Re: Case No, SC6726 — Dorwin D. Thatcher vs. City of Tigard
Enclosed is the defendant's answer form which denies the claim filed against
the City. The City of Tigard is joining Harris 6 McMonagle Associates, Inc.
and Stuart L. Cato (individually) as third party defendants in the case. The
grounds for this action is as follows: Harris & McMonagle submitted "as
built" drawings signed by Stuart L. Cato to the City which are alleged to be
in error. Mr. Thatcher relied on the drawings and had brought this action
against the City for costs resulting from the "as builts" alleged to be in
error.
The enclosed check represents $20.30 as the defendant's answer fee and $15.00
service fee for serving the third r,,.ity defendants. Please be advised the

RE: Letter from Consumer Sounding Board dated 4/24/84.
Dear Mr. Thatcher:
Standard operating procedure in Tigard is to provide the contractor or person
applying for the permit a copy of the actual "as built" plan similar to the
enclosed plan.
Standard operating procedure in the U.S.A. service area is to dig three feet
either side of the location given. If the service is not found the agency
issuing the permit should be contacted to verify if in fact that your
contractor has dug where the lateral location was indicated.
A field inspection on site on May 9, 1984, shows that the location of the
lateral was within 5 to 6 feet of where the "as built" had indicated it should
be. Further, a prudent contractor would notice that the service line is
connected to a 3' deep by 4' diameter manhole. A cursory look in the manhole
would have shown that the lateral entered at an angle. There is a note on the
plan that no marker was placed.
Our public works department supervisor reports that you returned complaining
tn.t the sewer was too low to serve your property. This was after the lot had
been lowered several feet at the sewer location. No information was provided
that the alignment was incorrect , I would appear from our field inspection
that you had to reconnect to the lateral 15 feet out from the manhole to gain
enough grace to serve tt!: house that was built on a lot that was lowered from
the time the sewer was installed.
Clear and sufficient information was easily available to any prudent
contractor to determine the location of this sewer lateral.
I can see no ne-ligence on the part of the city in this matter. Ali this
information was available prior to construction of the house. Please contact
our Engineering Divinion if you require any further specifics. if you feel
the need to pursue your claim against the City, we will review the claim and
forward it to our insurance carrier for processing.

PROCEDURE AND INSTRUCTIONS Etfective October 15, 1983
1. The purpose of the Small Claims Department is to decide civil disputes promptly and
economically. The hearings are informal, with Plaintiff and Defendant apnearinq without
attorneys. There is no appeal from a decision in the Small Claims Department.
2. You may file for any amount, as lona as you do not go over $1000. In most cases the
claim must be filed in the county where the Defendant resides, although there are some
exceptions. Contact the Clerk if you have any questions.
3. A Small Claim must be filed in the form prescribed by the Court. If assumed business
name, all individuals in ownership should be named, then 'dba' the business name. If
corporation, only corporate name is named as Defendant, but you will need to show the
name and address of the registered anent for service of the claim papers.
4. If the claim is to recover specific personal property, you should leave blank the amount
claimed and describe the property claimed, and aive its value. (not over $1000)
5. The original Claim must be sworn to an(I signed in the presence of a Notary Public or
the Clerk of the District Court, Small Claims Department.
6. The original Claim and copies must be filed with the Clerk of the District Court,
Small Claims Department, Washington County Courthouse, Hillsboro, Oregon 97124.
7. You must pay a Small Claims filinq fee of $35.80 payable to District Court at the time
the claim is filed.

On June 1, 1981 we sent a letter requesting that we be released
from liability on the above sewer extension. A copy of that
letter is enclosed.
To date, we have received no such release and have been advised
by our bonding company, United Pacific Reliance, that until they
receive written notice from the City of Tigard, they cannot let
the bond lapse.
We are very concerned that our previous request was not acted
upon and wish to notify you that we are not renewing the bond
on "McCoy Estates". Kevington has a current bond.
If there are reasons for such a long delay and further information
is needed, please let us know.

MENTS KNOWN AS THE KIMBERLY (MCCOY) SANITARY SEWER EXTENSION, NERALLY LOCATED
WEST OF S.W. 98TH AVENUE ON SW KIMBERLY DRIVE.
WHEREAS, the City executed a Sanitary Sewer Compl'.ance Agreement, dated
April 14, 1980, with Kazebee-Marshall Construction Co,ipany, to install a public
sanitary sewer line and appurtenances thereto, to specified standards; and
WHEREAS, the Compliance Agreement stipulates that:
"Upon receipt of certification by the Department of Public Works that all
requirements have been met and a One Year Maintenance Bond, the City
Council agrees to accept the public improvements, subject to the
requirements for correction of deficiencies and maintenance for a
period of one year. . ."; and
WHEREAS, the original performance bond, in lieu of a seperate maintenance
bond, has remained in full force and effect throughout the normally required
maintenance period of one year, and
WHEREAS, the Public Works Department has now certified that the specific terms
and conditions of said agreement and bond have been satisfactorily completed; and
WHEREAS, no deficiencies remain to be corrected thereinregard,

Your construction or improvements must be completed in accordance with
the plans and specifications attached. No funds will be released prior
to comp .etion. Please retain r�•cvipted itemized bills if you desire
reimbursement.
Changes may have been made in your plans and specifications so that your
home will meet acceptable standards. Any revisions must be discussed with
your contractor or suppliers; and if the cost of your construction is
altered, an amendment to your contract cost estimates must be sub—
mitted to this office.
Your copy of the plans and specifications must be signed and dated by you
and your contractor and be available at the building site. No inspection
will he made unless they are available to our representative.
Inspections will be required at the following stages. Please contact me
at 643-4693 when you are ready for an inspection:
Before covering the interior walls by 3/29/80. Do not cover struc—
tural framing until this inspection has been made. Construction at
this stage is to include rough—in plumbing and wiring, heating duct
work, and fireplace/chimney if proposed.
