It is requested that you take notice -f the problems relating to standing water in front of the residence at 15625 S. W. W. 116th Tigard, OR 97223 Gentlemen: In accord with the terms o,' your warranty as it relates to my residence at 15625 S. W. Alderbrook Circle the following defects, which are the result. of faulty workxianshl o or defec.:ive materials, arp brought to your attention. 1. Defects✓e siding; Some has beer. replaced; some has not. The defective siding has been identified with chalk markr,. 2. The siding on the gable over the garage needs to be re ami led. 3. After repiacoment of the defective siding the 1,ouse should be prepared for the second coat of paint as provided in you: specifications for, and submitted to the Oregon Department of Veteran's Affairs. it has been necessary for you to renaf.l much of the siding. Sema of the nail heads have been covered by blobs of potitti; some have not. This is certainly not professional work. The siding which hoe been replaced differs in color from tho original. It is also obvious fro.n the areas which have no paSdst that the second coat, provided for in i:he specifications, has never been applied. Be.:ause the repairs to the siding and the paiat are so extensive it may be advantageous for both of us to apply new siding over the defective siding. I would appreciate your bid to perform this act. If we do not agree on a prico by July 2, 1979 I will assume that you will correct the defects in accord with the warranty. The following defects are also deserving of your attention: A. Verbally your representatives hew refused to acknow- ledge that the property has a drainage problem. The facts are that drainage is a common problem on Alder- brook Circl,t. I have spent much time and effc•rt trying to retmdy this ptnblem. The record should show that I take exception to the lace of drairage as it exists. Tualatin Development Company, Inc. June 22, 1979 Page 2 B. You have made an unsuccessful effort to repair the street to eliminate the standing water in front of the residence. This matter still requires attention. When it rains the standing water is still present. The record will show many aggravations have occurrdd in the construction of thio housa. My most serious complaint is that your representatives have made deliberate fAlFe representations. To substantiate this serious allegation I enclose a copy of your letter of July 31, 1978 in which Mr. Guthrie and Mr. Misno are yu,)ted as saying that it "is this sola responsibility of the City of Tigard" to repave the street. This statement was repeated to me by your representative as recently as April 19, 1979 , After being informed by the City of Tigard that repnir of the streets is your responsibility until Summerfidld A is accepted by the City of Tigard your representative suddei►ly became aware of this fact. Your cooperation in er.bmit, ting a bid 'or new siding or correcting the defects menti.onad herein on a tiros?y basis Will bo appreciated Please call my at 238-8236 so we can arraa?,* s time to inspect the property together. It was your suggestion that consideration be given for additional street lighting within the valance of the secondary and tertiary streets . Those areas are presently illuminated with individual post yard lights . It is my feeling the post yard lights do not provide an adequate lighting level on the roadways . However, since some illumination is gained, my enclosed proposals marked as exhibits "A" and "B'1, recommend only a minimum number of additional lights .
