S--14- 1 -,%"j ��-� bk r,S"I`T'NSC�JS CITY ®F TIG�RRD April 10, 1991 OREGON Irvin and Christine Black 14945 SW 100th Avenue Tigard, OR 97224 Dear Mr. & Mrs. Black: In my letter of February 27, 1991, I mentioned that it may be necessary to improve drainage along the drainace easement that crosses your lot. Since then, a video inspection of the interior of the drain line has shown that it is partially crushed about eight feet above the ditch inlet. As Chris Davies explained to you on April 5, 1991, this will require that either the easement be restored to its original condition or that the pipe be replaced with a properly sized and constructed storm drain. If the existing line was replaced with a proper storm drain, it could be accepted by the City for maintenance. This would require replacing your existing pipe with a 12-inch pipe installed to City standards as described on the attached partially completed permit application that would be required for the work. The line should be inspected by the City before it is covered. This application would require the .information requested in Section 1 . as well. as a simple sketch showing the location of the line by measuring the distance from it to your house. Upon your return of the requested information, we will prepare the final permit. Please note that the fee and security normally required for this permit has been waived. If you shoo:3e to restore the eacenlent instead of replacing the line, a similar permit would be required. It appears likely that there will be an emphasis on non-auto modes of transportation. • Air Emissions (HB 2175) - TVEDC's concern with proposed hill is that it is a "blank check" to DEQ for assessing fees for anything DEQ could reasonably link to the auto. • Western Bypass Study is continuing on schedule, Issues (including litigation) are expected to be centered around land use decision points. It is possible that the ODOT study will not conclude with a recommendation that the Western Bypass be built. • Urban Renewal - TVEDC testified at legislature to bring attention to the perspective of urban renewal and economic development/stability. It appears that "tax increment financing" will be included in the $10 property tax limit as provisioned by Ballot Measl•..e 5. Metro_Charter Commission Mayor Edwards adv-Ased the City of Tigard must submit a name of an appointi.i,nt nominee representing Washington County cities on the Metro Charter Commission. He asked Mary Tobias if she would be willing to serve and she indicated she would be pleased to have her name placed in nomination. "Tigard officials feel that Ms. `lobirrs would be an excellent choice because of tier knowledge of the region and the governmental agencies in the area. She has also proven to be a valuable liaison between the private and public sectors. COUNCIL MEETING RECAP - APRIL 9, 1991 PAGE 1 Oregon Depa_rtWnt of Transportation ( IQ )OT) - Western Bypass Study Mike Wert of ODOT overviewed the steps necessary to the Western Bypass Study. Some of the requirements are federally imposed. A range of reasonable, alternatives for the Bypass must be thoroughly examined. The first step is adoption of an intergovernmenial agreement (IGA) which is intended to ass-,re that all nine .-urisdict►ons: • participate in the decision-making process • that the process is consistent with state land-use regulations • that any decisions made are consistent with local comprehensive plans • that there is a coordinated citizen involvement program The proposed IGA is on the consent agenda (Item 4.2) Councilor Johnson noted concerns in supporting the IGA if alternatives identified included routes which were opposed by Tigard residents. Mayor Edwards and Councilors Kasten and Schwartz advised that they felt Tigard should enter into the IGA; however, when options are considered, they would then voice concerns on those which they felt would not be in the best interest of 'Tigard. 'I'riad - Arbor Heights-Apartmen_t�09th and Naeve Council advised City Attorney that the City will require the developer to resubmit an application for development approval. This will require a new public hearing before the Planning Commission. Prior to the hearing, the NPO and interested parties will have an opportunity to review and comment on the new application. Proclamation Mayor Edwards proclaimed April as National Fair Housing Month Visitor's A&nda Bob Smithson, 14977 S.W. 100th Street noted problems with storm water runoff from his neighbors' property. He advised that his septic system was failing because of excessive storm water percolation. Staff has visited the site. The storm drain on the neighbors' (Mr. and Mrs. Black) property was found to be crushed. The Blacks have been notified that repairs to the storm drain pipe on their property must be made as soon as possible. 