Plug all pipe outlets with suitable test plugs. Brace each plug securely. 3. If the pipe to be tested is submerged in ground water, insert a pipe probe, by boring or jetting, into the backfill material adiacent to the center of the pipe, and determine the pressure in the probe when air passes slowly through it. This is the back pressure due to ground water submergence over the end of the probe. All gauge pressures in the test should be increased by this amount. 4. Add air slowly to the portion of the pipe installation under test until the internal air pressure is raised to 4.0 psig. 5. Check exposed pipe and plugs for abnormal leakage by coating with a soap solution. If any failures are observed, bleed off air and make necessary repairs. G. After an internal pressure of 4.0 psig is obtained, allow at least two minutes for air temperature to stcbilize, adding only the amount of air required to maintain pressure. 7. After the two minute period, disconnect air supply. 9. When pressure decreases 3.5 psig, start stopwatch. Determine the time in seconds that is required for the internal air pressure to reach 2.5 psig. This time interval should then be compared with the time required in seconds as computed on reverse side of sheet. 9. List siza and length of all. portions of pipe under test in table similar to one shown on reverse side of sheet. 10. By use of nomograph, compute K and C. Use scales d and L, read K and C, and enter these values in the table on reverse side of sheet. 11. Add all values of K and all values of C for pipe under test. 12. If the total of all C values is less than one, enter the total of all K values into the space fur "Time Required in Seconds." 13. If the total of all C values is greater than one, divide the total of all K values, by the total of all C values, to get tq. PROCEDURE FOR CONDUCTING ACCEPTANCE TEST 1. Clean pipe to be tested by propelling snug fitting inflated rubber ball through the pipe with water. 2. Plug all pipe outlets with suitable test plugs. Brace each plLg urely. 3. If the pipe to be tested is submerged in grourd water, insert a pipe probe, by boring or jetting, into the backfill material adjacent to she center of the pipe, and determine the pressure in the probe when air passes slowly through it. This is the back pressure due to grou:id water submergence o%e.r the end of the probe. All gauge pressures iu the test should be increase.": by this amount. 4. Add air slowly to the portion of the pipe installation under test until the internal air pressure is raised to 4.0 psig. 5. Check exposed pipe and plugs for bbnormal leakage by coating with a soap solution. If any failures are observed, bleed off air and make necessary repairs. 6. After an internal pressure of 4.0 psig is obtained, allow at least two minutes for air temperature to stabilize, adding oiily the amount of air required to maintain pressure. 7. After the two minute period, disconnect air supply. 8. When pressure decreases to 3.5 psig, start stopwatch. Determine the time in seconds that is required for the internal air pressure to reach 2.5 psig. This time interval should then be compared with the time required in seconds as computed on reverse side of. sheet. 9. List siza and length of all portions of pipe under test in table similar to one shown on LevPrse side of sheet. 10. By use of nomograph, compute K and C. Use scales d and L, read K and C, end enter these valuer in the table on r_ •arse side of sheet. 11. Add all values of K and all values of C for pipe under test. 12. If the total of all C values is less than one, enter the total of all K values into the space for "Time Required in Seconds." 13. If the total of all C values is greater than one, divide the total of all K values, by the total of all C values, to get tq. To make this division with the nomograph, use scales C and K, and read tq. A.Anderson S(1P.IF.C7• SFWFR F.ASFMFNT5 Date December 11, 1973 I rcturn to you heretith the blcnla eaAement document which accompanied your note of November 21 and which we discussed, as I recall , on one occasion vhe•l I was in your office about the date of your memo. F.asemen a are generally cetegarited as "easements appurtenant" "o-nnemonts in gross". »cements appurtenant are appurtenant to a piece of property and title to the easement passes along with the title to the tract rf which it ie an anpurtenanee ,and the separation of the two, one from the other, does not generally occur. The grantee of the tract to which the eaeement in an appurtenance -an pass the easement »lora, to others ae an inotdent of the sale or grant of a portion of the tract in chief. FasemenLa in dross are not usually related to any tract but are granted for spee.e!a or general purposes either public or private. I'i,hlic easements generally are easements in groes and this is particularly true of sewer easements , water line easements, public road easements, telephone easements , power line easements etc. In the instant case, you have indicated that Fastgatp Theatres , Inc, granted an easement to Pier.:e , WF.bber, Drumm and Kesler for sewer conduits, and the document, copy of whish you supplied, specifically states that "said easement ! to 1)r appur- tenant to pertain sal property now owned by the Orantees lying and situwted Northers; of the Nurtherly bouneAry of the real prop- erty hen.-inabove described". This obviously is an issement appur- tenant , and grantees of an easement appurtenant may not properly reconvey the easement apart from the tract to which it is appur- tenant , to the City of Tigard or to anyone Plop. It is further noted that the easemmnt document does not specify w,ietl.er the easement area In granted for exclusive or non-exclusive purposes and therefore, tt would pr^:,ably be construed that the rights therety grantee are exclusive. Accordingly, 4n oreer for the city tp obtain an easement in vrons to construct a sewer line as a part of the City's general public sewer netwcrk, not relating to any particular tract. , the City should require execution of thow easement instrument by not only all parties having an ownership or possessory interest in the trart In which thR easement area oos:urs, but am well by the persons who own the tract l'or the benefit of which the prior easdment appurtenan', was granted, In this chap I understand that the grantors necessari'l) would be Fastgete Theatres, Inc. , as owners of the tract on which the (-asemont 18 imposad, and 011bert C. Pierce , John D. Webber, Virginia )rumor and Jules Ressler, grantees in the outstanding ease- ment, or their successors in interest to the tract or any part thereof of which the granted easement is an appurtenance, PAA!ob Fred.
