The Beck Sanitary Sewer extends northwesterly from SW Erste Court (said street: being in Genesis Subdivision) . 1-he sewer line is a 155 foot extension of the Genesis sewer -system, serving tracts located at 115th Avenue/Fanner Street. 2. All public improvements have now been satisfactorily completed and heave withstood the required one-year maintenance guarantee period. 3. The Engineering Division certifies that the improvement is now acceptelh1v and that all requirements have been met. A. Therefore, it, is recommended that (in accordance with the terms of trK_, project agreement) the City Council accept the public sanitary sower improvement, for City operation and maintrnance responsibility and, further, that the Council authorize release of the assurance bond. BECK and NORA C. BECK Grantees) , their heirs, successors and assigns, a perpetual nonexclusive easement to lay down, construct and perpetually maintain an underground sewer pipe through, under and across the following described property: See 'EXHIBIT A" attached hereto and by this reference incorporated herein. Said line as installed shall be sufficient size to satisfy the City of Tigard and allow credit for future connection by grantors of their existing properties. Use by Grantees . Grantees, their agents, independent contractors and invitees shall use the easement st,-ip for installation and maintenance of a sewer pipe only. 3. Perpetual Easement. This easement shall be perpetual and its benefits and buruens shall run with the real property described herein. However, in the event it is not used by Grantees for a period of three ( 3 ) years or if otherwise abandoned by Grantees, the easement shall automatically expire and Grantees shall, upon request, execute a recordable documen� evidencing such expiration. 4 . Easement Subject to Existing Rights. This easement for sewer purposes hereby granted to Grantees shall be subject iii all respects to existing rights, encumbrances and matters of record affecting the easement property and the parcel upon which it is located. Grantees shall, upon the initial installation of the sewer and upon each and every occasion that the sewer is repaired, renewed, added to or removed, EXCEPT if the sewer is repaired, renewed, added to or removed for Grantors' use, restore the premises of the Grantors to the same or better condition as they were prior to any such installation or work , including but not limited to the removal of all brush, trees and stumps which may be cut down or uprooted as a result of the construction. 6. Indemnification. Grantees agree to indemnify, defend and hold harmless Grantors, their officers, agents, employees, successors and assigns from any loss, claim or liability -of Grantors arising in any manner out of Grantees' use of the easement strip. Grantees assume all risk arising out of its use of the easement strip, and Grantors ' o`.fic,ars, agents, employees, successors and arc;g.^.c shall have no lial.i.lity to Grantees or others for any condition existing from Grantees' use of the easement. 7. Taxes . Grantors agree to continuously pay all the real property taxes on the property described in Exhibit "A" . 8. Runs with Land. The easement herein granted is intended to be appurtenant to and run with the land benefited and burdened hereunder. Q . Damage During Construction. If any damage shall occur to -3rantor' s-property as a result of the construction of the contemplated sewer line for Grantees ' use only, Grantees shall repair that damage at their own expense. 10. Duration. The easement created hereunder shall be perpetual unless -the easement is extinguished or terminated pursuant to the provisions hereof .
