will permit flexibility in the sixe of industrial sitas; 6 . Which provide for a circulation system that provides direct acuece to arterials or collectors that will not channel traffic through residential areas; w 7 . Which provide evidence of continuing management reaponsibillty to enforce restrictions established upon the original development plan; and 10. Which recognize the differing transportation requirements of employees and service vehicles with adequate provision for public transit access . (Ord. 89-06; Ord. 83-52) The Planning Cosssission finds that the ),Vdesi gnation of these parcels is consistent with the purpose statement of the I-P Boning district. The existing and contemplated site improvements tmuld be able to accommodate a variety of induntrial uses that would be consistent with both the use and dimensional standards applicable to the sone. The proposed sone change would allow ©n appropriate location for p^rmitted industrial park activities . The existing uses do not yererate any apparent nuisance characteristics such as noise, odor, glare or smoke. Any expansion of this use or development of new uses fcr the site would be required to abide by the Code restrictions intended to limit such characteristics on property sowed I-P. No residential use currently exists on the subject property and none is proposed. The alto and surrounding area is nonresidential .in character. These parcels nre provided with adequate on-site circulation systems which utilize direct access to SW ;2nd Avenue. Traffic from these parcels is not. directed through residentially zoned areas . The app icant has proposed no site modifications and has provided no evidonce of changes to any existing deed restrictions for these pa-,-cels . Public: transit In currently available on SW Bonita Road north of the site. Any request for additional. future mason transit strops shall be coordinated through Tri-Met. The applicant' s narrative has stated, and the Planning Commission concurs, that the existing uses on these three Q, parcels are consistent with the I-P standards for lot oc dimension, current use, minimum setback standards, and ouilding height. A Lot Line Adjustment was recently approved by the City on in anticipation of this sone change application. This requested zone change would have caused the United Pipe parcel aD (tax lot 700) to fall short of the 20 percent landscaping which is required by the I-P zoning designation. To prevent this ul nonconformity, the applicant filed a lot .line adjustment application which the City approved on June 24, 1993. The resulting configuration of parcels which are requesting the I-P zoning designation will provide compatibility and a further extension of the adjacent T-P sons which incorporates the Pactrunt Business Park to . The zone change will have little, if any, impact on the potential demand on existing facilities. The City of Tigard Building Department, Tigard Water District, Northwest Natural Gas, Portland General Electric, and the Tualatin Valley Fire and Rescue District have reviewed the proposal and have offered no commento or objections regarding the proposal . Tigard Water District has returned comments stating that the Water District shall require each tax lot to be served by its own separate water mater. Plan Policy 5 . 1 . 1 stages that the City shall promote activities Limed at the diversification of the economic opportunities available to Tigard residents with particular emphasis placed on the growth of the local job market. The applicant also states that Pacific Northwest. Properties is considering plans to upgrade the Ryder Truck site (tax lot 600) to a new ube which would be allowed under the I-P zoning designation. This change may also provide additional job market growth. STAFF HEVORT - EON 93--0003 - PACIFIC NW PROPERTIES Page % 4. Plan Policies 7. 1.2, 7.2. 1, 7 .4.4, and 7 .6. 1 are satisfied because a full range of public service are currently provid*d to this site. Service providing review agencies have not raised any issues regarding thea r ability to provide services to this site if this sone change application is approved. Service providing agencies would be provided with an opportunity to r4wiew any development proposals for the vubject site which sight arise after redesignation. S. Plan Policy 8. 1 . 1 is satisfied because no new on-site development is proposed in connection with this sone change. Although the difference would be negligible, the proposed redeaignation cuuld slightly decrease the demand on the public roadway system generated by uses on the property as assessed utilizing the Institute of Traffic Rngineers Trio Genera ion Manual. The following comparison shows that site generated traffic should be marginally less than allowed by the current light industrial zoning designation. Industrial Park - 5 .97 trips per 1000 square feet of gross building area - 0. 93 trips per 1.000 square feed at a.m. peak hours - 0.97 trips per 1000 square feet at p.m. peak hours Light Industrial - 6 .9: trips per 1000 square feet of gross building area - 0. 