PROJECT T-T F DATE: PROGRESS , NOTES : WEATHER INSPEC VOR ' y + CASH BOND ESCROW AGREEMENT THIS AGREEMENT, made this !� day of 1973 between the CITY OF TIGARD, hereinaf er termed "City", _ANT HOMES, INC. , hereinafter termed "Elegant", and the EQUITABLE SA'vINGS & LOAN ASSOCIATION of Oregon, hereinafter termed "Loan Association", W I T N E S S E T H : WHEREAS, Elegant has heretofore executed a Subdivision Compliance Agreement with respect to the development, construction and improvement of a residential subdivision within the City known as PATHFINDER, copy of said agreement together with a particular legal description of said lands being attached hereto and by reference made a part hereof; and WHEREAS, 'Elegant Homes has propo•ad to the City that there be entrusted to the Loam Asso.iation the sum of 2;2 alf- as a cash performance bond to assure the City that all requ rements of said Subdivision Compliance Agreement shall be properly and timely performed and to assure that the costs thereof shall be timely paid and all requirements thereof met; and WHEREAS, the Loan Association has agreed to take title to and hold in a trust capacity the sum of $ 42. '37g,<,�- and { hereby acknowledges custody thereof to be held pursuant to the terms and provisions of said Subdivision Compliance Agreement as hereto attached, and it is desired hereby to set forth and define the conditions applicable to said cash bond, NOW, THFRFFORE, if Elegant shall faithfully observe and timely comply with all requirements of said Subdivision Compliance Agreement and all ordinances and regulations applicable to said subdivision, and if Elegant shall well and truly perform all matters and things undertaken thereby and hereby to be performed and sha11 promptly make payment to all persons supplying labor and/or materials for any prosecution of the work, and if Elegant shall not permit any lien or claim to be filed or prosecuted against the City on account of any labor or material furnished, and if Elegant shall promptly pay all contributions or amounts due the State Industrial Accident Fund and the State Unemployment Compensation Fund, and shall promptly as due make payment to the person, co-partnership, association or corporation entitled thereto of the moneys mentioned 1n Che.pter 279.320 and 279.510 O.R.S. and shall promptly comply with all withholding and payment requirements of Chapter 316.162 to 316.212 O.R.S. with respect to the collection of taxes at source, then upon full completion of all work and the furnishing of evidence satisfactory to the City that all requirements hereof have been fulfilled, and if Elegant shall execute and deliver to the City the Maintenance Bond described in said Subdivision Compliance Agreement, then the Loan Association shall thereupon release to Flegant the said cash bond deposit; PROVIDED, however, that the obligations hereof shall not apply to any money loaned or advanced to the principal or to any subcontractor or other person in the performance of any such work whether specifically provided for by contract or otherwise. Lib If, however, Elegant shall fail to .literally comply with all requirements of said Subdivision Compliance Agreement and all the requirements hereof, or shall in any particular perform the work in a defective manner, upon ten (10) days notice by the City to Elegant and such default or failure continuing thereafter, the ; City is hereby authorized to have said work performed or the requirements of the Subdivision Compliance Agreement brought into conformity with the terms thereof and with the City's ordinances and .regulations, and the City shall be, and it is hereby, authorized to charge the same against the entrusted cash deposit and the Bank agrees to pay therefrom all amounts certified by the Cit;, to be chargeable thereto. Nothing herein contained shall be construed to constitute acceptance by the City of any responsibility for maintenance of the improvements nor shall the City by reason thereof become obligated to any person or property owner for any loss or damage arising by reason of the manner in which said improvements were constructed. S t Further, the City be,. and it is hereby, authorized in addition to the foregoing, in the event of such default on the i part of Elegant, to charge against said funds all costs incurred by the City including attorney's fees in exacting compliance therewith or herewith, and the Loan Association agrees to disburse said .funds for said purposes upon certification thereof by the City. Upon fulfillment of the foregoing, in accordance with the terms and provisions hereof, the City agrees to furnish a certificate ; of release of said deposit or such portions thereof as shall remain after fulfillment of the requirements hereof. Plug all pipe outlets with suitable test plugs. Brace each plug securely. 3. If the pipe to be tested i.s submerged in ground water, insert a pipe probe, by boring or jetting, into the backfill material adjacent to the center of the pipe, and determine the pres ,ure in the probe when ai.r passes slowly through it. This is the back pressure due to ground water submergence over the end of the probe. All gauge pressures in the test should be increased by this amount. 4. Add air slowly to the portion of the pipe installation under test until the internal air pressure is raised to 4.0 prig. 5. Check exposed pipe and plugs for abnormal leakage by coating with a soap solution. If any failures are observed, bleed off air anti make necessary repairs. 6. After an internal pressure of 4.0 prig is obtained, allow at least two minutes for air temperature to stabilize, adding only the amount of air required to maintain pressure. 7. After the two minute period, disconnect air supply. 8. When pressure decreases to 3.5 prig, start stopwatch. Determine the time in seconds that is required for the internal air pressure to reach 2.5 psig. This time interval should then be compared with the time required in seconds as computed on reverse side of sheet. 9. List size and length of all portions of pipe under test in table similar to oi.e shown on reverse side of sheet. 10. By use of nomograph, compute K and C. Use scales d and L, read K and C, and enter these values in the table on reverse side of sheet. 11. Add a:l values of K and all values of C for pipe under test. 12. If the pipe to be tested is submerged in ground water, insert a pipe probe, by boring or jetting, into the backfill material adjacent to the center of the pipe, and determine the pressure in the probe when air passes slowly through it. This is the back pressure due to ground water submergence over the end of the probe. All gauge pressures in the test should be increased by this amount. 