KNOW ALL MEN BY THESE PRESENTS, that GARDEN HOME CONSTRUCT ION COMPANY

as surety, are jointly and severally held and bound unto the Unified Sewerage Agency
of Washington County, Oregon, in the sung of $2 , 600. _

for the payment of which we jointly and severally bind ourselves, our heirs, execu-
tors, administrators and assigns, firmly by these presents.
THE CONDITION OF THIS BOND IS SUCH
That, whereas the said principal herein has made and entered into a certain
sanitary sewer construction permit agree ent, a copy of which is attached hereto,
with the Unified Sewerage Agency of Washington County, which permit agreement, to-
gether with the applicable plans and Standard Specifications, is by this reference
made a part hereof, whereby the said principal agrees to perform certain work and
to assume certain obligations, which tliings he agrees to do in accordance with the
certain terms, conditions, requirements, plans and specifications set out in said
sanitary sewer construction permit agreement.
NOW, THEREFORE, if the principal herein shall faithfully ana truly observe
and comply with the terms, conditions and provision; of the said agreement, in all
respects, and shall well and truly and fully do and perform all matters and things
by him undertaken to be performed under said agreement upon the terms set forth
therein, and within the time prescribed therein, or as extended by order of the
Board of Directors, and shall indemnify and save harmless the Unified Sewerage Agency
employees, and agents, against any direct or indirect damages of every kind and de-
scription that shall be suffered or claimed to be suffered in connection with or
arising out of the performance of the said contract by the said contractor or his
subcontractors, then this obligation is to be void, otherwise to remain in full
force and effect. In addition, the principal agrees to provide for the resto.ation
of any monument erected or used for the purpose of designating a survey marker or
boundary of any town, tract , plat or parcel of land which monument is broken down.
Injured, obliterated, removed or destroyed, whether wilfully or not, by the princi-
pal , his agents, employees or contractors, independent or otherwise '•or a period of
one year from the date of acceptance of the work performed under this surety bond.

CONSTRUCTION PERMIT AGREEMENT
THIS AGREEMENT, made and entered into this day of ,
19__0 by and between Unified Sewerage Agency of Washington County, a political
subdivision of the State of Oregon, hereinafter sometimes referred to as "Agency",

WITNESSETH:
WHEREAS, Petitioner has petitioned the Agency to accept and file on the
records of the Agency sanitary sewer construction plans and specifications for

WHEREAS, the Unified Sewerage Agency of Washington County Resolution and
Order No. 70-12, Section 6, provides that the subdivider install all required
sanitary sewer facilities and repair all existing streets and other public facilities
damaged in the development of the sanitary sewer construction; and
WHERFAS, it is the desire of the Petitioner to proceed under Agency Resolution
and Order No. 70-12, Section 6, Paragraph D, thereof and enter into an agreement with
the Agency wherein and whereby the Petitioner agrees to install all of the required
public sanitary sewer improvements as defined in the Agency Resolution and Order
No. 70-12, Section 1 , within one year from the date of application, and in all events
to do all of these things requi.red for the installation of all. public sanitary sewer
improvements and facilities within the proposed subdivision; and
WHEREAS, the Agency is agreeable to the acceptance of said detailed Plans and
Specifications upon the execution of this agreement and the Petitioner's filing a
Corporate Surety Bond in the amount of

NOW, THEREFORE, in consideration of the premises of the covenants and agree-
ments to be kept and performed by the parties hereto, it is covenanted and agreed
as follows:
I
The petitioner binds itself to use such materials and to so construct all of
the sanitary sewer improvements according to Agency Standards as defined in the
Agency Resolution and Order No. 71-9, ,nd as shown on the detailed Plans and Specifi-
cations which have heretofore been preseited to the Agency Staff Engineer for
acceptance; and
II
The principal agrees to provide for :he restoration of any monument erected
or used for the purpose of designating a survey marker or boundary of any town,
tract, plat or parcel of land which monument is broken down, injured, obliterated,
removed or destroyed, whether wilfully or not, by the principal, his agents,
employees or contractors, subcontractors, independent or otherwise.
III
Petitioner further agrees that all of said sanitary sewer improvements shall
be completed on or before _ _ _, 19______; and
IV
The Petitioner further agrees that in case it shall abandon the work, or fail
to make satisfactory progress on the work, the Agency may cause the work to be
completed; the Petitioner and the surety on the bond attached hereto shall he _jointly
and severally liable to the Agency for any amd all loss and damage from such default,
either from the greater expense of so completing, or repairing faulty or damaged work,
or from any other cause.
It is mutually understood and agreed by and between the parties hereto;
That this Permit Agreement is being made by virtue of unified Sewerage: Agency
of Washington County, Resolution and Order No. 70-12, Section 6, Paragraph ll, deems
it proper for this Permit Agreement to be entered into concerning the construction
of all public sanitary sewer improvements, as defined in Section 1 of said Resolution
and Order, and as shown on the detailed Plans and gpecifications filed by the
Petitioner herein.

and its seal affixed by its duly authorized officer. and Unified Sewerage Agency
of Washington County has caused these presents to be executed by its Board of
Directors by authority of an order of said Board heretofore entered of record.
