Firefighting Water Supply: A firefighting water supply must be provided for this building. This firefighting water supply must consist of standard fire hydrant located within 250 feet of all portions of the structure as measured along the line of fire apparatus travel. It must produce a minimum of 2,977 gallons per minute at a minimum residual pressure of 20 pounds per square inch. Vicinity Information Adjacent properties to the north, west, and southwest are zoned R- 3.5 (Residential, 3.5 units per acre) and are developed with single family residences. Properties directly south of the site are zoned C-P and are presently vacant or occupied by single family residences. Properties across SW 72nd Avenue from the site are also zoned C-P. These properties are developed with a number of office buildings containing a variety of commercial and professional uses. The subject- site has 367 feet of frontage on SW 72nd Avenue. SW 72nd Avenue is developed with 44 feet of pavement, curbs, storm drains, streetlights, and a sidewalk along the site's frontage. The site has slightly more than 600 feet of frontage along SW Fir Street. SW Fir Street consists of 20 feet of gravel covered right- of-way which dead ends into the driveways of residences to the south of the site. The Transportation Plan Map designates SW Fir Street as a local street. Fully developed local streets typically consist of 50 feet of public right-of-•way improved with full street improvements. 3. Site Information and Proposal The proposed development site consists of three parcels totalling approximately 5.03 acres, including a 16.5 foot by 630 foot section of tax lot 3600 between SW Fir. Street and the other involved parcels. The remainder of tax lot 3600 iii not a part of the proposed development site. Tax lot 800 contains a house and outbuidings in its northeastern corner.. The other parcels are vacant. The site contains a grove of fir and oak trees in the northeastern corner of the site with the oak trees extending along the site's border along SW 72nd Avenue . The remainder of the site is mostly open and covered with grasses, weeds, and nut and fruit trees. The parcels are relatively flat with a slight slope towards the east.. The applicant proposes development of a 100 unit, ten building apartment complex on the site. Three buildings would be located along the site's 72nd Avenue frontage; the other seven buildings would be located along a circular roadway through the site. None of the residential buildings would be closer than 75 feet from the site's northern and western boundaries with properties developed with single family residences. Eight garage buildings would be located along the Internal roadway between the proposed apartment buildings and the neighboring single family residences. All garage buildings are setback no less than ten feet from the site's borders. Each residential building will contain ten apartment units. Each building will have 6 two-bedroom apartments and 4 one-bedroom units. All unite will have balconies. The maximum building height. proposed in 37 feet. The development plan includes a recreation centir to include a pool, spa, exercise room, and lounge area. The recreation center would be located in the northern section of the site, approximately 80 feet from the property's northern boundary. The plan proposes a total of 180 parking spaces to be distributed throughout the site along the circular driveway. Proposed site landscaping includes retention of the majority of the mature oak trees along the site's SW 72nd Avenue frontage, a mixture of coniferous trees and evergreen shrubs along the site's other borders, and a variety of deciduous trees along the project's internal driveways and along SW Fir Street. The northern, western, and a portion of the southern boundaries of the site will be bermed. Internal site landscaping will include a number of ornamental flowering trees, small shrubs, ground covers, and lawn. The development would be served by one access driveway from SW 72nd Avenue directly across from SW Varna Street and another access driveway onto SW Fir Street. The Metzger Water District has commented that the District's existing water lines adjacent to this site are unable to provide sufficient fire flow for the proposed development. The applicant's representative, Metzger Water District, and Tigard Water District are currently involved in arranging for fire hydrant service to be provided for the site from a Tigard Water District line which also is adjacent to the site. However, because of enrollment pressures from this proposed development and other proposed developments within the District, prospective ocrupants of the development nhould be advised that students may need to he bused to other schools. After the District completes construction of a new middle school in 1992, there should be room fcr these prospective students at Phil Lewis School and Fowler Junior High School. The City of Tigard Biii.l.ding Division has commented that a demolition permit must he obtained prior to demolition or moving the existing house and outbuildings on the site. In addition_, existing utility services, wells, and septic located and properly removed. systems must be NPO #5 has reviewed the proposal and has commented that the NPO desires to see all deed restrictions strictly adhered to by the developer/owners of the proposed apartment complex. ANALYSIS AND CONCLUSION R-25 ?.oninq District Multi-family resi_di-:,ti. tl use of the site is a permitted use in the R-25 zoning - district applied to the site. One hundred dwelling units are proposed on a site that would provide an opportunity for approximately 125 unite under the R-25 zone. Proposed site improvenents comply with R-25 district requirements for building height (45 foot maximum height allowed; 39 foot maximum height proposed) , lot coverage (maximum allowed site coverage of 80 percent; proposed site coverage of less than 60 percent) , and lande.caped area (minimum landscape coverage of 20 percent; proposed landscaped coverage of greater than 40 percent) . All proposed residential buildings satisfy minimum building setback requirements including a minimum 30 fort setback from the site's northern and western borders with low density residentially zoned properties. Seven of the proposed garage buildings, however, do not comply with this 30 foot setback requirement along these borders of the site. A variance to that setback standard for the garages is considered below. Density Transition Code Section 18.40.040.A restricts residential