A sketch indicating the location is enclosed . The City of Tigard is responsible for all line extension costs. The total line extension cost is $24.93 [$106. 58 (circuitry and transformer installation) less $81 .65 (estimated annual revenue) - $24.93 (total line extension costs) ] . "Option B" includes the energy and maintenance to luminaires and poles installed by the customer. The City of Tigard will be responsible for all trenching and installation of a 2-inch PVC conduit (see enclosed sketch) . The trench mus t be a minimum depth of 36--inches deep and 8-inches wide. PGE must inspect the trench and conduit installation prior to backfilling . Co. Tax Map 1S1 34B, Tax Lot 400). DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director based his decision are as note: below. A. FINDING 0" FACT 1. Background The City recently approved the plans for a 304 uni,s apartment complex and related facilities (SDR 22-84). During the review, it was not noted that a variance approval was necessary before a substandard cul-de-sac could be utilized 2. Vicinity Information The proposed cul-de-sac location is at the western end of Springwood Drive. Greenway Town Center is immediately north and the Woodspring Condominiums lie to the southeast. 3. Site Information and Proposal Description The apartment site is undergoing the first stages of land preparation and development and few, if any, permanent Improvements have been installed. The cul-de-sac will be in the northeast corner of the property and will represent the terminus of Springwood Drive, which is a publicly dedicated street. Two driveways to the parking lot for the apartments will intersect with the cul-de-sac. Because of the building layout and configuration of the parking areas, a cul-de-sac with a 24 foot radius is requested in lie,. of the 50 foot radius standard. Except for the cul-de-sac radius, all other City standards relating to its construction will be met. 4. Agency and NPO Comments The Engineering Division has no objection to the proposal as long as the design and installation of the cul-de-sac meets all other applicable City standards. NOTICE OF DECISION - V 2-85 - PAGE 1 Washington County Fire District No. 1 has no objection to the request, provided: a. Parking is not permitted on the cul-de-sac. b. The first 40 feet of the two driveways must be capable of sustaining a minimum wheel load of 12,500 pounds per square foot and a gross vehicle weight of 45,000 pounds. No other comments have been received. B. ANALYSIS AND CONCLUSION In order to approve a variance, Section 18.134.050 of the Community Development code states that the following criteria must be satisfied: 1. The proposed variance will not be materially detrimental to the purposes of this code, be in conflict with the policies of the comprehensive plan, to any other applicable policies and standards, and to other properties in the same zoning district or vicinity; 2. There are special circumstances that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will be the same as permitted ur►der this code and city standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the .land; 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified in the code; and 5. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. Tile basic purpose of a cul-de-sac is to provide adequate area for emergency vehicles to turn around and for the convenience of the general public. The proposed cul-de-sac in concert with two 24 foot wida uriveways will offer an acceptable alternative for vehicles to change direction. Although not part of the public street system, the driveways will connect with a new public street located at the wesEern end of the project. The cul-de-sac will only serve the subject property and virtuall} all of the traffic will travel through to the apartment complex or turn into Greenway Town Center. A standard size cul-de-sac would occupy a large area and would remove a significant number of parking spaces. Since very few motorists will need to make n 1800 turn, the reduced size of the cul-de-sac 18 appropriate. NOTICE OF DECISION -• V 2-85 - PAGE 2 ANL The proposed apartment complex is a permitted use and the reduction in cul-de-sac size will have no appreciable effect upon the traffic movement on Springwood Drive. The variance will allow for additional parking spaces, and still provide for appropriate access and maneuvering space for emergency vehicles. C. DECISION The Planning Director approve V 2-85 subject to the following conditions: 1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS. 2. Improvements including concrete sidewalk, concrete curb, st.eetlights, concrete driveway aprons, storm drainage and utilities (delete inapplicable items) shall be installed at the terminus of SW Springwood Drive, westerly if SW 121st Avenue. 1 Said improvements shall be built to standards existent adjacent improvements. 3. Five (5) sets of plan-profile public improvement construction plans and one (1) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Section for. approval. 4. Construction of proposed public improvements shall not commence until after the Engineering Section has issued approved public improvement plans. The section will require posting of a 100% Performance Bond, the payment of a permit fee and a streetlight fee. Also, the execution of a construction compliance agreement shall occur prior to, or concurrently with the issuance of approved public improvement plans. 