Apparently he did this on your instructions to satisfy our requirements for receiving accelerated drainage. He i�ad an erosion control device dertigned consisting of a fluma and thrust block to be installed on our right of way. Ile consulted our Chief Enggineer, who left the decision with us on the Division as to whether the device need be 'Lnstalled. We have observed the drainage at the building site curing the past winter, and it is apparent that no erosion is going to occur duo to the sr.,nll amount of water flowing doom the lank into our side ditch. One more season's growth of natural vegetation will further stnbilire the channel. The design of the Gtreet and sanitary sewer are critical because the upstream sraitary manhole was shown on the preliminary plat 120 feet north of its actual location. Since this is the case, the sewer is considerably more shallow than origkally thought:. q.n order to maintain minimum cover on the sewer zt the upper end, the road was kept rather high . :'here is also a slight swale in front of the property which did not show up on the contour map. Therefore, the ruad is in fill for about 50 feet. However, there are about 400 cubic yards of excess excavation which will be used to bring Lot 1 up to drain to the street. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: The Council finds that the lands hereinafter described have heretofore been and are now classified R-7 (single family residential) pursuant to the zoning ordinances of the City of Tigard. Section 21 The Council further finds that pursuant to prescribed pro- cedure a, ro- cedurea, application for change of zone of said lands from R-7 (residential) to A-2 (multi-family residential) and for companion- ate planned development treatment was the subject of a public hearing held by the Planning Commission on February 18, 1975, and the Com- mission has heretofore filed its report with the City Recorder, copy whereof is hereto attached and by reference made a part hereof, re- commending approval of the application. Section 3: The Council further finds that after due and legal notice a ublic hearing was held on March 10,' 1975, before an im- partial council, and that at said hearing the applicant and all in- terested parties were afforded an opportunity to be heard and to present and rebut evidence with respect to said application. Section 41 Based on the evidence both oral and documentary and the record of said hearing before the City Council, the Council makes the following findings: (a) That the comprehensive plan entitled "Neighborhood Planning Organization Number Two" includes tax lots 1000 ani part of tax lot 1001 on tax map 1S1-35CD as a part of a larger area designated for A-2, multi family residential zone, and the granting of applicant's request is therefore compatible with the comprehensive plan. (b) That the change of pre-existing land use classification .from R• 7 to A-2 multi-family is consistent with the public need for multi- family housing in the Tigard community to provide rental housing for persons unable to purchase single family dwellings. (c) The Council further finds that the granting of the appli- cation and change of zone sought subject to the requirements herein- after set forth will not unduly burden the nearby single family resi- dential area nor have an undesirable impact on the locality. (d) That public services, includinis water, sewer, electric energy and gas are readily available to the subject site and that the site is contiguous to 9Bth Street, an improved public right-of-way and directly accessible to Greenburg Road, a collector street. (e) That it is consistent with the public interest to authorize the use of said tract as a planned development project pursuant to Chapter 18.56 of the Tigard Municipal Code thereby to assure that esthetic consideration and public interest values will be accentuated. ORDINANCE No. 75- (f) That the proposals of the applicant with respect t3 dedi- cation of additional right of way, construction of public improvements, making, provision for storm drainage and providing for common nrensnder the jurisdiction of the property owner, landscaping development ands construction of sidewalks and curbs, and other amenities, all as here- inafter set forth under Special Conditions, will enhance the accept- ability of the planned development concept as a part of the integrated development program for the locality. Section 5: That the use classification of applicant's lands as des- cribed on the attached Fxhibit "D" by this reference made a part hereof, being tax lots 1000 and part of 1001, 1Sl-_',5CD, as hereinabove referred, be and the same is hereby changed from the present R-7, single family .residential zone, to A-2, multi-family residential zone, and for companionate planned development treatment, and the use henceforth of said property shall be limited to, consistent with and subject to all requirements of the A-2 zoning classification as now or hereafter prescribed by the Tigard Municipal Code, and further subject to the requirements of this Ordinance. WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets , sidewalks , street .lights , storm sewers , sanitary sewers , underground utilities and other public facilities for the development of subdivisions ; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement which stipulates that : "Upon receipt of certification by the Department of Public Works that all requirimerrts have been met and a One Year Maintenance Bond , the City Council agrees to accept the public improvements , subject to the requirements for correction of deficiencies and maintenance for a period cf one year. . . ; " and WHEREAS, said Certification has now been received ; and WHEREAS, an acceptable Maintenance Bond has been in effect for the aforsaid maintenance period ; and WHEREAS, all deficiencies have now been corrected , NOW, THEREFORE , BE IT RESOLVED that the City Council of the City of Tigard , Oregon , hereb;* accepts the public improvements constructed within Scott Sub- divis:! on , said subdivision being recorder] in Book 35 on Page 23 in��lashi.ngton County , Oregon , Plat Records . AND FURTHER , the City Council herein authorizes release of the aforsaid Maintenance Bond . PASSED: This day of , 1781 , by the Coiinci l of the City of Tigard .