densities within 100 feet of the edge of a developing site to no than 125 percent of the maximum allowable density of an abuts-'.. ; developed residential area. Maximum allowable density of the abutting developed area is determined by the Comprehensive Plan designation of the area rather than by the existing residential density or by the density allowe3 by the zoning district. The maximum allowable density of the Rolling Hills neighborhood to the north and west of the subject site is five units per acre as determined by the Low Density Residential Comprehensive Plan designation applied to the neighborhood. Therefore, the maximum allowed density for the proposed development within 100 feet of the northern and western edges of the subject site is 6.25 units per acre. The applicant has submitted calculations indicating that approximately two acres of the site will be within 100 feet of the abutting lower density developed area providing an opportunity for 12.5 dwelling units to be located within this area. The site plan places only a portion of one ten-unit building within the 100 foot wide density transition area with the remainder of this area occupied by landscaping, parking, and the internal roadway. The density transition requirements are therefore satisfied. Site Develpxnent Review The proposal complies with Site Development Review standards for provision of private outdoor areae (balconies) , shared recreation faculties (swimr..ing pool and recreation center) ,screening of service facilites, residential building separation, and design offsets along building faces. Dwelling units and the recreation center have been situated towards the interior and southeast portions of the site so as to reduce possible noise impacts on neighboring properties and increase visual privacy between adjacent uses. Other Site Development Review standards relate to other Community Development Code standards reviewed below. Accass and Circulation -he proposal also satisfies Community Development Code standards for interr.al roadway widths (minimum width of 24 feet) , number of access points (two required; two provided) , and emergency vehicle maneuve;•ability through the circular design of the internal roadway system. The proposed accesses onto SW 72nd Avenue are appropriately located opposite existing intersections with SW Varna Street. and SW Fir Street on the east side of SW 72nd Avenue. In order to bring SW Fir Street up to an acceptable condition to provide access to 'he proposed developw_nt, right-of-way shall be dedicated and the road surface shall be improved as recommended by the Engineering Division and as shown on the site plan. Ten additional feet of right- of-way shall also be dedicated along SW 72nd Avenue. In order to avoid overloading the SW Fir Street intersection, the northern access to the site along SW 72nd Avenue shall be a two-way driveway as proposed. Parking The site plan provides for an appropriate number of parking spaces for• a 100 unit apartment development (150 spaces required at 1.5 spaces per unit; 180 spaces provided) , and covered parking spaces (100 covered spaces required; 104 covered spaces provided) . The site plan proposes three designated handicapped parking spaces. The Community Development Code Section 18.106.020.N.1 requires that parking areas be provided with one designated handicapped parking space for every 50 standard parking spaces. Therefore, one additional designated handicapped parking space must be provided on a revised site plan. It is recommended that this additional space and at least one of the already proposed designated handicapped spaces be located within a garage or carport to better serve the needs of handicapped residents or visitors to the apartment complex. In addition, it is recommended that the hdndicapped parking spaces be scattered throughout the parking area rather than be concentrated as currently proposed. The site plan proposes that 45 uncovered parking spaces, or 25 percent of the total parking paces, be compact spaces. While this is consistent with Code allowances for compact spaces as a percentage of total spaces, we a=t, concerned with both the percentage of uncovered spacce that are co,npact spaces so well as the concentration of compact spacce on the eastern portion of the site. The eastern porti,.)n of the site is logically the area that will provide visitor parking. It is recommended that the applicant reassess both the number r. id location of compact parking spaces. The site plan provides information on parking area lighting along alaleways on the northern and western portions of the site. This 1 proposed lighting, along with landscaping and building locations, are l designed so as to minimize or eliminate the effects of the lights upon adjacent resideneas. Nevertheless, a revised site plan shall be submitted which includes information regarding exterior lighting for a11. portions of the n'_te. Code Section 18.108.050.8 requires that walkways with a minimum of lour feet connect multi-family residential dWelli.ng units with common open space and recreational facilities. In addition, the development's sidewalks should connect with public sidewalks along SW 72nd Avenue and SW Fir Street. The site plan and landscaping plan shall be revised to provide !or an interconnected walkway system providing appropriate pedestrian circulation throughout the site. Landscaping The proposed berms and landscape materials along the site's borders should provide adequate screening and buffering between the proposed development and adjacent single family residences. In addition, the location of the dwelling units away from the northern and western site borders as well as the placement of garages and parking areas further separates the proposed apartments from the neighboring single family residences. The landscaping plan appears to provide an adequate amount and arrangement of landscaping materials to satisfy most Code landscaping related requirements, although the plan will. need to be revised to provide greater details relating the proposed plant list to the plan. Without details on proposed plantings, it: is not p0831ble to determine whether adequate vision clearance will be maintained at the Intersections of the access driveway and SW Fir Street with SW 72nd Avenue. Clear vision must be maintained between three and eight feet above grade at these intersections. Code Section 18.1.00.035.8 requires that street trees with a minimum caliper of 2 inches be provided along public streets with spacing to range between 20 and 40 feet