This agreement is between the Unified Sewerage Agency of
War:hington County, Oregon, a municipal corporation, called
"Ajoncy," and Tualatin Development Co., Inc., an Oregon
corporation', called "TDC."
WHEREAS:
1. TDC is desirous of obtaining from Agency approval of
TDC's proposal to provide sewage disposal service for the
Summerfield development, including temporary connection with
the King City sewage disposal plant, and
2. Agency is desirous of insuring that the efficient
operation of the King City plant will not be impaired and that
the operation of said plant will be discontinued as soon as
feasible.
It is agreed by TDC in consideration of Agency's promise
to approve TDC's sewage disposal proposal for. its Sv,nmerfield
development, which promise is made by Agency in reliance upon
the faithful performance of the germs of this agreement by
Vic and contingent upon compliance with all ].awful conditions
precedent to approval imposed by Agency, ghat:
1. 7'DC will not expand the Sunmierfiel.d sewage collection
system or allow occupancy of any houses in the Summerfi.old
development unless Agency determines that the King City plant
has sufficient capacity to allow such expansion or occupancy.
2. TDC wi.tl operate and maintain with no liability to Agency
the Summerfield pump station and pressure main.
3. "t the point in time that the Tualatin River Interceptor
and Ilia ourham Waste Water Treatment Plant are operational,
TDC wi..11 remove the Siumner.field pump station and construct a
gravity sewer line from the pump station location to the
Tualatin River IntercepLor. Stich construction will be performed
wiihin one year from the date of availability of connection to
the Tualatin River Interceptor and in accordance with applicable
rules and regulations of Agency. Such cons trnct..ion shall be at
'1.'DC's expense unless the Agency shall agree to a plan of reitnburse-
ment.
4. TDC will continue to comply with all present and future
lawful rules, regulations and determinations of Agency.

Your consulting engineer, 11arris-McMonagle Associates, has submitted
plans to us for construction of interim pimping facility to transmit
sewage from your Summerfield project to the King City Sewage Treatment
Plant.
The Unified Sewerage: Agency, City of Tigard, Dl"-Q, Tualatin Development
Company and Elarris McMonagle Associates have all been ir-olved in
formalization of plans for providing sewer service to the Summerfield
Development, Many written and verbal proposals have been made concerning
the method and duration of providing this service. We feel that it would"
be to the best interest of all those involved to have a formal agreement
summerizing the previous written and verbal commitments.
We suggest that an agreement be made between the Unified Sewerage Agency
and the Tualatin Development Company and that the agreement cover the
following items :
1) Approval of future expansion of the Summerfield Sewage Collection
System shall be contingent upon plant capacity at the King City
Plant.
2) Operation and maintenance of the Summerfield Pump Station and
Pr-ssure Main shall be the responsibility of Tualatin Development
Company.
3) A plan be submitted covering the timely removal of the Stmnnerfield
Pump Station and construction of a gravity sewer line to the
Agency's Tualatin River Interceptor when the Durham Waste Weter
Treatment Plant and Tualatin River Interceptor are operational.
This has beer verbally agreed to by your engineers.