95 trips per 1000 square feet at a.m. peak hours - 1 .04 trips per 1000 square feet at p.m. peak hours The above analysis indicates that the requested zone 4 change would not be expected to significantly affect the transportation system and could even result in a alight decrease in the potential for vehicle trips. 6 . It shall be demonstrated that associated lights, noise and other external effects will not interfere with the activities and uses on surrounding properties. f . All other applicable plan policies can be met. The applicant's narrative addresses items 1 and 2 as specified under item (b) listed above. Staff concurs with this analysis and borrows liberally from the ap�licant in providing the findings addressing both cr_teria. This site is separated from any residential development. The nearest residential development- (or sone) is approximately 600 feet to the west of the PGR site (the westernmost parcel) . The Southern Pacific Railroad tracks , SW 74th Avenue and lanno Creek separate these zoning districts. All three sites have frontage access directly to SN 72nd Avenue which is classified as a Major Collector. Southwest 72nd Avenue is well connected with other collector streets and is in c1cse proximity to I-5. With reference to the other requirements listed under Policy 12 . 3 . 1(b) , the applicant ham stated, and the City agrees, that the sine and shape of this Bite will provide for both short and long term needs of this site. This is demonstrated by the cooperation of the property owners in the preparation of this application and the stated plans for the potential expansion of the uses on this site. STAFF REPORT - ZON 93-0003 - PACIFIC NW PROPERTIES Page 6 The subject property has an average grade of approximately 3 percent,, which is lass than the maximum average grade for Light Industrial land recommended by the locational standard in the Comprehensive Plan. The contemplated expansion of the uses of any portion of these three parcels would require an application for site development review by the Planning Division under either the minor modification or major modification Community Development Code standards. Although the issues of noise, external lights and other e-ternal effects and their possible interference with the activities and uses on surrounding properties shall be addressed at that time, it ie doubtful that there would be any negative impacts upon bight Induatrial property from land zoned less intensely as Induatrial Park. This analynts above demonstrates that all other applicable Plan policies can be met as a result of the proposed changes. As correctly stated in the applicant's narrative, a parcel on the southwest corner of the intersection of SW Sandburg Street and SW 72nd Avenue was changed from C-P to I-P in late 1990 (CPA 98-0008/ZON 90-0008) . Finlandia Sauna, located across from SW Landmark Lane on SW 72nd Avenue was changed from I-N and C-P to I-L in late 1992 (CPA 9 !- �'" 0005/ZON 92•-0003) . Also, the Pittman i Brooks, P.C. Certified Public Accountants Fite, located on the went side of. SW 72nd Avenue acroogn from Cardinal Lane, was changed from I-I. to I-P t in 1991. . These past zone changes of parcels in the vicinity of the subject property reflects a change in the co;mnunity an It. contl.nues to adjust and shift with tkie economy of the City. la The City concurs with the applicant that prior redesignations in the area constitute a change in circumstances affecting tax lots 2400, 600 and 700 that supports the applicant's assertion STAFF REPORT - ZON 93-0003 - PACIFIC NF1 PROPERTIES Page 7 that these properties would be more suitably designated Industrial Park than the current Light Industrial dMsignation currently applied to theme sites. This redesignation would remove only agricultural sales and services, animal kennels and auctioning, and some automotive uses from this site. The I-P designation allows a broader range of less intensive potential services to be placed on this site. This redesignation would compliment the uses in existence in the surrounding area. Code Ca RJ2 1e.68 ( zoning di@_trict) Chapter 18.68 ( Industrial Park zoning district) of the Tigard Community Development Code contains the following purpose statement applicable to this requastc 18.68.010 Purpose A. The purpose of the I-P inning district is to provide areas: 1. For combining light manufacturing, office and complementary related commercial uses, e.g. , restaurant, barber shop, beamty salons, and fitness centers; 2. For combining uses which have no off-site impacts in terms of noise, odor, glare, lights, vibration, smoke, dust, or othar types of off-site impacts; 3. for combining parking, landscaping and other design features which physically and visually link structures and uses within one development ; 4 . Which prohibit residential use; 5. Which utilize a basic street and utility pattern which will permit flexibility in the size of industrial sites; 6 . Which provide for a circulation system that provides direct access to arterials or collectors that will not channel traffic through residential arses; a7 . Which utilize an internal circulation system which connects to adjoining Rites; B . Which provide a complete not. of pre-imposed restrictions (e.g. , deed restrictions, restriction covenants, etc. ) , that are enforceable upon all occupants of the Industrial park including provisions for sites improvement, building STAFF REPORT - ZON 93-0003 - PACIFIC NW PROPERTIES Page 8 design, landscaping, sign control, off-street parking, and site maintenance; 9 . Which provide evidence of continuing managenei.t responsibility to enforce restrictions established upon the original development plan; and 10. Which recognise the differing transportation requirements of employees and se?