We finally had to request a copy from USA after my staff was unable ':o locate the agreement in the City records. It is my understanding, from the information provided by Fred Anderson, that once this agreement was executed, Section 2 of the 1967 Predelivery Service Corporation agreement with the City was no longer needed. The 1970 agreement established that the City would charge sever service fees and remit a portion of fees collected to USA. A review of our records concerning ownership of sewer lines indicates that the line built by Predelivery in 1967 in now owned by the City. As I mentioned to you in an earlier tAlephone conversation, Bob Jean and I have discussed the matter and determined that we will support a request by Predelivery Service Corporation to terminate the 1967 agreement. To do this, a request must be made through the City Council. I suggest that your firs prepare the necessary materials in cooperation with our City Attorney's office. We will then set a Council agenda date and process your request. Plase advice me if you require any additional information.
