Summercrest Drive, Millview Court, and Tom Court nood It, ho constructed to local street standards , b. 121st Avenue is a major collector street requiri-iy right—of-way dedication from centerline of 30 feat this condition needs to apply to the lot/homesite on 121st. Avonuu as well as the portions of the plat that abut the street C . In order to avoid an undesirable half--street improvumunt along 121st Avenue, the entire frontage, including the proposed 0. 18 acre parcel, should be improved to major collector street standards . d . No objection to the variance for cul--de--sac length. Any through streets or access onto North Dakota Street or 171st Avenue will be much less desirable from a traffic afut.y stiandpoint. e . An 8 foot wide, paved bicycle/pedestrian path needi to hr installed on the 15 foot easement :,hown between Lot! 18 t+nd 19 to provide suitable access to 121st. Avenue and North Dakota Street. f. Soils reports will be necessary prior to building permit issuance for any lots which receive fill material . PGE and Tigard Water District have no objections to the proposal . Beaverton School District indicat=es that adequate facilities are available to serve the anticipated student population. No other comments have been received . B. FINDINGS AND CONCLUSION' The relevant approval criteria in this case are Comprehensive Polis ik's 2. 1 . 1, 7. 1 .2., 7. 3 . 1 , 7.4.4, 8 . 1 . 1, and 8 . 1 . 3; and Community Developwont Code sections 18 .50, 18. 160, and 18. 164. Since the Plan has oven ack,-iowledged, the State Goals no longer have to be addressed. The Planning Commission concludes that. the proposal with modific,+lion!, is consistent with the relevant portions of the Comprehensive Plan basod upon the findings noted below: 1 . Police 2 . 1 . 1 is satisfied because the Neighborhood P1Nnning Organization and surrounding property owners were given notice of the hearing and an opportunity to comment ,on the applicant ' s proposal . 2. Policy 7. 1 . 2, 7. 31 . , and 7.4 .4 are satisfied because adaque4te water, sewer, and storm drainage facilities are available to the development. The applicant also indicates that these fmcilitie-t will be. provided within the subdivision as required by City standards . 3 . Policy 8 . 1 . 1 calls for a safe and efficient street system that meets current and projected needs . The plat allows fi.ir the. Extension of Summercrest Drive gas a local street. the varinnce criter,'.a have also been satisfied for the cul--de--sac length s discussed below. 4. Policy 8 . 1 . 3 will be satisfied when the conditions of Approvol relating to street improvements are completed, The Planning Commission has determined that, the proposal with modifications, is consistent with the relevant portions of the U..."unity Development Code based upon the findings noted below: 1 . Chapter 18 . 50 of the Code is satisfied because the proposAl moot% all the requirements for the R -4 .5 zone. 2. Chapter 18 . 160 of the Code is satisfied because the propuv,41 xu+ota the requirements set forth for the submission and npprov;41 of a preliminary plat. . FINAL ORDER NO. 06 p _ PC - PAGE: 3 3 . Chapter 18 . 164 of the Code will be satisfied during the approval process for the final plat . 4. Section 18 . 160. 120(b) is satisfied based upon the discussion below: a. Tlherp are special circumstances or conditions affecting the property which are unusual and peculiar to the land as compared to ether land similarly situated; b. The variance is necessary for the proper design or, function of the subdivision; C. The granting of a variance will not be detrimental to the public health, safety, and welfare or injurious to tho rights of other owners of property; and d. The variance is necessary for the preservation and enjoyment of a substantial property right because of an extraordinary hardship which would result from strict compliance with thr regulations of this ordinance. 'The above criteria are met- because: 1 . The previously determined street stubout locations of SW Summercrest Drive determined the wester•1y intersection location. I Any kind of street access to North Dakota "'rept or 121st Avenue would also require a variance and would have y«rious traffic safety ramifications . 3 . This proposal represents the best option for providing safe street access to the project and other altprnativpi will clearly be detrimental , 4 . Because this is the last parcel in the area to develop, no other alternatives exist to provide access to the eastor•n portion of the , property . Denial of this variance will result in poor utilization of this property . C. DECISION Based upon the discussion above, the Planning Commission approves S 16-86/V 26 -86/M 9 -P6 subject to the following conditions : 1 .
