Please attach the enclosed subordinations to the original easement, and cause the entire set to be recorded as a "package . Once both easements and the subordinations have been recorded, please provide me with a complete set of copies of the recorded instruments. Box 23397 Tigard., OR 97223 Re: City of Tigard - Pioneer Land Development (Storm Drainage Easement) Dear John: I have spoken with Pioneer Land's attorney, Tom Gerber, concerning his requested conditions to the standard storm drainage easement proposed by the City. I understand that city staff tentatively approved the conditions and proceeded to issue building permits, which were required prior to the closing of the sale which took place today. I also understand that the easement will eventually be presented to the City Council for final adoption and acceptance. Tim Ramis and I have concurred with the proposed conditions, with one exception. We are concerned about the absolute limitation on assignment, and I telephoned Mr. Gerber today to inform him of our. concern. 1 Mr. Gerber and I agreed to add the following clause to the condi- tion that refers to non-assignability of the easement: 'I*** , excepting a transfer to a successor public agency ' having jurisdiction over storm drainage systems. " Please revise the easement accordingly, ask Mr. Conser to sign the revised easement and recommend that he speak with Mr. Gerber if he has any questions concerning the revision. Thank you for your cooperation. ce 2 yours, A/ 0<7 r / ! re;►neth M. Elliott ,ME:mch cc: Thomas A. Gerber, Esq. I believe that we are very close to having all of the technical issues addressed. I know that this has been as difficult for the City staff as it has been for our client and us to resolve. It is not our practice to becone "adversaries" with staffs, and I hope that has not happened as a result of our difficulties in this case. Attn: Mr. Lance Stout 0690 SW Bancroft St. Portland, OR 97201 RE: Censor Storage Center Dear Mr. Stout: It would seem that I'm not adequately verbally communicating what it is that: we must receive to facilitate construction approval for said project. Therefore, I'm writing to endeavor to convey such and, also, to iterate our perception of project status. To begin, I've enclosed two pertinent items: 1 . A copy of Final Order No. 85-22. 2. A copy of Poblic Improvement Review (process) Application Information. To continue; to date we have received the required sets of sanitary sewer drawings which were prepared by Mr. Dave Larson, On March 25th, 1986, Sue Laszlo informed me that one ropy was being circulated in accordance with our agency routing list, by Mr. Robert Schroeder, and would be returned to the City upon completion of that task . Therefore, it is our perception that some progress is being made toward eventual. construction approval for the sanitary sewer facility . Next, some time ago (March), we received one copy of a plan sheet, prepared by a registered architect (Mr. Robert Schroeder), titled "Utility Plan" and, also, one site drainage talc sheet. The plan does not address development of a storm drainage facility which would allow for collection of and passage of stormwater flow from upstream lands; it. is limited to internal drainage. In endeavoring to discuss this problem, I was referred to Mr, Schroeder, Mr•. Larson was, apparently, riot working on this project any longer. Mr. Schroeder was unable to resolve the problem and didn't krn)w whom to refer me to regarding submittal of a comprehensive drairage plan. Shortly thereafter, subsequent to our meeting in Bill Monahan's office, I spoke to you several times of our need to have such a plan submitted for review to enable progress to be made. Contrary to where our conversations seemed to lead, the issue is not one of public versus private system ownership; it is an issue of adequate provision for scormwater runoff, now and in the future, for all impacted tracts. Now, Most recently (June), we have received a copy of a legal description and description map which conveys certain drainage rights between two pr.i.vato corporat:ion a (namely Coast Finance Inc . and Pioneer land Development, I.nc. . ) . Unfortunately, this still does not: address the issue; and that: is -• What is prcposed to be done about assuring the passage of upstream stor•mwater without creating upstream, on site, or downstream problems, now and in t:he future? We simply cannot proceed to grant construction approval for the site until the aforesaid concern is resolved. Therefore, to progress toward eventual construction approval for the storm sewer facility, please have one preliminary drainage plan and c:alc sheet prepared by a registered civil engineer; said plan need address the aforesaid issue. Then, submit said plan in accordance with the procedure specified by the enclosed Improvement Review Instructions