11 Mr. Smithson advised that the drainage ditch along his property has eroded so that the water line is now exposed. He notified the Water District and they placed some temporary material around the line. !lowever, Mr. Smithson is concerned about City crews breaking the line when they clean the ditch. We expect to solve much of the problem by providing upstream erosion control to prevent the ,ilt from reaching the inlet; however, erosion control alone is not sufficient to prevent this inlet from being a continual maintenance problem to the City. As you recall, the property owners at 14977 SW 100th Avenue recently had the basement of their home flooded during a rain storm. As a result, the City has been investigating the condition of the d.-ainage system in the vicinity. On a recent_ visit to your property we discovered the source of silt that has been filling up the culvert south of your property and causing the flooding. The problem is a culvert, located under the driveway into the tree farm, that is 1) not of adequate capacity to allow proper drainage of storm water and 2) elevated so high above the bottom of the drainageway that it washes out the bank of the drainageway. The inadequate size of the culvert causes an overflow which in turn erodes the soil outside the drainageway and carries large quantities of silt into the drainage system below your property. The City has no record of an application for a permit: to install this culvert in the public easement. As noted in the attached memo from Greg Berry, the City's Utilities Engineer, the erosion caused by the undersized culvert is a violat'on of Chapter 1 of the Unified Sewerage Agency's Erosion Control Rules. Recognizing that you may be unaware of these rules, I have included a copy for your review. Please contact me no later than February 22, 1991 to discuss possible solutions to this problem. Most of the erosion from this site appears to be caused by a culvert under a driveway. The culvert has inadequate capacity causing the driveway to overflow during rain storms . This has caused a rivulet to form parallel to the channel that crosses the tree farm. This rivulet appears to be the source of the erosion that caused the storm drain failure. Petitioner shall proceed to complete &Al public improvements as shown on the improvement plan, as appro%lod by the City of Tigard and prepared by John Middleton,_ P.E. ^^ dated _Dri1 9, 1987 _• Said improvements to be completed no later thasi one (1) year from the date of thi3 agreement, and Petitioner hereby agrees tc comply with all staraard specifications adopted by this City, or as may otherwise be approved by tha Department of Community Development ani+ to use only such material and to follow such designs as is required to conform thereto. Petitioner shall provide certification of installatiin conformance and one as-built mylar, both stamped by a registered civil eng neer, to the City prior to City inspection of petitioners _-iprovemenl work for, City tentative acceptance coii3ideration. 2 . To a3SL1r•e compliance with the City' s requirements and the )revisions thereof, Petitions- agrees to provide h,2rewith and tender- to tha City, a surety bord(s) in i,irm approved by the City, with liability in the amount equal to the contract price of $_ .OG _ prior to issuance of a permit for constructic,n of said improvements; Petitioner' s contractor shall be licensed, and insured as required. 1 3 . In the event that the contractor shall fail, neglect or refuse to proceed with the work in an orderly and progressive manner to assure completion within the time specified, upon ten (10) days notice by the City to the Petitioner and Petitioner' s surety, and such default and failure to proceed continuing thereafter, the City may at its option proceed to have the work completed and charge the costs thereof against the Petitioner and the Petitioner' s surety and in the event the same be not paid, to bring an action on the said bond to recover the amount thereof, In the event that such action be brought, the Petitioner and the Petitioner's surety shall be required to promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the court shall adjudge rea�cnable as attorney' s fees and cost incurred by the City, both in th.� Trial Cr,Art and Appellate Court, if any, or the City may at its option bring proceedings to enforce against the petitioner anu/or Petitioner' s surety, specific performance of the contract and compliance with tho standards adopted by the City or Tigard, and in any event, in a like manner, the City shall he entitled to recover s+ich sums as the Court may adjudges reasonable for the city' !; attorney' s fees and cost, both in the Trial Court and Appellate Court, if any . 4 . Petitioner, concurrent with the execution hereof, agrees to pay the following fees as required by the City of Tigard: a. A plan check fee to cover the cost of review and approval of construction plans in the amount of b. A permit fee to cover the cost of processing the permit application and performing the inspection of sewer construction, in the amount of $(incl. in "a" above), C . A connection charge to connect directly to an existing sewer, which was installed with/without (strike inapplicably word) cost to the petitioner, in the amount of $ -N.A.- d. N.A.-d. A monthly sewer service charga for the use of public sewer system in the amount of $- N.A. 5. Petitioner, concurrent with the execution hereof, also agrees to piy a surcharge in the amount of $ -N•A•- as required by that certain coot race entered into by the City with _-N.A.