-vice vehicles with adequate provision for public transit access. (Ord. 89-0E; Ord. 83-52) The City contends Viat the redesignation of these parcels is consistent with the purpose statement of the I-P zoning district. The existing and contemplated site improvements would be able to accomodate a variety of industrial uses that would be consistent with both the use and dimensional standards applicable to the sone. The proposed sone change would allow an appropriate location for permitted industrial park activities. The existing uses do not generate any apparent nuisance characteristics such as noise, odor, glare or smoke. Any erpansion of this use or development of new uses for the site would be required to abide by the Code restrictions intended to limit such characteristics on property zoned I-P. No residential use currently exists on the subject property and none is proposed. The site and surrounding area is nonresidential in character. These parcels are provided with adequate on--site circulation systems which utilize direct access to SW 72nd Avenue. Traffic from these parcels is not dirocted through residentially zoned araas . The applicant has proposed no site modifications and has provided no evidence of changes to any existing deed restrictions for these parcels . Pub) +.c transit is currently available on SW Bonita Road north of the site. Any request for additional future mass transit stops shall be coordinated through Tri-Met. The applicant's narrative has stated, and the City concurs, that the existing uses on these threw parcels are consistent with the I-P standards for lot dimension, current use, minimum setback standards, and building height. A Lot Line Adjustment was recently approved by the City on in anticipation of this zone change application. This requested zone change would have caused the United Pipe parcel (tax lot 700) to fall short of the 20 percent landscaping which is required by the I-P zoning designation. To prevent this nonconformity, the applicant filed a lot line adjustment application which the City approved on June 24, 1993. This adjustment provides approximately 5,000 additional square feet to the United Pipe parcel which allows the 20 percent landscaping requirement to be meet on-site. Under the I-1. sone, an office use is only permitted when it is directly associated with the allowed use. The occupancy of the office building by Alpha Computers is not associated with the warehousing and office use of the other two buildings. Therefore, Alpha Computer's Intended use is not allowed under the current sone. The applicant's states that the intent of this request is to change the zoning designation on this 8.96 acre site from I.!ght Industrial (I-L) to Industrial Park (I-P) . Both uses are allowed under the I-P zoning designation. Pacific Northwest Properties in also applying for a zone change on the Ryder Truck parcel (tax lot 600) . The current Automobile and Equipment Repair use is allowed under either sone. In addition, United Pipe and Supply (tax lot. 700) has requested a sone change to I-P. Currently, United Pipe and Supply is surrounded on tr*o sides with the I-P zoning designation. The resulting configuration of parcels which are requesting the I-P toning designation will provide compatibility and a further extension of the adjacent I-P sone which incorporates the Pactrust Business Park to the south. Thic provides continuity betwean the I-P zone and the I-L zone in this area. 5. Agctcy and NPO C Mets The City of Tigard Engineering Department has reviewed this application and states that public facilities (romd, sanitary sewer and storm sewer) are available to the sito. The zone change will have little, if any, impact on the potential demand on existing facilities. The City of Tigard Building Department, Tigard Mater District, Northwest Natural Gas, Portland General Electric, and the Tualatin Valley Fire and Rescue District have reviewed the proposal and have offered no comments or objections regarding the proposal. No other comments have been received. B. FINDINGS AND CONCLUSIONS The applicable criteria for this case are Comprehensive Plan Policies 2. 1. 1, 3.1.1, 5. 1.1, 7.1.2, 7.2.1, 7.4.4, 7.6. 1, 8. 1. 1, 12.2 . 1, 12.3. 