arid in accordance with the Conditions specified by Final Order No. 85•-22. Subsequently, such action (along with completion of the processing procedure for the sanitary system plans) shoUl.d facilitate final construction approval for the project. Very truly yours, John S. Ash Avenue Tigard, Oregon 97223 Dear Randy: RE: Storm Line for Conser Site Project Nimber 285413 After our recr(it discussion, I contacted Neal Conser and reviewed the ways in which he, the City, and we might all work together to solve the drainage problem that effects the Conser site, as well as adjoining properties. As I mentioned, Neal is willing to facilitate acquisition of a public easement for a new storm line to replace the existing inadequate line and inlet. We had also hoped that the City would be able to assist in the cost of the new facility, but based upon your observations, it appears that this will not be possible. We would appreciate a letter, as ycu offered, that Neal could use in contacting the adjacent property owners about an easement.. I believe that the main points should be: 1) The City and Neal Conser hope to upgrade the existing inadequate line; 2) The existing line was installed at the time $.he site was developed, and apparently without an easement to allow access for City maintenance. Also, the line was not installed to City standards; 3) The new line would follow generally the same route as the old line, across the existing lawn area., and would be built to City standards; 4) The new line, and easement, are needed to provide storm drainage for the Conser site and the site crossed by the easement, as well as other upstream sites; 5) Providing the easement to the City will assure the property owner tli,at the construction will meet City standards and that the area will be sat ;sfactorily restored after construction; 6) Requiring a developer to obtain an easement such as this is a normal procedure, unless the City itself has to obtain an easement through negotiation or condemnation procedures. ri a Randy Clarno Project Numbar 285413 February 14, 1986 Page 2 We would appreciate receiving your comments as soon as possible, so that Neal can approach the effected property owner. I would suggest that you address your letter to Neal Conser , 6580 N.W. Mt. ORDER INCLUDING FINDINGS AND CONCLUSIONS, WHICH APPROVES AN APPLICATTON FOR A CONDITIONAL USE (CU 5--85), DL.ANNED DEVELOPMi_NT (PD 4-85), AND VARIANCE (V 18-85) REQUEST BY WILL_AMINIA LUMBER CO, The Tigard Planning Commission reviewed the above application at a public hearing on December 3, 1.985. The Commission based its decision on the facts, findings and conclusions noted below; A. FACTS 1 . General Information CASE.: Conditional Use CU 5-85, Planned Development PD 4-85, and Variance V 18--85. REQUEST : To establish a 90,000 square foot mini-warehouse facility and to vary the requited number of parking spaces from 93 to 4. COMPREHENSIVE PLAN DESIGNATION: Commercial General ZONING DESIGNATION: C-G (PD) (Commercial General, Planned Development) . APPLICANT: Neal Conser OWNER: Willaminia Lumber Co. 18858 Alleghaney Or. 9400 SW Barnes Road Oregon City OR 97045 Portland, OR 97225 LOCATION: 15700 SW Pacific Highway (WCTM 2SI. IOD, Lot 1800) . 2. Background No previous land use proposals have been reviewed by the City regarding this property . 3 . Vicinity. Information A nursery zoned C-G (PD) abuts the property to the north. A second, similarly zoned parcel and retail development is immediately south along Pacific Highway . Multi-family rosi.dences zoned R- 2.5 (PD) (Residential , 25 units/acre) lie to the southeast. and east . King City is located on the west side of Pacific Highway. 4. Site Information and Property Description The subject property is presently undeveloped. Thp applicant proposes to construct six storage buildings between 13,5J0 and 17,400 square feet and one office building of 1 ,470 square feet . One driveway access with VINAL ORDER NO. 85--_gU_ PC PAGE 1 s a customer controlled gate will. be provided on Pacific Highway and a secondary fire access shall be at the northwest corner of the parcel. Driveways of 24 feet in width surround the six storage buildings and four parking spaces are shown next to the office. A chain lin'; fence will. surround the project at the edge of the pavement. A landscaped buffer that is 10 feet wide to the north and south and 25 feet on the east side are proposed utilizing a combination of natural and imported vegetation. 5. Agency and NPO Comments The Engineering Division has the following comments; a. The pruper•ty drains toward the Summerfield development and a method for stormwater disposal must be provided. h. 