WHEREAS, the original performance bond, in lieu of a separate maintenance bond, has remained in full force and effect throughout the normally required maintenance period of one year, and WHEREAS, the Public Works Department has now certified that the specific terms and conditi -ns of said agreement and bond have been satisfactorily completed; and WHEREAS, no deficiencies remain to be corrected thereinregard, NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: The City of Tigard, Oregon, hereby accepts the public main line sanitary sewer improvements known as the Park Street Square Sanitary Sewer Extension; AND FURTHFR, the City Council herfin authorizes release of the aforesaid guarantee bond. Bedford and Kirsten N Bedford hereinafter termed "Petitioner", —' W I T N E S S E T E1: WHEREAS, Petitioner has applied to the City for approval of construction of a sanitary sewer, to be known as Sanitary Sewer mains _ being within the boundaries of an area as described on the attache—d �l.cn , and by reference made a part hereof; and WHEREAS, the City of Tigard requires applicants for construction of sewers, and appurtenances thereto, to submit to construction inspection, and testing therewithal, to grant public easements,thecef•or, and requires the payment of fees; and WHEREAS, the City has approved and adopted the standard specifications for. Public Works construction by APWA, Oregon Chapter, and the Unified Sewerage Agency specifications for sanitary sewers prepared by professional engineers for Public Works construction; and WHEREAS, the public improvements required to be constructed are incomplete, but petitioner has nonetheless requested that the City permit granting of the property to the public, and the parties herein named desire to protect the public interest generally to assure the public improvements will be installed as required and completed within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing premise and the covenants and agree- ments to be kept and performed by the Petitioner and its contractor and contractors surety, IT IS HEREBY AGREED AS FOLLOWS: I. The City agrees to make periodic inspections as, in the City's judgement, is necessary to assure compliance. 7. The Petitioner agrees to insure that the Petitioner's engineer obtains accurate as-built (field) construction records of said sewer installation and, also, agrees to insure that the CiLy is furnished with one accurate a.=-built mylar thereof. 9. At such time as all public improvements have been completed in accordance with the City's requirements, Petitioner shall be required to notify the City of the readiness for final inspection/ upon affirmation by the Department of. Public Works that all re, 'A re-- ments of the City have been met, the Petitic^^r will submit i:o the City a good and sufficient maintenance bond in the form approved by the City in a sum equal to twenty percent (2.0%) of the contract price to provide for correction of any defective work or maintenance becoming anparent or arising within one year after final acceptance of the public improvements by the City. 10. Upon receipt of certification by the Department of Publ ' Works that all require- ments have been met, and a one year Maintenance bond, the City COUnCi.1 agrees to accept the public improvements, subject to the requirement of correction of deficiencies and maintenance for a period of one year. Also, the Division indicates that two lanes exiting Park Street should be provided. 3. A sidewalk shall be provided along Pat-ific width of six feet. Highway with a minimum The City Engineering Division has the following comments: 1 . The terms of the School Street easement should be reviewed to ensure that the proposed accers at that location is appropriate. 2• An 8-foot wide sidewalk is required along Pacific Highway. The entire sidewalk should be within the right-of-way and it appears that additionai right-of-way dedication may be necessary to accommodate it. 3• Half-street improvements including a 5-foot wider sidewalk should be provided along the Paik Street and Grant Avenue frontage. Park Street is identified as a minor collector, requiring a half-street Pavement width of 20 feet . 4. The require distance between driveways and intersections is 30 feet. Tne proposed driveway onto Park Street exceeds this standard. It should be noted, however , that as additional development takes place near Pacific Highway ai,d Park Street, turning movements in and out of this driveway may have to be partially restricted to avoid unnecessary traffic hazards. APPLICABLE PLANNING POLICIES The relevant sections in the Community Development for this request are the C-G (General Commercial zone 18.62) , Additional Yard Area Requirements (18.96) , Landscaping and Screening (18. 100) , Visual Clearance Areas (18. 102) , Off-Street Parking and Loading, Access and Egress (18. 108) , Signs (18. 114) , and Land Division (18. 162). The uses proposed are consistent with those allowed in the C-G zone and the building setbacks from Pacific Highway are appropriate. The landscaping plan submitted does not indicate a sufficient number of street trees as provided in Section 18. 1.00.035. A 6-foot high fence along with a 5 to 10-foot wide landscaped buffer on the back off the project. City Code requires a minimum width for the landscaped buffer of 10 feet. The visual clearance areas for both driveways onto Pacific Highway are proposed to contain signs and vegetation. The Code prohibits obstructions over three feet in height except for utility poles and trees wi 'hout branches below eight feet. The proposed plan is in conformance with parking and access standards except for bicycle parking. A minimum of 5 secured bicycle rack spaces should be provided. The applicant should provide evidence that the parking area will be jointly available to all three parcels. This should be in the form of a recorded legal agreement, such as an easement. The five parking spaces between the driveway for the restaurant and the building will create an awkward situation between cars backing out and vehicles using the drive-up window. It is recommended that this portion of the site plan be modified to remove this conflict. The applicant has not submitted any information regarding signs for review with this application. The proposed partitioning conforms with all applicable criteria contained in Section 18.162.030 and the C-G zone related to lot size and availability of public services and facilities. D. CONCLUSION AND RECOMMENDATIONS The proposed partitioning and site development are consistent with City policy. It is recommended that MLP 12-83 and SUR 17-83 be approved subject to the conditions below: Conditions for MLP 12-E3: 1. The partitioning shall create three parcels of 1.018, 0.53, and 0.543 as shown on the applicants partitioning plan. 2. The Minor Land Partition shall be recorded with Washington County within one year of the approval date. A copy of the recorded Minor Land Partition shall be filed with the City of Tigard Engineering Division. These two requirements shall be accomplished priur to issuance of building permits.
