WHEREAS, the City of Tigard Subdivision Ordinance requires subdividers to install streets, sidewalks, street lights, curbs, storm sewers, sanitary sewers, underground utilities and other public facilities for the development of subdivisions ; and WHEREAS, the City further required the payment of fees and the execution of a Compliance Agreement which stipulates that : "Upon receipt of certification by the Department of Public Works that all requirements have been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvement:a, { subject to the requirements for correction of deficiencies and maintenance for a period of one year . . .";and WHEREAS, said Certification has now been received by the Department of Public Works that all requirements of the Subdivision Compliance Agreement have been met , and WHEREAS, the required performance bond has remained in full force and effect throught the normally required maintenance period of one year; and NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, hereby accepts the public improvements constructed within LA MANCHA ESTATES SUBDIVISION, said subdivision being recorded ir. Sewer service is available to the site from an 8" line at Hall Blvd. and Murcock Street or from an 8" line in 83rd Avenue at the south line of Hambach Park Subdivision. The preliminary plat proposes to extend an 8" sewer line120 ft. along Hall Blvd. and thence along the common lot lines of Lots 14 and 15 to the cul-de-sac in LaMancha Estates. 6. Water service is available to the site from a 12" Tigard Water District line in Hall Blvd. or a 6" line in 83rd Avenue from Hambach Park. The preliminary plat proposes to extend a 6" water line from Hall Blvd. through Lot 13 to the cul-de-sac in LaMancha Estates. 7. A storm drainage plan was not indicated on the preliminary plat. 8. The existing right-of-way on SW Hall Blvd. is 60 feet, with 22 feet of pavement in fair (i.e. patched) condition and inadequate shoulders. NPO Plan 115 and #6 designated SW Hall. Blvd. as a "Residential Arterial" with a 90 foot right- of-way, 2 lanes, 24 feet paved with a 14 foot landscaped median, capable of handling 6-12,000 vehicles a day at a driving speed of 25-35 miles per hour. . The preliminary plat proposes to dedicate 45 feet of right-of-way from the centerline of SW Hall Blvd. 9. The Tigard Environmental Design and Open Space Plan designates SW Hall Blvd. as a "visual corridor". As a condition of approval of Hambach Park (S 1-78), immediately north of LaMancha Estates, a 15 foot landscaped earth berm was required along SW Hall Blvd. frontage. 10. No fire hydrant within LaMancha Estates was indicated on the preIimiary plat. Joseph E. Gruelich, Deputy Fire Marshall, Tualatin Rural Fire Protection District, stated in a letter dated February 20, 1980, that a fire hydrant will be required to be installed at the corner of 83rd and the cul-de-sac street in Ira Mancha Estates. ll . A revised preliminary plat was submitted by the applicant .ollowing the Planning Direr_tor's denial of the original one on January 17, 1980. The revised plat proposes access to LaMancha Estates from the north via 83rd Avenue, no direct access from Hall Blvd. , and the extension of 83rd Avenue as a stub street to the south line of LaMancha Estates, to serve future development to the South. That the lot lines on lots 10 and 16 be adjusted on the Final Plat so that these lots meet the 5000 sq. ft. minimum lot size requirements. 2. That a one foot reserve strip in 83rd Avenue at the south line of LaMancha Estates be conveyed to the City and so indicated on the final plat. 3.