'The existing sidewalk to the South should be extended along the Pacific Highway frontage to the northern property line. C . Written approval should be obtained from the Unified Sewage Agency (U.S.A. ) to allow the connection of the project to the Summerfield development system. d. Public sanitary sew.ir should be extended to the nort`iern boundary of the subject parcel to allow for utilization of t-ie scnwer line by properties to the north. C . Permits for improvements within the Pacific Highway right-of-way shall be obtained from the State Highway Division. The State Highway Division indicates that a i0 foot vehicle storage area should be provided between the entrance gate and the right-of-way . Also, no on street parking will be permitted. The King City Council, Summerfield Civic Association and NPO N 6 have no objection to the proposal . No other comments have been received. H. f'T.NDINGS AND CONCLUSIONS The relevant criteria for this proposal are T,gard Comprehensive ►clan policies 2. 1 . 1, 7. 1 .2, 7.3 . 1, 7.4.4, and 8. 1 .3; and %,ummunity Development Code Chapters 18.62 C-G Zone; 18.80 Planned Development; 18 , 1.30 Conditional. Use; 18 . 100 Landscaping and Screening; 18 . 102 Visual Clearance; 18 . 106 Off-Street Parking and loading; 18 . 108 Access, Egress, and Circulation; and 18. 134 Variance. Since the Comprchpnsive Plan hos :,eon acknowledged by I.CDC, the Statewide Planning Goal and Guidelines no longer have to be addressed. The Planning Commission concludes that the proposed Conditional Ilse/Variance is consistent with the above criteria based upon the following findings: FINAL ORDER NO. 85 -. I)n _ PC - PAGE 2 Plan Policies a, Policy 2. 1. 1 is satisfied because the Neighborhood Planning Organization and surrounding property owners were given notice of the hearing and an opportunity to comment on the applicant's proposal. b. Policy 7. 1 .2, 7.3 . 1, and 7.4 ,4 are satisfied because adequate water, sewer, and storm drainage facilities are available to the development. The applicant also indicates that these facilities will be provided as required by City standards. C. Policy 8. 1 .3 will be satisfied when the conditions of approval relating to street improvements are completed. Code Provisions 1 . Chapter 18.62 is sat i.sfi.ed because the use is permissible following a Conditional Use review. Building setback, height, and lot coverage requirements have also been met. 2. Section 18.80. 1.20 (a) (3) of Chapter 18 ,80 Planned Development outlines the approval. criteria for development requests, The application' s narrative has addressed these criteria and has demonstrated the proposal' s conformance with this portion of the Code. 3 . Section 18 . 130.040 (a) of Chapter 18. 130 Conditional Use outlines the approval criteria for Conditional Use applications . These criteria have also been properly addressed by the applicant' s narrative. Section 18. 130. 150 (c) (25) indicates that all underlying requirements of the applicable zone shall pertain to a mini-warehouse. 4 . The applicable portions of Chapter 18. 100 Landscaping and Screening including street: trees, landscaped area, buffering, and screening have been met. The existing vegetation along the eastern side of the property shall be preserved as a natural buffer. The proposed buildings which will be 16.5 feet hight at the roof peak will be well screened from the view of residents in Summerfield. 5. Chapter 18 . 102 Visual Clearance is satisfied because no ribstruct.ions are proposed in the •rici.nity of the driveway accp9s on Pacific Highway. 6. The number of parking spaces required in Chapter 18 . 106 Off-Street Parking and Loading is not satisfied, however, a variance to this standard is appropriate as discussed in item 8 . below. 7, rhe driveway dimension proposed for the project are consistent with the standards set forth in Chapter 18. 108 Access, Egress, and Circulation. FINAL. ORDER NO. 85-" PC -r PAGE .i 8. Section 18. 134.050 of Chapter 18. 134 Variance contains the criteria which must be met in order to justify a variance request. Section 18 . 106.030 (d) (2) requires that wholesaling, storage, and distribution activities provide one parking space per 1000 gross square feet of floor area Plus one space per 700 square feet of patron .%erving area, with a minimum of 10 spaces. Mini-warehouses are included under this use category but the parking needs are significantly different from other types of wholesale, storage, and distribution activities. The primary fo-tor is the absence of employees in a mini-warehouse operation. Par0 nq will typically be needed for office personnel and first time customers. Established customer will drive through the automatic gate enroute to their storage units . The applicant has addressed the criteria in Section 18 . 134 .050 and the Planning Commission concurs with the analysis . C. RECOMMENDATION Based upon the findings and conclusion above the Planning Commission approves CU 5-85/PD 4--85/V 18-85 subject to the following conditions: 1. UNLESS OTHERWISE NOTED, ALI...
