has filed an applicatiot, with the County Court for permission to install a sewer
line or lines for the transmission of sewage along, over and/or across certain
County roads; and
WIIEREAS, the matter having been fully considered by the Washington Count;
Court anti it being the opinion and judgment of said Cott that the application
Should be granted and a permit as ptayed for therein should be issued:

Cuurtty roads at the locations as hereinafter more particularly described, be
approved and that permit be granted the said Applicant to install said sewer line
or lines alon, or across said County roads within the limits bounded and described

SUBJECT, iIOWEVER, to and upon the following terms, conditions, requirements end
arreements:
GE;IrM PROVISIONS
1. The word Roadmaster, as herein used, shall mean the County Roadmaster or
his drly authorized representative_.
2. Vie '.pplicant herein agrees to employ any and all methods in tho conetru_ -
ti.on of said sewer lines which the Roadmaster may require in order to properly
protect the County reads from damage both during, construction of said sewer lines
and subsequent to their completion.
3. During the installation or construction of said sewer linea and during
the repair of said lines, the l.pplicant shall at all times maintain such watchmen,
barricades and other safety devices as may be necessary to properly protect traffic
urcri said County roads and to warn and safeguard the public against injury or
damage resulting from the operations of Raid Applicant in the construction and
maintenance of said sewer lines. ALL barriradrs and obstructions shall bear
lighted signal lights during the hours between sunset and sunrise.
4. The Applicant shall indemnify and hold hatmless the Washington County Couto
Washington County, and all of the officers, employees or agents of the Washtrp,trn
flounty Court and the menbers thereof, against any and all damages, claims, demandr
actions, cause of arl-ion, costs and expenses of whatever nature which may result
from any injury to or death of any person, or for the loss or damage to property
of any hind or nature, including the County road facilities or structures, prop-
erty or equipment used or owned by Washington County or the County Court, and
facilities such as wires, lines, poles or pipe liner., which may now or may hereafter
occupy the right of way if said County roads, when such injury, death, lose or
riamage is due to the existence u. said sewer lines or to the construction, installri
tion, matntennnee, repair, remcval, operation or use thereof, or to the contents
therein or therefrom.

5. The Applicant shall so conduct his construction that there shall be no
interference or interruption of the traffic upon and alcng the County roads.
The Roadmaeter may specify details in connection with the handling of traffic
laid such specifications shall be complied with by the Applicant.
6. This permit is issued with the specific understanding that the same is
subject to all existing public and private rights in and to the right of way of
the County roads, and the same constituteE the consent of the Washinctor, County
Court to the installation of the said sewer lines only to the extent that the
llashington County Court has legal authority to grant such consent.
7. If at any time in the judgment of the County Court the presence of said
newer line upon the right of way of said County road is detrimental to the inter-
cE,ts of said County roads or to the proper repair, maintenance or reconstruction
of the same, the Washington County Court may give notice of such fact to said
,Applicant, and upon receipt of ouch notice the Applicant agrees to conform promptly
to the requirements of the Washington County Court with respect thereto.
6. The said Applicant shall at all times keep said sewer line free 'rom all
leaks and in a ^,00d btate of repair so that no damage or injury will he dale to
the said County roads.
9. The entire cost of instailing said sewer lines, includin^ the cost of
materials, trenching, laying_, backfilling, supervision and inspection, and any
other expense whatever incident thereto, in to be paid by the Applicant. The
Applicant shall reimburse the Washington County Court for any and all expenses
incurred by said Washington County Court in connection with s id inst. tlation,
and such reimbursement shall be made by said applicant within en (10) days after
being billed therefor by the Washington County Court.
10. Any supervision or control exercised by the Roadmaeter shall. in no way
relieve the Applicant of any duty or responsibility to the general public, nor
shall such supervision or control relieve said Applicant of any liability for
loss, damage or injury to persons or property wistained by reason of the inotallati')
maintenance or repair of said sewer lines, nor of the Apolicant's liability for
damage to said County roads.
11. if for any reason it become, necessary in the judgment of the lloshington
County Court or the Roadmaeter to disconnect the said sewer lines or any section
thereof, for the purpose of: repair of the said County roads or any work or im-
provement thereon, or if the said County roads are being: damaged or endangered by
rr_asoa of the presence of said sewer lines, or the seepage of gas or liquid there-
from, the Washington County Court may give the said Applicant ten (10) days written
notice to turn off the gas or liqu+d, and should said Applicant fail or neglect to
do so, then the Washington County Court or the Roadmaster may disconnect said sewer
lines or turn off the gas or liquid, and by so doing neither the County, Wiahing,ton
Cmunt" Court, nor iu, Engineer, Roadmaeter or employees shall be liable either
officially or personally for any damage or injury sustained thereby, either by the
said Applicant. consumers or patrons, or persons to whom it owes a responsibility