4. Add air slowly to the portion of the pipe installation under test until the internal air pressure is raised to 4.0 psig. 5. Check exposed pipe and plugs for abnormal leakage by coating with a soap solution. If any failures are observed, bleed off air and make necessary repairs. 6. After an internal pressure of 4.0 psig is obtained, allow at least two minutes for air temperature to stabilize, adding only the amount of air required to maintain pressure. 7. After the two minute period, disconnect air supply. A. When pressure decreases to 3.5 psig, start stopwatch. Determine the time in seconds that is required for the internal air pressure to reach 2.5 psig. Clean pipe to be tested by propelling snug fi ting inflated rubber ball through the pipe with water. 2. Plug all pipe outlets with suitable test plugs. Brace each plug securely. 3. If. the pipe to be tested is submerged in ground water, insert a pipe probe, by boring or jetting, into the backfill material adjacent to the center of the pipe, and determine the pressure in the probe when air passes slowly through it. This is the back pressure due to ground water submergence over the end of the probe. All gauge pressures In the test should be increased by this amount. 4. Add air slowly to the portion of the pipe installation under test until the internal air pressure is raised to 4.0 psig. 5. Check exposed pipe and plugs for abnormal leakage by coating w .th a soap solution. If any failures are observed, bleed off air and make necessary repairs. G. After an internal pressure of 4.0 psig is obtained, allow at least two minutes for air temperature to stabilize, adding only the amount of air required to maintain pressure. 7. After the two minute period, disconnect air supply. S. When pressure decreases to 3.5 psig, start. stopwatch. Determine the time in seconds that is required for the internal air pressure to reach '.5 psig. This time interval should then be compared with the time required in seconds as computed on reverse side of sheet. 9. List size and length of all portions of pipe under test in table similar to one shown on reverse side of sheet. 10. By use of nomograph, compute K and C. Use scales d and L, read K and C, and enter these values in the table on reverse side of sheet. 11. Add all values of K and all values of C for pipe under test. 12. If the total of all C values is less than one, enter the total of all K values into the space for "Time Required in Seconds." 13. If the total of all C values is greater than one, divide the total of all K values, by the total of all C values, to get. tq. In the event that p^titioner shall fail, neglect or refuse to proceed with the work in an orderly and progressive manner to assure completion within the time limited, upon ten days notice t,y the City to petitioner and petitioner's sureties, and .uch default and failure to proceed continuing thereafter, the City may at its option proceed to have the work completed and charge the r•osts thereof against the petitioner and petitioner's sureties and is the event the same be not paid, to bring an action on the said bone to recover the amount thereof. In the event such action W. ,. be brought petitioner and petitioner's sureties promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the court shall adjudge reasonable as attorney's fees and costs incurred by the City, both in the Trial Court and Appellate Court, if any, or the City may, at its option, bring proceedings to enforce against the petitioner and/or petitioner's sureties specific performance of the contract and compliance with the subdivision standards and ordinances of the City of Tigard, ane in such event, in like manner, the City shall be entitled to recover such sum as the court shall adjudge reasonable as and for the City's attorney's fees and costs, both in the Trial Court and Appellate Court, if any. 4. Petitioner, concurrent with the execution hereof, has deposited with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities within SECTION I of the subdivision, according to Portland General Electric Schedule 091, Option B, together with a further sum equal to the estimated cost of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of initi,il energizing of said lights. The City agrees to make and provide periodic and final inspections a.. in the City's judgement are necessary to assure compliance herewith, in consideration whereof the petitioner has paid prescribed inspection fees. 6. The City agrees to install street identification and traffic signs within the said subdivision, in consideration of payment in the amount of19� 5.00. 7. At such time as all public improvements except side- walks and street trees within the subdivision have been completed in accordance with the City's requirements, petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the petitioner will submit to the City a good and sufficient maintenance bond, if not already provided with the performance bond, in form approved by the City in the sum of , 39,746.00 to provide for correction of any defective work or maintenance becoming apparent or arising within one year after final acceptane- of the public improvements of said by the City. pi, E. Upon receipt of certification by the Department of Public works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth. 9. That in addition to or supplementary of the requirements of the City's Subdivision Ordinance and thi provisions hereof., petitioner binds itself to conform to the following requirements, scheduling and limitations: (a) None of the Lots of petitioner's subdivision as above described may be occupied for residential purposes until an occupancy per,,it is issued under authority of the City and no occupancy permit shall bo issued prior to the acceptance of the subdivision and to the LJ-9 that the sidewalk paralleling the street for each developed lot proposed to be occupied, is installed as n part of the development= provided tblit all sidewalks as required by she plans and subdivision code shall be installed throughout said subdivision not later than three (3) years from the date of this Subdivision Improvement Contract. (2) � Y (b) All landsc::ping trees on that portion of each lot between the public sidewalks and the curb (Parking area) as required, shall be planted and in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and application for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season. In any event, all landscaping trees in all areas shall be planted and in place within the entire subdivision within three ; (3) years from the date of this subdivision improvement contract. 10. The parties hereto hereby adopt the form of performance bond, copy whereof is hereto attached and by reference made a part hereof, and petitic,ner agrees to cause to have the said bond executed and filed with the Ci�.y concurrently with the execution of this agreement at or prior to the time this agreement is executed on behalf of the City. 11.
