WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers, under- ground utilities and other public facilities for the development of subdivision; and WHEP,EAS, the City further required the payment of fees and the execution of. a Compliance Agreement which stipulates tha`: "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Mai.tenanec Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and raintenance for 3 period of one year. . ."; and WHEREAS, said Certification has now been received; and WHEREAS, the original performance bond has remained in full force and effectbeyond the normally required maintenance period of one year, and WFEREAS, the deficiencies which were required to be corrected therein have been repaired, NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within Summerfield No. 5 Subdivision, said suhdirision being recorded in Book 34 on Page 47 in Washington County, Oregon, Plat Records. Greenleaf Court, within the approved Summerfield Phase II area, it was my understanding that when the planning commission approved the preliminary plat that this street was allowed to br, 24 feet in width. The reasoning applied in this case was that the actual width of 24 feet occurs along a distance of 13 feet, that there are lots only on one aide, and that the reduced traffic demand within this type of development would not create the same demand on the street as would a family type development. Due to the above stated understanding and reasons, I am hereby requesting that you reevaluate this street improvement width. Please advise me when you have completed your findires. The attached application form should be used for submitting such a request. Only one application per sub- division, partitioning, or lot is required. A .opy of the completed form and the required exhibits will be kept on file by DEQ as a permanent record. Prompt action can be taken only if an application contains all requested information and all required exhibits. It is important that all items be com- pletely and specifically filled out. We have entertained numerous and varied proposals to accomplish lhose goals. however, we believe that the prograrn as now con- ceived will best serve all concerned and will greatly help Surnrnerfield to be one of the finest residential communities in Oregon and thusly be a great asset towards slaking Tigard known as the finest area to live in. Attached is a master plan of Summerfield. On the plan we have indicated where 1kV believe the approximate locations of the street lights should be. For example, i,n Summerfield Drive we have located the lights on the South side of the road and approximately 1 ,,n feet on center. The street light which we propose to use for the above mentioned location is of cast aluminum nr d made by Charmglow Products. The lamp itself is made by rhe Welshach Curpur.,tion. Roth of these items are on display in the island on y. MI. 1041h. off Durham Road. The lamp bulb which we propose to use is 203 watts. It h.t, a long life of 6, 000 hours and puts out around 2, 900 lumens. The lamp bulb i- clear (not frosted) and the glass in the lamp fixture is also clear. thus pruducing more than enough illumination for this residential development. The applicant proposes a 40 font right-cf-way wioth, where 50 feet is required and 24 feet of paving, where 34 feet is required. Considering the higher density of buildings, traffic and population it is reasonable to expect streets to at least meet standards for the lower density single family areas. In the townhouse area 59 dwelling units are located alung approximately 1130 feet of frontage, while in the single family area 32 unite are located along approximately 1180 feet of frontage. The density in the townhouse area is approximately twice that of the single family area, (113 people vs. 61 people at 1.92 people per dwelling unit) and generates twice the traffic on streets that are a lesser standard than the lower density single family area. Higher density development creates higher life loss potentials during emergencies, thus every possible means should be taken to maximize public safety in higher density areas of the Summerfield Development. Wider streets provide better access and manouvofing for emergency vehicles, better fire break areas in case of fire and increased traffic and pedestrian safety. Again we state the fire district agrees with the present subdivision ordinance requiring 34' streets and would like to see the requirements in all new developments, whether it is a subdivision, planned development, etc., for the following masons: l 1. The streets provide access for the fire apparatus. Two 6' wide cars parked apposite each other doesn't leave much room for apparatus to pass thru or to manuver for proper placement. The 12' section of street with 6' cars lurked doesn't leave enough room for BY fire apparatus to pass. 2. The streets provide fire breaks to prevent the spread of fire from building to building, remembering some of these town houses are frame construction, 250' long, 50' wide with less than 10' of separation on the ends. After having several apartment house fires in our district, and learning of experiences of other fire departments involved in these type of fires, we feel strongly that any street less than your requirements could only contribute to a possible conflagration. The reversal of the approval was based on the City Attorney's legal inter- pretation of the Subdivision Ordinance relating to street widths that were proposed to be less than the Subdivision Ordinance standard. It was the opinion of the City Attorney that to propose streets of widths other than those stated in the Ordinance that a variance must be applied for under Chapter 17.48, Paragraph 17.48.020. The following is in answer to those questions posed in paragraph 17.48.029. 1) The special circumstances that exist are that the land known as Summerfield was changed in zoning from R-7 to P-D based on the overall concept for development as reviewed and adopted by the City Council on February 12, 1973 by Ordinance No. 73-5 j and that to comply with this approved concept vartences from the Hubdivision ordinance are required. 2) The zone change application followed the proper legal channels } as set forth in the Wass.. ^'.)n County and City of Tigard zoning ordinance and was reviewed in detail at each stage of approval, based on the overall concept development plan. To be able to Implement the plan as approved in concept it is necessary to vary the street standards In accordance with the general provisions approved in the master plan. To riot allow the variences from the subdivision ordinance would impose an extraordinary hardship on the owner in that the development could not be constructed as pro- posed, and would not tie in with the existing greenway, golf course, (:ity of Tigard w- Page - 2 .recreation facilities and streets which were constructed in good faith and in conformance with the duly adc•ited overall plan for development. 3) The Public Health, Safety, and Welfare will not be adversely affected by any of the modifications to the subdivision ordinance as proposed in the preliminary plat of Summerfield Phase Il; to the contrary, the mode of living development concert for the age group of people and their traffic pattrrns as observed in the development of King City has proven that there is substantialy less use of the streets and less vehicles owned per residence than in the usual family oriented subdivision, therefore, there is less need for standard width streets. The adjacent property will not be injured in an, way because of this variance. Those streets that connect to adjacent property are of sufficient width to :candle the ambient traffic loads arra channel them through the development. The minutes of the July 3, 1973 planning Commission meeting were amended as follows: 1. page 5 concerning the Arrow Heating conditional use, Ball did riot recommend approval of the request but rather stated he felt the request was an appropriate one but under the interpretation of the ordinance as stated by the City Attorney he could not recommend approval. 2. Page 7 concerning the Schulz conditional use the 3rd condition should state that no access will be provided onto Tiedeman to include the i construction or driveways. B. The minutes were approved as amended by unanimous vote of the Commission present. 4. DISCUSSIOM PERIOD A. George Marshall of the Tualatin Development Corp- oration requested the Planning Commission consider problems created for their devolupment resulting from a recent City Attorney interpretation of the streets standards section of the Subdivision Ordinance. He stated that he was requesting the Planning Commission accept an interpretation of the Subdivision Ordinance contrary to that offered by the City Attorney's office. C.. Mr. Marshall presented a history of the Summerfield development to date, beginning with its original approval by Washington County as a Planned Residential Development. The project was then annexed to the City of Tigard and the City initiated a change of zoning to the City's Planned Development District. Mr. Marshall pointed out that according to his interpretation of the Subdivision Ordinance, the hat large scale developments can ordinance states t be granted exceptions from the subdivision code and that the City's approval of the P-D zone was also an acceptance of the streets on the submitted plan not corforming to the City's minimum street standards in thcs Subdivision Ordinance.
