CITY OF TIGARD NOTICE OF DECISION SITE DEVELOPMENT REVIEW SDR 91-0002 LEEK/MACKRNZIE ENGINEERING APPLICATION: A request for Site Development Review approval to allow construction of an approximately 8,000 square foot equipment repair and battery distribution facility. Zoning: I-H (Heavy Industrial) . Location: 1395.5 SW 72nd Avenue (WCTM 2S1 1DD, Tax Lot 1000) . DECISION: Notice is hereby given that the Planning Director's designee for he City of Tigard has APPROVED the above request subject to certain conditions . The findings and conclusions on which the decision is based are noted below: A. FINDINGS OF FACT 1. Background The subject site was annexed into the City of Tigard on November. 10, 1970 (BC 207 ) . No other land use or development applications for this parcel have been reviewed by the City of Tigard. 2 . Vicinity Information The subject parcel is bordered by properties on all sides which are zoned for heavy industrial use ( I-H) . Landmark Industrial Park lies directly to the south of the subject site. Immediately to the west of the site is a legally nonconforming residential home with Circle A W Products just '�o the west of the home. The properties to the east contains Sandvik Steel, Inc. Gerber Legendary Blades and Williams Air Control are located to the southeast of the site. 3. Site Information and Proposal. Description The site is presently undeveloped. The property slopes southward away from SW 72nd Avenue frontage. The elevation drops approximately 19 feet from the northern property line to the southern property line. There are currently no trees or landscaping present although the site is covered with a variety of low lying n, tural grasses . A Northwest Natural Gas .line is located approximately 29 feet from the site's northernmost corner and runs in a southwesterly direction until it NOTICE OF DECISION - SDR 91-0002 - LEEK/MACKENZIE PAGE 1 exits the property approximately 53 feet south of the property's northwestern corner. The applicant requests Site Development Review approval to allow the construction of an approximately 8,000 square foot equipment repair and battery distribution facility. This development is proposed to provide 32 parking spaces located along the north and east of the site. A double bicycle parking rack will. be located on the northwestern corner of the building. The applicant proposes 15 percent landscaping coverage with ten Scanlon Red Maples, three Douglaa Fir and two Chanticleer Pear trees to be located along the north and east boundaries of the site. Chanticleer Pear trees and Vine Maples will also be located on the interior portion of the site. 4 . Agency and NPO Comments The Engineering Division has reviewed the request and provides the following comments: 1. Streets : The site fronts S.W. 72nd Avenue which is classified as a major collector. The existing roadway has 44 feet of pavement and curbs on bot: sides; sidewalks are not currently insta?.led and should be a requirement of development. Access into the site is at .a difficult situation. The location of the site is such that it fronts the roadway both in a vertical and horizontal curve. Therefore access to the site should be looked at. very closely to insure that it meets both sight and stopping distances . 2 . Sanitary Sewer: There is an existing public sanitary sewer line that is located on the south end of the property and runs the length of the property. The existing line appears to have sufficient cap,icity to handle this development. 3 . Storm Sewer: There is an existing public storm sewer line located in S.W. 72nd Avenue. This site could be serviced by this line and the line appears to be adequate to h!rndle this development . NOTICE OF DECISION - SUR 91-0002 - LEEK/MACKENZIE PAGE 2 4 . Surface Water Management The Unified Sewerage Agency has established and the City has agreed to enforce (resolution No. 90-43) Surface Water Management Regulations requiring the construction of on-site grater quality facilities or fees in lieu of facility construction. Requiring surface water quality acil.;_ties on small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are r,o natural depressions or other areas of this site that particularly suitable for water quality facilities. Regional facilities, funded by fees in lieu of construction of scattered smaller facilities would provide the required treatment with improved reliability and less maintenance. Consequently a fee-in-lieu of the construction of on-site water quality facilities should be assessed. 5. Traffic Impact Fees Washington County has established and the City has agreed to enforce (Resolution No. 90-65) Traffic Impact Fees (TIF) . The purpose of the fee is to ensure that new development contributes to extra-capacity transportation improvements needed to accommodate additional traffic generated by such. development. The applicant shall be required to pay t:hp fee. Eased on the following intormation the ESTIMATED TIF for this development would be: A) Use as defined by applicant: ( 3neral Light Industrial B) Land Use Category: Industrial C) Rate per trip: $130.00 D) ITE Category: 110 E) Weekday average trip rate: 6 . 97 per T.G.S.F. F) TIF = 6 .97 X 8 X $130.00 - $7248 .80 Please note this is only an estimate of the proposed TIF fee. The actual fee will be calculated at the time NOTICE OF DECISION - SDR 91-0902 - LEER/MACRENZIE PAGE 3 of the building application. The actual TIF will be based on the total square footage shown in the approved building plana and the trip rate in effect at the time of building permit application. The Tualatin Valley Fire and. Rescue District has reviewed the proposal and has the following comments: Fire hydrants are required as per the Uniform Building Code. Fire hydrants shail be with-n 250 feet of all portions of the outside walls of the buildings. If the building provides an internal sprinkling system, the availability of fire hydrants may be extended to 500 feet. Approval of fire hydrant location shall be coordinated with the Tigard Water District. The City of Tigard Field Operations Division has reviewed this proposal and offers the following comment: Part of the parking area is shcln to be within a sanitary sewer easement and within a couple feet of the sanitary sewer line. The Cterations Division needs access to manholes on this sanitary sewer line. From reviewing the drawings, we are not sure that this is being addressed. Neighborhood Planning Organization #5 has reviewed this proposal Lnd has offered the following comments: Due to the "Z" alignment of 72nd around this site we are extremely concerned about the potential traffic hazard that will develop as uoth employees and customerR of businesses using the site try to arrive and leave. There .is also the slope of the road which, due to the topography of other adjacent parcels, tends