Red Rork Creek is a water quality limited stream and turbidity monitoring reports must be submitted to Oregon Department of Environmental Quality (See Implementation Conditions # 13 and #14, Enclosure 4). This letter verifies that your proposed activities as presented in your application (Enclosure 1) are authorized under the terms and limitations of Nationwide Permit Number 26, as described in Enclosure 2. However, Section 401 water quality certification from the Oregon Department of Environmental Quality (DEQ) has not been issued for this nationwide permit. 'Therefore, this authorization will not become valid until certification is issued. By copy of this letter, we are notifying DEQ of your proposed work and thus requesting their certification. The certification will be considered by Mr. Tom Rosetta, Oregon Department of Environmental Quality, 811 S.W. Sixth Avenue, Portland, Oregon 97204-5694. When water quality certification has been issued, you must provide a copy, along with any imposed conditions, to this office. The City of Tigard has zoned the site for commercial use, and it is the last large commercial property in the Tigard Triangle,and one of the few undeveloped large parcels in the City Limits. There is an existing demand for big-box developments in the METRO area. Project Description: The project consists of developing the site into a 331,189 plus square feet commercial./retail center and associated parking. The center piece of the proposed development would be a 240,000 square foot pad, which would be used for a big box retail center. In addition there would be 5 -7 smaller pads. Most of the rest of the site would be used for parking. There are approximately 1.73 acres of wetlands on the site. The development would direc,ly impact 1.16 acres of the wetlands. The wetland impacts would be mitigated on site,per our approved Oregon Division of State Lands Permit and subsequent Nationwide Permit. Duc to scheduling,the project constriction will be phased. 'The grading for the relocation of the wetlands along Dartmouth may occur first. Subsequent removal of the existing 1.16 acres of wetlands may not occur unit the spring of 1999. There are n)other available sites withing the Tigard Triangle that meet the needs for this type of development. In addition, the developer has owned the property since the 1920's. They are trying to develop the property under their ownership. They have been trying to develop the property for approximately 15 years,and only recently has their any interest by commercial/retail concerns. Describe what measures you will use (before and after construction) to minimize impacts to the waterway or wetland. The portion of the site that will be undeveloped will be clearly marked,and a silt fence or hay bales will be installed along Its edge prior to any clearing or excavation. Construction in and around the wetlands will occur during the dry summer months to reduce runoff and sedimentation. Prior to the project going out for bids an erosion control plan will be developed. Runoff from the developed area will enter a water quality/detention facility prior to entering either the wetlands or natural drainages. Resource Replacement Mitigation Describe measures to be taken to replace unavoidably impacted wetland resources The project would impact approximately 1.16 acres of the 1.73 acres of wetlands on and off the site(76,842 sq. ft), The wetland impacts would be mitigated for on-site. The project proposes to relocated most of the drainage which bisects the property further to the north. It would nun parallel to Dartmouth Road. The relocated portion of the drainage and its associated wetlands would be 1.16 acres, and there would be a 15 foot wide buffer strip on both sides of the drainage. The wetland along the drainage would be planted to scrub-shrub species, with a grass/sedge understory. The existing mitigation area consists of a shallow water emergent wetland and island complex with higher area of land banks planted to trees and shrubs. The islands are primarily scrub-shrubs forested wetlands. The emergent wetland,;are designed to be narrow bands between scrub-schrub community. The forested bands will consist of a mixture of Oregon ash and Douglas hawthorn. This is intended to replace 18 Oregon ash that are within the wetland that would be impacted. In addition, the avoided wetlands will be enhanced by planting trees and scrubs (16.304).