12. It is understood and agreed that the Washington County Court shall not
be held responsible or liable for injury or damage that may occur to said sewer
linea or any connection or connections thereto, by reason of any ccnstructinn or
maintenance operations that may be carried on by or under the direction of either
the Washington County Court or any duly authorized representative of said Washing-
ton County Court, or by any perss-n constructing or installing, maintalnin;_ re-
pairing, operating or using any facility pursuant to n permit heretofore or here-
after issued by the Washington County Court.
13. Applicant or his contractor shall obtain liability and property damaga
insurance providing coverage against any clnim, demand, suit or action for propert,-
damage, personal injury or death, rebulting from any activities of the Applicant
and his or its officers, agents, employees and contractors, in connection with
the construction or maintenance operations of said sewer lines. ,:aid insurance
shall provide coverage in the amounts, $50,OOC.00 for property damage resulting
from any single occurrence, and $100,000.00 for the 6enth or injury of any person,
subject to a limit of $200,000.00 for the injuries or deaths resulting from a

single occurrence. Copies of such policy of policies of insurance. ,r certificates
evidencing the same, shall be submitted to and approved by the District Attorney
for Washington County before, any work is commenced under this permit. The Applicant
and/or his contractor's insurer shall give the Washirdton &1unty Court ten (10) days
wriLten notice in advance of any cancellation of 1-,surance reyvired in the terms of
this permit.
14. It is understood and agreed that. the AEplicant shall provide a surety bond
in favor of Washington County for the sum of Dollars to be effective
beginning on the date on which the Applicant's contractor shall enter upon the
right of way of said County roads pursuant to the terms hereunder and commence
excavation for the construction of said sewer lines. It is further understood
and agreed that the surety bond will remain in force for a period of five (5)
years following the completion of the construction and installation of said sewer
lines and repair of said County roads, in the event the Applicant has provided a
continuing surety bond in favor of Washington County, and said bond is of sufficient
amount to include this excavation and construction, as determined by the County Court
of Washington County, said bond shall be subject to the conditions and terms of this
permit.
15. It is further understood and rigreed that Applicant will inspect the
construction area, and repair and maintain defects resulting from the excavation
and construction for a period of five (5) years, from the date of termination if
said construction.
PROVISIONS RELATING TO LOCATION AND CONSTRUCTION
16. The backfilling of all trenches and tunnels must be accomplished immediately
after the sewer lines have been placed and tested and must be well tamped and com-
pncted so as to allow the least possible amount of subsequent settlement. All debris,
refuse and waste of all finds which may have accumulated upon the said right of way
by reason of the operation of the within named applicant or his contractor must be
removed immediately upon completition of said construction operation and the right of
way must be restored to at least as good A condition as it was prior to such opera-
tion. All worK in connection with said sewer lines construction must be done in a
neat and workmanlike manner and under the general supervision of the Roadmsster
whose decision shall he final with respect to any of the terms, conditions, stipula-
tions and provisions of this permit and must meet with his approval.
17. Where said sewer linea cruse the County roads they shall be installed on
a line as described in this permit.
18. At no point shall the top of the sewer lines be lose than thirty-six (36)
inches below the grade of the road or beneath the surface of the ground at that
point, if the ground be lawer than the grade of the County roads.
19. Where the sewer lines are in the traveled portion of paved roadway the
top twelve (12) inches of backfill shall be ten (10) tnches of 2"-0 compacted base
rock and the remaining two (2) inches (leveling course) shall consist of 3/4" minus
crushed rock or gravel.
20. In event that the earth backfill below that portion of the trench to be
filled with base rock is not sufficiently stable to support the required amount of
crushed rock or gravel, it is agreed that the Applicant will take all steps necessary
to insure that the required depth of crushed rock or gravel will remain free of soil
or clay and that no pumping action will result.
21. The pavement on said roads shall be restored by placing hot Asphaltic
concrete (class B) with a compacted thickness equal to that pavement which was
removed. The edges of the existing surfaces surrounding the trench shall be clean
rind properly tt_ated with bitumul,s to insure A bond between the existing pavement
and the replacement material. The restored pnvement shall be finished to a smooth
riding surface.
