Sherwood Blvd. Sherwood, OR 97140 RE: Millmont Park Subdivision Dear Mr. Miller: It was brought to my attention by Mr. Henry Schmidt, cne property owner to the north of above said subdivision, that an easement was never acquired from him for the sanitary sewer manhole that was partially constructed on his property. Bob Thompson, The City inspector a` the time of construction recalls Mr. Schmidt asking why the manhole was to be onstructed on his property. He also recalls that in his conversation with the contractor that the contractor's foreman agreed to construct the manhole two to three feet south of the proposed locstion. For some reason this was not accomplished and now we have a problem with legal access to that manhole. Please contact Mr. Schmidt and proceed with easement acquisition or at least a letter for right cif entry. If you would like to discuss this further call me at 639-4171. The idea being that upon City assumption of responsibility for the public improvements, within any given residential developmnt project, pedestrians should not unduly suffer the inconvenience, and annoyance, of missing walkway segments. Subsequently, as I see it, three alternatives exist. (b) All landscaping trees on that portion of each lot between the public sidewalks and the curb (parking area) is required, shall be planted in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and -applicant for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season In any event, all landscaping and trees in all areas shall. be planted and in place within the entire subdivision within three (3) years from the cl-te of this subdivision improvement contract. (c) After tentative City acceptance of the public improvements, the Petitioner agrees to place an asphaltic concrete Class "A" overlay nn all roads within the development; placement scheduling to be approve by the City . S a.� R'�•.tiat 1 � W cs� _T__^__ _�lillamette Meridian, Washi gton unty, Oregon; and WHEREAS, the City has approved and adopted the standard specifications for Public Works construction by APWA Oregon Chapter and the Unified Sewerage specifications for the sanitary sewers prepared by professional engineers for subdivision development; and WHEREAS, the public improvements required to be constructed or placed in Petitioner's development are incomplete, but Petitioner has nonetheless requested the City to permit progressive occupancy and use of property in the subdivision, and the parties desire hereby to protect the public interest generally and prospective purchasers of lots in said subdivision by legally enforceable assurances that the public improvements will be installed as required and completed within the time hereinafter set forth. •• NOW, THEREFORE, in consideration of the foregoing premises and the covenants and agreements to be kept and performed by the Petitioner and its sureties, IT IS HEREBY AGREED AS FOLLOWS: (1) Petitioner shall proceed witli the development, with the intent and purpose to complete all public improvements except, sidewalks and street trees of said subdivision not later than two (2) years from the date of this agreement, and Petitioner is hereby bound to comply with all subdivision standards as set forth in said Subdivision Ordinan and the standard specification adopted by the City of tigard, or as may be etnerwise approved by the Public Works Department and to use only such material and to follow such designs as may be required to conform thereto. Petitioner shall provide certification of installation conformance, via a registered civil engineer, to the City prior to City inspection of petitioners improvement work for City tentative and final acceptance consideration. (2) To assure compliance with the City's requirements and the provisions hereof, Petitioner tenders herewith to the City a surety bond in form approved by the City, with liability in the amount of a copy whereof hereto attached by this reference made a part hereof. (3) In the event that Petitioner shall fail, neglect or refuse to proceed with the work in an orderly and progressive manner to assure completion within the time limits, upon ten (10) days notice by the City to Petitioner and Petitioner's sureties, and such default and failure to proceed continuing thereafter, the city may at its option proceed to have the work competed and - 1 - I charge the costs hereof against Petitioner and Petitioner' s sureties and in the event same be not paid, to bring an action on the said bond to recover the • amount thereof. In the event such action be brought, Petitioner and Petitioner' s sureties promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the court shall adjudge reasonable as attorney' s fees and costs incurred by the City, both in the Trial Court and Appellate Court, if any, or the City may, at its option, bring proceedings to enforce against the Petitioner and/or Petitioner' s sureties specific performance of the contract and compliance with the subdivision standards and ordinances of the City of Tigard, and in such event, in like manner, the City shall be entitled to recover such sum as the court shall adjudge reasonable as and for the City' s attorney' s fees and costs, both in the Trial Court and Appellate Court, if any . (A) Petitioner, concurrent the with execution hereof, has deposited with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities within the subdivision, according to Portland General Electric Schedule 091, Option "B", together• with a further sum equal to the estimated cost: of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of initial energizing of said lights . Said amount being $ �1 (5) The City agrees to make and provide periodic and final inspections which in the City' s interest are desirable to assure compliance herewith, in consideration whereof the Petitioner has paid prescribed inspections fees.