'pie have nowfurther considered this matter, and it is noted that Section 105.755 , Oregon Revised statutes authorizes an actin for damages whenever the State Highway Commission changes the grade of a state higrhway , county or district road , or otherwise , but does not apply to city streets . Section 105 .760 , F,eviaed Statutes , provides in pertinent part : "Tf consent is given by the groverninF body of a city to change any g rade of ar►y street as such gprade has been established or maintained by the consenting city and pursuant thereto the State I(igrhway Commission or a county changes the grade , the state or' the county whichever rnakes such change of parade shall be liable fur and shall pay dust arid reasonable compensation for any damare or injury to Any real property abuttinF upon the road or street affected by the grade change. " We find no statute which authorizes an action for damages for irrade chanFes in city streets raccomplished directly by the city nor do we find any authority for such action where the city changes the E-'rude of a cuunt,y road , which we understand Walnut Street to be . The :?upreme Court has considered several cases involvinp the City of Portland as defendant , where damages were sougrht for interference with physical accessto property and in terse terms the court held : "The rigrhtA of abutting proprietors to access to the pretrises are subservient to the primary rip,hts of the public to the free use of the streets for the purpose of travel and incidental purposes . ` In the case of Oregon Investment Co. v. Schrunk , ;142 Or 63 , the court f usher commen�eci "- J "Interference with the abuttlnr* owners ' rtmhts of access held in these cases (here the court cited various Oreton cases) not to be a 'taking*' wpm in- cidental. to the carrying out of a legrit imate public purpose.