to have "blind" spots in the curves of the "Z" . Landscape requirements may also compound this visibility problem. The City of Tigard Building, Packs Maintenance and Streets Maintenance Divisions, Tigard Water District, General Telephone, Northwest Natural Gas, and Portland General Electric have reviewed the proposal and have Issued no comments or objections . No other comments have been received. NOTICE OF DECISION - SDR 91-OOC2 - LEEK/MACKENZIE PAGE 4 B. ANALYSIS AND CONCLUSION Code Section 18.72 .050(A) (4) (Heavy-Industrial) of -.he Community Development Code (CDC) allows a maximum building height of 45 feet. The height of the equipment repair and battery distribution facility is proposed to be approximately 1P feet 10 inches and therefor. is within the building height allowed in this zoning district . The I-H zoning district requires a 30 foot minimum setback from the front property line. This development proposes an approximately 45 foot setback from the front property line and therefore satisfies this minimum setback requirement. No other setback requirements apply to this site. The applxc!ant has stated that approximately 2,800 :. -dare feet of the building will be used for the sale, storage and repair of truck equipment and electrical components. The balance of the building (approximately 5, 114 square feet) will be available for a similar tenant. These uses are classified in Code Section 18.42 (Use Classifications) as both Automotive and Equipment: Repairs (Heavy and Light) , and Wholesaling, Storage and Distribution (Heavy and Light) . Under these classifications the more stringent parking requirement is teat of Automotive Repair which requires one parking space for every 500 square feet of gross floor area. The proposed building's size of 7,914 square feet necessitates a minimum of 12 vehicular parking spaces. The site plan provides an adequate numher of parking spaces to satisfy the Code requiremF!nts for uses likely to locate in the proposed building ( 31 spaces provided, or 1 space per 256 square feet of gross floor area; this provides more parking spaces than would be required for the most intensive use allowable in the I-H zoning district) . State of Oregon House Bill 2084 , which became effective September 1, 1990, requires two disabled person parking spaces if 26 to 50 parking spL--es are provided. The proposed plan provides for only one disabled person parking spare. One additional disabled person parking space will therefore need to be provided. It is suggested by staff that the additional required handicapped space be located in close proximity to the lobby entrance of the business located on the southern portion of the proposed building. This arrangement will provide easier building accessabili.ty and more convenient vehicle maneuvering for disabled citizens . The site plan notes that bicycle parking wi..) z be provided on the northwest corner of the building. Space for two bicycles will be )rovided. Code Section 18. 106 (P) requires NOTICE OF DECISION - SJR 91-0002 - LEER/MACKENZIE PAGE 5 one bicycle harking space for Each 15 require., vehicle parking spaces. Therefore, this code standard is sa:.isfied. The site meets the minimum access standards through the provision of one 30 foot wide access driveway from SW 72nd Avenue. Code Section 18.. 108.080(A) requires that industrial use parking areas with less than 100 parking spaces be provided with one access drive with a minimum access width of 30 feet. The accessway must be paved to a minimum width of 24 feet. The applicant is proposing a paved. 30 foot wide paved accessway and therefore surpasses this access requirement. Code Section 18. 108.050 requires that a walkway extend frozr the ground floor entrances or from the ground floor landing of stairs of all commercial and industrial uses, to the streets which provide the requircd access and egre ,� . The proposed site plan does not indicate that a walkway has been provided. Therefore, the site plan should be revised to provide the required pedestrian walkway. Code Section 19. 100. 110 (Screening! Special Provisions) states that trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed and on the basis on one tree for each seven parking spaces in order to provide a canopy effect. While it is not feasible to distribute the required trees at an even ratio of one tree for every seven parking spaces due to the parking and traffic circulation pattern on this site, the applicant has approximated this placement as close as possible by providing seven interior parking lot trees whereas the Code only requires five parking lGt trees for this size of parking lots . Developments within the I-H zoning district are required to provide a minimum of 15% landscaping on the site. Of: the 25,410 square foot site, the applicant has proposed to landscape 6,655 square feet. This surpasses the minimum landscaping requirement by providing approximately 26 percent landscaping whereas the Code requires only 3,812 square feet for this site. Section 18. 102 (Visual Clearance Areas) requires that a clear vision area shall be maintained on the corners of all property adjacent- to intersecting r:.ght-of-ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding 3 feet in height, except that obstructions which may be located in this area shall be visually clear between 3 and 8 feet in ►ieight (trees may be placed within this area provided all blanches below 8 feet are removed) . Visual clearance areas shall he that triangular area formed by NOTICE OF DECISION - SDR 91-0002 - LEEK/MACKENZIE PAGE 6 measuring a 30 font distance along each of tae right-of-way or property lines and then connecting these two 30 foot distance points with a straight line. The proposed development conforms with all visual clearance requirements of this code section. Comprehensive Plan Policy 8. 1. 1 (Transportation) calls for a safe and efficient street system that meets current and future growth and development needs. As noted previously by- both the Engineering Department and NPO # 5, access to the site is difficult. Both of these reviewing agencies have raised concerns pertaining to adequate sight distance along the section of SW 72nd Avenue which involves the proposed ingress/egress location for this development. It shall be the responsibility of the applicant to demonstrate that adequate sight distance exists at this Iocat�on in light of both the horizontal and vertical curves on SW 72nd Aven+ie and proposes placement of the driveway access. C. DECISION Based upon the above findings and conclusions, the Planning Director's designee APPROVES Site Development Review SDR 91- 0001 subject to the following conditions: BUILDING PERMITS WILL NOT BE ISSUED UNTIL THE CONDITIONS LISTED BELOW ARF SATISFIED OR AN ACCEPTABLE PERFORMANCE ASSURA?:CE IS POSTED.