* (6) The City agrees to install street identification and traffic signs within the said subdivision, in consideration of payment in the amount of (7) At such time as all public improvements except sidewalks and street trees within the subdivision have been completed in accordance with the City ' s requirements, Petitioner shall submit a "certificate of installation conformance" to the City to notify the City of the readiness for acceptance consideration inspection and upon notification by the Department of Public Works that the r•egVirements of the City have been met, the Petitioner will submit to the City a good and sufficient maintenance bond if not already provided with the performance bond, form approved by the City, in the sum of $-- 54P . Upon receipt of certification by the Department of Public Works, that all requirements have been met, and a One Year Maintenance Bond, the City Council agrees to tentatively accept the public improvement subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth. (8) That in addition to or supplementary of the requirements of the City' s Subdivision Ordinance and the provisions hereof, Petitioner binds itself to conform to the following requirements, scheduling and limitations: *Project Fee $ Sewer• Fee $ 2 (a) None of the lots of Petitioner' s subdivision as described may be occupied for residential purposc!s until an occupancy permit is issued under authority of the City and no occupancy permit shall be issued prior to the acceptance of the subdivision and to the time that the sidewalk paralleling the street for each developed lot proposed to a occupied, is installed as a part of the development; provided that all sidewalks as required by the plans and subdivision code shall be installed throughout said subdivision not later than 3 years from the date of this Subdivision Improvement Contract. (b) All landscaping trees on that portion of each lot between the public sidewalks and the curb (parking area) is required, shall be planted in place prior to final inspection and issuance of occupancy permit; fur each such lot in the subdivision. Provided that final inspection and applicant for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season. (9) At such time as all public improvements have been completed in accordance with the City' s requirements, Petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the Council agrees to accept said improvements for operation and maintenance responsibility, thereinregard, and release the Petitioner' s guarantee bond. (10) The parties hereto hereby adopt the form of performance bond, copy whereof is hereto attached and by reference made a part hereof, and Petitioner agrees to cause to have said bond executed and filed with the City concurrently with the execution of this agreement at or prior to the time this agreement is executed on behalf of the City. Site Information The property is vacant, relatively flat, and does not contain any significant vegetation. 1 5. Proposal Description A 51-lot subdivision is proposed. The lots are oriented around a street pattern which consists of a curvilinear extension of S.W. Hamlet Street on the western property line to Hall Blvd. and a north-south street connecting the Hamlet Street extension with the development to the south (S 3-84). Two cul-de-sacs will come off of Hamlet Street. Except for the corner lots, virtually all of the parcels are proposed to utilize a "0" foot side yard on one side. The remaining setbacks are intended to meet the requirements of the R-7 zone. The variance application covers these two aspects of the proposal. h. Agency Comments The Engineering Division has no objection to the proposal but makes the following observations : a. A State Highway Division permit for access and improvements on Hall Blvd. will be required. b. Full one-half street improvements to arterial standards are required along the Nell Blvd. frontage. C. Hall Blvd. is designated as a bicycle route in the adopted Tigard Area Comprehensive Pedestrian/Bicycle Pathway Plan. Additional pavement width may be required along Hall Blvd. to accommodate bicycles. Plans for the bicycle routes should be submitted as part of the half-street improvement plans. d. A 15-foot wide public utility easement is required for the storm line between "C" Street and Hall Blvd. e. A temporary turnaround should be provided at the south end of "B" Street if it precedes development to the south. Th ualatin Rural Fire Protection District has no objection to the proposal. The District does recommend the relocation of the proposed hydr..nt at the corner of Hamlet Street and the cu:-de-sac to the corner of Hamlet Street and Hall Blvd. The schools that will serve this development are listed below along with current enrollment and capacity figures. ANALYSIS 4ND CONCLUSION The location o' the north-south street in the development should be coordinated with he development to the south (Robert Randall S 3-84). As proposed, there is a 10-foot offset between the street alignment for the two projects. The required improvements along Hall Blvd. should be coordinated through the City Engineering Division. Access and street improvements -n iiall Blvd. will ultimately require State Highway Division approval. The size and/or configuration of lots 22 through 30 should be modified to conform with the density transition provision in Section 18.40.040 of the Code. The density within 100 feet of th^ western property line is 7.92 units/acre and the maximum allowable density is 6.25 units/acre. The proposed development is consistenL with the overall density requirement of the R-7 zone. Only the minimum lot size standard of 5,000 square feet in the R-7 zone is not met by this proposal. Because it appears that the current proposal is close to meeting the R-7 zone standards, the Planning staff is requesting consideration of a zone change from R-12 to R-7. Sire the adoption of the new ordinance in November, several lend use proposals have encounttced setback difficulties for single family residences in tha R-12 zone which allows both single and multiple family residential development. It is the opinion of the staff that when variances are required th.oughout a development, a zone change is a more appropriate method for alleviating the problem. If lesser setbacks for single family residences in th,! R-12 zone appear justified, the City should initiate a modification to the Code rather than routinely requiring plan change or variance app'.ications to obtain the desired setbacks. V,e change will be consistent with the Comprehensive Plan designation which calls for residential densities of i to 1.2 units per acre and the rezoning proposal on the property to the south (Robert Randall ZC 3-84). The request will establish a less intensive zone that is more consistent with the type of development proposed, especially in terms of setback requi:cements. RECOMMENDATIONS The Planning staff r-icommends denial of V 2-84 and approval of a zone nhange from R-12 to R-7 and to allow "O" foot side yard construction as Frovid2d in Chapter 18. 148 of the Code.