- for tho reimbursement of sewer co:;struction costs pertinent thereto. b. The City agrees to make periodic inspections as, in the City' s judgment, is necessary to assure compliance. 7. The Petitioner agrees to insure that the, City receives 48-hour advance notice of commencement of construction and, also, 12-hour advance notice for all requested field inspections . 8 , The Petitioner, +grges to insure Uiat the Petitioner' ,.; engineer obtains accurate as-built (field) cinstruction records of said Sewer installation and, also, agrees to insu, e that the City is furnished with one accurate as built mylar thereof. 2 _. 9. At such time as all public improvements have been completed in accordance with the City' s requirements, Petitioner shall submit a certificate of installation conformance" tc the City to notify the City of readiness for acceptance inspection and then, upon notification by the Department of Community Development that the requirements of the City have been met, the Petitioner will s:,bmit to the City a good and sufficient guarantee bond, if not already provided with the performance bond, in the form approved by the City, to provide for correction of any defective work or maintenance becoming apparent or arising within one year after tentative acceptance of the public improvements by the City. 10, Upon receipt of certification by the Department of Community Development, that all requirements have been ^-et, and a one-hear Guarantee Bond, the City agrees to accept the puhlic impru•iements, subject to the requirements of correction of deficiencies and maint nance for a period of one year. 11 , Petitioner agrees to provide for correction of any defective work and/or maintenance becoming apparent or arising during the guarantee period. 12. At such time as all public improvements have been cowp!nt..?J in accordance with the City' s requirements, Petitioner shall notify the City of readiness for final inspection and upon certification by tKe Department of Community Development that all requirements of the City save been diet, the Council agrees to accept said improvements, for operat'`on and maintenance responsibility, and r�iease the Petitioner' s guarant( r bond. 13 . That the Petitioner, in consideration of tho. City' s approval of the application to construct a storm sewer within the boundaries of easements held by or to be. held by the City, does hereby covenant and agree to save, hold harmless and indemnify the City, its officers, agents and employees, for and from all claims, demands, damages, and aach and every other obligation that can or could arise from the neglect of Petitioner, his officers agents, contractors and employes, or from trespass upon property outside of the easement area, including attorney' s fees nd costs, if any, necessarily incurred by the City in defending against such claims, with the intent and purpose chat the City shall be made whole with respect to any amounts it may be required to pay or be held liable for in connection with the exercise of the :,rivileges afforded Petitioner to utilize the area within the City' s easement for sower construction purposes . License 1 19305 r � ly OPU Z'l ,(y R� Etc � �_ i •4. � t \ 21 " G4M s M+.'+.. ?Kms' �'..� STORM SEWER COMPLIANCE AGREEMENT THIS AGREEMENT dated this _ day of between the CITY OF TIGARD, a municipality of the State of Oregon, hereinafter termed the "City", and Mr. Robert Smith9gn, an individual' her.einaiter termed "Petitioner", ` W I T N E S S E i H: WHEREAS, Petitioner has applied to the City for approval of construction of a storm sewer, to be known as Smithson Storm Seder being within the boundaries of an areas as described on the attached Exhibit "A" and by reference made a part hereof; and WHEREAS, the City of Tigard requires applicants for construction of sewers, and appurtenances thereto, to submit to construction inspection, and testing therewithal, to grant public easements, therefor, and requirc's the payment of fees; and WHEREAS, the City has adopted the Standard Specifications for Public Works Construction Oregon Chapter APWA, for street, storm drain, str•uctura and related work, and the Uniform Building Code, prepared by professionals for public improvement construction; and WHEREAS the public improvements required to be constructioned are incomplete, and petitioner has nonetheless requested that the City permit granting of easements to the public, and the parties herein named desire to protect the public interest and assure that the improvement will be installed as rejuired and completed within the time hereinafter set forth, NOW, THEREFORE, in consideration of the foregoing premise and the covenants and agreements to be kept and performed by the Petitioner, and Petitioner's Surety, IT IS HEREBY AGREED AS FOLLOWS: I . Petitioner shall proceed to complete all public improvements as shown on the improvement plan, as approved by the City of Tigard and proipared by John_Middlekon, P.E. dated April 9, 1987 Said improvements to be completed no later than one (1) year from the date of this agreement, and Petitioner hereby agrees to comply with all standard specifications adopted by this City, or as