depending on the mature size of the tree. Existing mature oak trees along the site's SW 72nd Avenue border satisfy the City's street tree requirement along that frontage. However, deciduous street trees are proposed at separations ranging between 50 and 80 feet along the site's SW Fir Street frontage. Additionally, the plant list does not list any deciduous trees with a caliper of greater than 1.75 inches. The landscaping plan should be revised accordingly to provide for adequately sized and spaced street trees along the site SW Fir Street frontage. Signe No sign location or sign description has been provided as part of the Site Development Review application. A sign permit must be obtained prior to erecting a sign on the site. Variance - Accessory Building Setbacks Community Development Code Secticn 18.144 allows accessory buildings, such as garages, on residential properties in excess of 2.5 acres to be up to 1000 square feet in size. Accessory buildings between 529 square feet and 1000 square feet in size must satisfy minimum standard building setback requirements applicable to the site. Smaller accessory buildings must sa`lefy a lesser setback standard. NOTICE OF JECISION - SDR89-25/M 89-28/V 89-38 - CRITERION EQUITIES Page 7 The site plan proposes eight garage buildings in excess of 1000 square feet in size. Seven of the garage buildings are proposed to be situated inside of. the 30 foot minimum building setback area required along the site's northern, western, and southwestern edges which abut properties zoned R--3.5. City staff notified the applicant's architects of these conflicts with City standards prior to compiling this report (telephone conversation between Ralph Tahran, Otak Architects, with Jerry Offer on January 31, 1990) . The applicant's architects have agreed to revise the site plan to reduce the size of all garage buildings to no larger than 1000 square feet in order to satisfy the maximum accessory building size 6tandard. Rather than reduce the garages to 528 square feet or less in size in order to take advantage of the l3sser required setback, a variance has been requested to allow the garage buildings of up to 1000 square feet in size to be located less than the 30 foot minimum setback from a lower density residential zone. None of the garages would be closer than 10 feet to the abutting properties. Code Section 18.134.050 provides the following criteria for allowance of a variance to a Code standard: (1) The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies of the Community Development Code, to any other applicable policies and standards, and to other propert�js In the same zoning district or vicinity. (2) There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; (3) The use proposed will be the same an permitted under this Code and City standards will be maintained to the greatest extent possible, while permitting some economic use of the land; (4) Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parka will not be adversely affected anymore than would occur if the development were Located as specified in the code; and (5) The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. In the present situation, the applicant is apparently caught between a Code standard that is intended to apply primarily to residential buildings and barns and the applicant's desire to provide additional screening and separation between the proposed multi-family dwelling unite and adjacent single-family residences through creating a fairly solid wall of garage buildings between the two. Because the proposed garages are relatively low in height (15 feet ac the peak) , and would be well screened by landscaping from views from abutting single-family NOTICE OF DECISION - S111189 -25/M 89-28/V 89-38 - CRITERION EQUITIES Pad- 8 residences, the garages would not present an appearance of bulkiness. The additional. setback applied to sites abutting lower intensity zones is intended to reduce the appearance of bulkiness that may result from taller, larger buildings on the more intense zone. In addition, this greater setback is intended to create a greater separation of noise producing areas of buildings ;i.e. , porches, open windows) between the different zones. The proposed garage locations should aid in reducing noises between the abutting properties by serving as a physical barrier to noise. If the garages are relocated to the inside of the development's internal roadway, the roadway and its noises would be separated from the abutting single-family residences by vegetative buffering materials only. If the garages are further reduced in size in order to s�cisfy the lesser setback standard applicable to smaller acco .asory structures, a greater number and area of breaks between the buildings would result. This would provide greater opportunities for noise to travel between the abutting properties. For these reasons, allowance of the variance would be expected to be a benefit rather than a detriment to adjacent properties and uses. The requested variance would not vary uses allowed on the site or within a required buffer area, but instead would vary a dimensional criteria only. The requested variance would have no apparent effect on any physical or natural systems and would have no apparent of,`.-site impacts except fo: a positive effect on noise migration as described above. The 30 foot building setback the requested variance is intended to avoid is not a hardship that would really affect the proposed development, but instead may be a hardship to adjacent properties that would not be as well buffered and screened from the noise and other possible impacts of the proposed higher intensity residential use. The criteria for a variance to a Code standard are therefore satisfied. The proposed garages of 1.000 square feet or less in size may be located closer than the 30 foot standard side and rear yard setback applicable to this site, but can be no closer than 10 feet from the site's boundaries. Lot Line Adjustment The proposed lot line adjustment between tax lots 3600 and 801 complies with applicable Code standards. Doth resultant parcels would continue to exceed the minimum lot size standards of their respective zones. Tax lot 3600 will continue to exceed the 65 foot average minimum lot width standard of the R-3.5 zone. No minimum average lot width is r.equLred in the R-25 zoning district applied to tax lot 801 and the portion of tax lot 3600 which is to be added to it. No buildings exist on either lot so building setbacks are not affected by the proposed adjustment. C.
