This sanitary sewer line is a public line and should be maintained by the City. However, the required easement to allow us to maintain this sewer line was never received by the City. Unless we have the required easement any and all expenses necessary to maintain this sewer line would be the responsibility of the property owner. With your help, we would like to correct this error. Granting of this 10 foot easement does not mean giving of land, only access to maintain the sewer line. It would give the City the right to cut and remove any brush, trees, or other matter or materials from the easement area . The .easement would require the City to leave the area in a neat and workmanlike condition and as nearly in the pre-existing state as practicable. Box 23557 Tigard , Oregon 97e23 Dear Bruce : After our telephone conversation today I began to dictate a .letter to you setting out what T told you on our phone conversation, and in the course of dictating the letter I read again through the Complaince Agreement and found that, although the agreement is one between Stalick and Tigard, it does, in its notice procedures, call for notice to be given to the contractor, instead of the "Petitioner. " Somehow I had overlooked that in my first reading of the document. We did give that notice, in the appropriate way, to the contractor. I presume from the fact that the question has reached me that the city has not previously encountered, at least in recent years, a case where it was necessary to call in someone else to finish a contrac-- tor' s job. It is my opinion, based on a reading of the Complaince Agreement , that it is not necessary for us to call for bids , but that we can simply engage anyone we think suitable to do the work and have it done. I cannot find any other formalities re.luired of us by the agreement. In my opinion we should simply contact a contractor who can do the work, get an estimate from him, make a record of the estimate, and tell him to proceed with the work, then turn 'the matter back over to me or to someone on your staff to commence the proceedings necessary to col: ect the money from Mr. Grahn or his insurance company.