may otherwise be approved by the Department of Community Development and to use only such material and to follow such designs as is required to conform thereto, Petitioner shall provide certification of installation conformance and one as—built mylar, both stamped by a registered civil engineer, to the City prior to City inspection of petitioners improvement work for City tentative acceptance consideration 2. To assure compliance with the City' s requiremerits and the provisions thereof, Petitioner agrees to provide herewith and tender to the City, a surety bond(s) in form approved by the City, with liability in the amount equal to the coritra( t price of $ 2025.00 ___ prior to issuance of a permit for construction of said improvements; Petitioner' s contractar shall be licensed, and insured a.: required. 1 - ' / . shall fail, neglect or refuse to 3 . In the event that the contractor 9 proceed with the work in an orderly and progressive manner to assure completion within the time specified, upon ten (10) days notice by the City to the Petitioner and Petitioner' s surety, and such default and failure to proceed continuing thereafter, the City may at its option proceed to have the work completed and charge the costs thereof against the Petitioner and the Petitioner' s surety and in the event the same ke not paid, to bring an action on the said bond to recover the amount thereof. In the event that such action be brought, the Petitioner and the Petitioner' s surety Shall be required to promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the court shall adjudge reasonable as attorney' s fees and cost incurred by the City, both in the Trial C.-)urt and Appellate Court, if any, or the City may at its option bring proceedings to enforce against the petitioner and, or Petitioner' s surety, specific performance of the contract and compliance with the standards adopted by the City of Tigard, and in any event, in a like manner, the City shall be entitled to recover such sums Rs the Court may adjudge reasonable for the City' s attorney' s fees and co°t, both in the Trial Court and Appellate Court, if any . 4 . Petitioner, concurrent with the execution hereof, agrees to pay the following fees as required by the City of Tigard: a.. A plan check fee to cover the cost of review and approval of construction plans in the amount of $ 81.00 b. A permit fee to cover the cost of processing the permit application and performing the inspection of sewer construction, in the amount of $(incl. in "a" above). C . A connection charge to connect directly to an existing sewor, which was installed with/without (strike inapplicable word) cost to the petitioner, in the amount of $ -N.A.-�____�.____ d . A monthly sewer service charge for the use of public sewer system in the amount of $- N.A. 5. Petitioner, concurrent with the execution hereof, also agrees to pay a surcharge in the amount of $_-N.A.- _ as required by that certain contract entered into by the City with _ -N.A.- for the reimbursement of sewer construction costs pertinent thereto. 6. The City agrees to make po7iodic inspections as, in the City' s judgment, is necessary to assure compliance. 7. The Petitioner agrees to in: re that the City receives 49- hour advance notice of commencement of construction and, also, 17.-hour advance notice for all requested field inspections B . The Petitioner agrees to insure that the Petitioner' s engineer obtains accurate as-built (field) construction records of said sewer installation and, also, agrees to insure that the City is furnished with one accurate an built m +r thereof . 2 9. At such time as 111 public improvements have been ci.imp10ted in accordance with t.ho City' s requirements, Petitioner shall submit a "certificate of installation conformance" to the City to notify the City of readiness for acceptance inspection and then, upon notification by the Department of Community Development that the requirements of the City have been met, the P2titioner will submit to the City a good arid sufficient guarantee Innrl, if not already provided with the performance bond, in the form approved by the City, to provide for correction of any defective work or• maintenance becoming apparent or arising within one year after tentative acceptance of the public improvements by the City . 10. Upon receipt of certification by the Department of Commun.it.y Development, that all requirements have boon meet, and a one-year guarantee Bond, the City agrees to accept the public improvements, subject to the requirements of correction of deficiencies arid maintenance for a period of one year. 11 . Petitioner agrees to provide for correction of any defective work and/or maintenance becoming apparent or arising during the guarantee period . 12 . At such time as all public improvements have been completed in accordance w_th the City' s requirements, Petitioner shall notify the City of readiness for• final inspection and upon certification by the Department of Community Dae.elopment that all requirements of the City have been met, the Council agrees to adept said improvements, for operation and maintenance responsibility, and release the Petitioner' s guarantee bond. 13 .