5. Additional right-of--way shall be dedicated to the Public at the terminus of said roadway to provide for the installatica of required improvements within public right-of-way, in accord with the City Engineers approval. 6. Public Improvement Review shall be applicable to all new developments and remodeling of existing developments. B. All provisions and regulations of the Municipal Code shall apply unless modified by other sections of said Code (e.g. Planned Development, Chapter 18.80; Variance, Chapter 18.134; Unusual Conditions, Section 15.04.120; Sanitary Sewerage Regulation, Chapter 12.05). C. The application and approval process is a three-step procedure which involves: I . _A Prea2plication Preliminary Public Improvement Construction Plan Review. (Prior to formal submittal of public improvement construction plans). ..the Applicant must submit one co;, „f the proposed public improvement construction plan, said plan having been prepared and signed by a Registered Civil Engineer, to the City's engineering office to facilitate preliminary review. Upon conclusion of said review, City staff will contact the Applicant and the Applicant's Engineer to discuss any obvious deficiencies and, also, formal submittal requirements applicable thereto. 2. Formal Public Improvement construction Plan Submittal) Circulation and Final Review (Prior to qualifying to receive an approved public improvement construction plan to facilitate commencement of construction work and receipt of building permits). . .the Applicant must submit the designated number of sets of plans, as will have bden specified at the conclusion of the aforesaid Preliminary Public Improvement Construction Plan Review process, for formal ctrcuio tion and final review; and simultaneously, must submit the fol.'owing: e. One comprehensive itemized Public Improvement Construction Cost Estimate, prepsred and signed by a registered civil engineer. b. One metes and bounds legal description, prepared and signed by a Registered Civil Engineer or land surveyor on 8 1/2" X 11" white bond paper, for each necessary dedication and easement . _ i .. Upon receipt of all of the aforemention...,, the City will afix its routing stamp on one set of the plans and, then, either the City or the Applicant shall circulate the plan through the appropriate Agencies for comment and acknowledgment (It is recommended that the Applicant hand-carry said plan, due to a savings of time which will be gained thereby). Thereafter, a final plan review will be conducted by City staff. Should revision of the plan be seemed necessary by City staff, to bring it into conformance with established City standards and specifications, circulation comments or development stipulations, the Applicant and the Applicant's Engineer shall then be notified thereof. Should 0- plan be deemed by city staff to be approvable, the Appl.' •-^t and the Applicrnt's Engineer shall then be notified ,, :_teof. Noeice of City readiness to issue an appeovahle plan does not mean that construction can commence nor does it mean that building permits can be secured; public improvement construction documentation must first be completed (prior to the actual issuance of the approved public improvement construction plan). 3. Public ImErovement Construction Documentation (Prior to qualifying to receive an approved public improvement construction plan to facilitate commencement of construction work and receipt of building permits).. .the Applicant must execute either a Street Opening Permit or a Public Improvement Compliance Agreement; and , also, must submit the following: a. A performance bond in favor of the City of Tigard, Oregon; the sum of whish will be determined by City staff at the conclusion of %►e formal public improvement construction plan circulation and final review process. b. Payment of all required public improvement construction plan (plan review, field inspection, street traffic control sign installation and streetlight energy and maintenance) fees the sum of which will be determined by City staff, and will be provided to the Applicant at the conclusion of the formal public improvement construction plan circulation and final review process. To clarify step number three's procedure: The City will prepare the appropriate form of construction agreement doc►.mer,t and shall provide it to the Applicant. The Applicant must then execute (and notarize) the agreement document and return it to the City along with the aforesaid bond (form subject to approval by the City) . Simultaneously, the Applicant must remit the total aforesaid public improvement construction plan review fees. In the event that a Street Opening Permit was the form of construction documentation selected by City staff as being most appropriate for the project, staff will then issue the approved public improvement construction plan and Applicant may subsequently commence public improvement construction work and, - 2 - also, may make application for building permits. In the event that a Construction Compliance Agreement was the form of �. construction documentation selected by City staff as being most appropriate, then, upon Applicant's return of the said agreement and bond, staff will route both documents to the City Council for Council acceptance and execution.