1 (locational criteria for the Light p. This policy is satisfied because the subject property has no wetlands, severe soil erosion, potential slopes exceeding 25% and does not appear to contain severe weak foundation soils or be subject to slumping, earth slides or movement. This conclusion is supported by the fact that this site and the area In the vicinity of the subjoct property is almost entirely developed with no evidence of development limitations. This application will have no effect upon Sall Creek which is located on the north side of tax lot 2400. 3. Plan Policy 5. 1. 1 states that the City shall promote activities aimed at the diversification of the economic opportunities available to Tigard residents with particular emphasis placed on the growth of the local job market. This proposal would enhance economic opportunities within the Tigard area by allowing Alpha Computers to utilise tax lot 2400 as its' own business location when Pacific Northwest Properties completest states of this lot to Alpha Computers. The app that Alpha Computers intends to immediately occupy the now vacant 10,303 square foot office building which will bring approximately 20 to 30 jobs to the Tigard area. The applicant also states that Pacific 1k'rthwest o� Properties is considering plans to upgrade the Rr Truck site (tax lot 600) to a new use which wouldbe allowed under the I-P zoning designation. This change may also provide additional job market growth. 4 . Staff concurs with this analysis and borrows liberally from the applicant in providing the findings addressing both criterie. t This site is separated from any residential development. The nearest residential development (or zone) is approxixaately 600 feet to the west of the PGR site (the westernmost parcel) . The Southern Pacific Railro--+d tracks, SW 74th Avenue and Fanno Creek separate these zoning districts. All three sites have frontage access directly to 8W 72nd Avenue which is classified as a Major Collector . Southwest 72nd Avenue is well connected with other Collector streets and is in close proximity to 1-5. With reference to the other requirements listed under Policy 12.3. 1(b) , the applicant has stated, and the Citv ; agrees, that the size and shape of this site will provide for both short and long term needs of this site. This is demonstrated by the cooperation of the property owners in the preparation of this application and the stated plans V) for the potential expansion of the uses on this site. The subject property has an average grade of approximately 3 percent, which is lona than the maximum average grade for Light industrial land recon nded by the locational standard in the Comprehensive Plan. This analysis above demonstrates that all other applicable Plan policies can be met as a result of the proposed changes. There have been recent Plan and map changes in the vicinity of the subject site. As correctly stated in the applicant's narrative, a parcel on the southwest corner of the intersection of SW Sarcdburg Street and SW 72nd Avenue was changed from C-P to I-P in late 1490 CPA 98-0008/EON 90-0008) . Finlandia Sauna, lo,.-ated across from SW Landmark Lane on SW 72nd Avenue was changed from I-H and C-P to I-L in late 1992 (CPA 92- 0005/ZON 92 -0003) . Also, the Pittman i Brooks, P.C. Certified Public Accorintants site, located on the west side of SW 72nd Avenue across from Cardinal Lane, was changed from I-L to I-P in 1991 . These past some changes of parcels in the vicinity of the subject property reflects a change in the community as it continues to adjust and shift with the economy of the City. The existing and contemplated site improvements Mould be able to acccomodate a variety of industrial uses that Mould be consistent with both the use and dimensional standards applicable to the sone. The proposed zone change Mould allow as appropriate location for permitted industrial park actIvi.ties. The existing uses do not generate any apparent nuisance characteristics such as noise, odor, glare or stoke. Any expansion of this use or development of new uses for the site Mould be required to abide by the Code restrictions intended to limit such characteristics on property zoned I-P. No residential use currently exists on the subject property and none is proposed. The site and surrounding area is nonresidential in character. Three parcels are provided with adequate on-site circulation systems which utilise direct access to ON 72nd Avenue. Traffic from these parcels is not directed through residentially, zoned areas. The applicant has proposed no site zwdificationn and has provided no evidence of changes to any existing deed restrictions for these parcels. Publi-i transit is currently available on ON Bonita Road north of the site. Any request for additional future mass transit stops rhall be coordinated through Tri-Met. The applicant's narrative has stated, and the City concurs, that the existing uses on these three parcels are consistent with the I-P standards for lot dimension, current use, minimum setback standards, and building height. Any future development of the site may require enhancement of the existing landscaping. D.
