WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, storm sewers, sanitary sewers , underground utilities and other public facilities for the development of subdivisions; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement which stipulates that: "Upon receipt of certification by the Department of Public Works that all requirements have been met , the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies sn-I maintenance for a period of one year. . . ;" and WHF'REAS, said Certification has now been received ; a WHEREAS, all deficiencies have now been corrected. NOW, THEREFORE, BE IT RESOLVED that the City COLncil of the City of Tigard, Oregon, hereby accepts the public improvements constructed within Lynz Curt Subdivision, said subdivision being recorded in Book 51 on Page 38 in Washington County, Oregon, Plat Records. AND FURTHER, the City Council herein authorizes release of the aforesaid Maintenance Bond. As a result of a satisfactory inspection and in light of your desire to con— tinue the existing performance bond throughout the maintenance period, in lieu of submitting a separate maintenance bond, we are now processing the necessary documentation (to the Council) to facilitate tentative acceptance of the project at the next Council meeting. Further, though it is recognized that construction defect additions and de— letions will probably occur throughout the one—year maintenance guarantee period, the following listing summarizes items noted to date which remain to be completed and/or corrected before final City acceptance of the project. 1. All driveway aprons and sidewalks need to be installed 2. The one inch Class "C" AC overlay needs to be installed (within one year). 3. All sanitary sewer lines need to be Wed; a video tape and written report needs to be given to the City for evaluation. Therefore, in reference to condition(s) number seven (7) and eight (S) of the project Compliance Agreement, we find we are able to certify project readiness for tentative acceptance to the Council with the balance of the 'construction defect work' to be completed/rectified during the one-year guarantee period. I have a April 28, 1980 letter from John S. Hagman, with a subdivision Compliance Agreement. I met with Mr. Iiagman and explained that due to the present unstable Real Estate Situation we might not want to go ahead with construction now, and were searching for an alternative situation. It appears that the Compliance Agreement requires us to complete the work, notwithstanding the fact that economic or war conditions might make it important to delay. 2. I think the attached form, which `I received from the Real Estate Division, Subdivision Section, permits us to place a sign and take reservations for the lots, something I believe would be logical for the next month or so, until a clearer picture is available. I am also involved in a trial, schedule for the first half of June, and hopefully that might make a difference. Cresmer Drive (Wash. Co. Tax Map 2S1 2CD, Tax Lot) Previous Action: On June 25, 1979, the City Council approved the zone change on the subject site from County "RU-4" to City "R-7." The site was annexed into the City with the McDonald Street annexation action in January, 1979. Request: The applicant is requesting preliminary plat approval in accordance with Section 17.16.100 of the Tigard Municipal Code to subdivide a 1.51 acre parcel into six lots with a minimum lot size of 7,500 sq. ft. at SW Ash Street near. SW Cresmer Drive. I. Findings of Fact: 1. The site is designated "Urban Low Density Residential" of the NPO Ill Plan and is currently zoned R-7, "Single Family Residential." 2. Applicable policies from the NPO Ill Plan include the following: a. "Density" - Policy 1 (Page 14) b. "Utilities, streets, etc." -��Policy 2 (Page 14) c. "Water and sewer facilities: Policy 3 (Page 14 & 15) 3. Section 17.16.100 states that: No tentative plan for a proposed subdivision and no tentative plan for a major partition shall be approved unless: a. Streets and roads are laid out so as to conform to the plats or subdivision or maps of major partitions already approved for adjoining property as to width, general direction, and in all other respects, unless the City determines it to be in the public interest to modify the street or road pattern. b. Streets and roads held for private use are clearly indicated on the tentative plan, and all reservations or restrictions relaying to such private roads and streets are set forth thereon. No tentative Plan of a subdivision or map of a major partition shall be approved unless there will exist adequate sewage disposal system to support the proposed use of the land described in the proposed plat. 4. The site slopes north to south at approximately 6' percent. The surrounding land uses are single family homes to the north, south, east and west in- cluding the Berea Subdivision to the north. 5. Sanitary sewer service and water service is available on Ash Street. 6. SW Ash Street is designated as a local street on the NPO 411 Plan with 50 .feet of right-of-way and 34 feet of pavement. The current right-of- way width is 45 feet. 7. No indication has been given as to how storm water run-off is to be handled. State law requires that: Rain, storm, and other surface run-off water drained from roofs, paved areas, courts or courtyards shall not be conveyed and discharged to the storm sewers or to the street gutters in a manner which may cause flooding to adjacent property, streets, alleys or walkways. II. Conclusionary Findings: 1. SW Asti Street is in substandard condition having inadequate right-of-way and pavement width and no sidewalks on curbs. 2. The proposed preliminary plat conforms to the Comprehensive Plan, in that the proposed lotting pattern is for residential purposes and conforms to the requirements of the zoning code. 3. With the attachment of appropriate conditions, access will be available to all lots, each lot as proposed will abut a public street. 4. Adequate sanitary sewer and water services are available. III. Final Action: The preliminary plat for Cowles Court subdivision is hereby approved subject to the following conditions: That an additional five feet of right-of-way be dedicated to the City or SW Ash Street. 2.
