Katherine St. Extension East Gentlemen: During the latter part of 1918, it was brought to your attention that the 36" culverts were not installed according to the Plans. one pipe was to terminate approximately 9 feet from the R/W, measur:,d at right angles to the R/W in order to provide room for the sidewalk. We have received permission from the City to locate the sidewalks at the curb line. In order to do this, five culvert ends will have to be extended. Enclosed is a sketch showing the necessary extensions. Also the rip-rap and concrete seal was improperly installed (see enclosed letter from City) and has washed out. Katherine Street as described on the attached Exhibit "A" , and by reference made a part hereof; and WHEREAS, the City of Tigard requires Petitioners for street dedications to install streets, sidewalks, curbs , street light- ing, storm sewers, underground utilities and other public facilities for the development of the street and requires the payment, of fees; and WHEREAS, the City has approved and adopted the standard specifications for Public Works construction by APWA, Oregcn Chapter, and the Unified Sewerage specifications for sanitary sewers prepared by professional engineers for Public Works con- struction; and WHEREAS, the public improvemen*s required to be constructed or placed in the said street area are incomplete, but petitioner has nonetheless requested the City to permit dedications of the property to the public and the parties herein named desire to protect the public interest generally to assure the public im- provements will be installed as required and completed within the time hereinafter set forth, NOW, THEREFORE, in consideration of the foreg.)in; premise and the covenants and agree►nents to be kept and performed by the Petitioner, IT IS HEREBY AGREED AS FOLLOWS: 1. Petitioner shall proceed to complete all public improve- ments as shown on herewith attached plan, as approved by the City of Tigard, prepared by Harris-McMonagle Associates (Tiardy Oregon) dated July 6th, 1978 Said street to be completed no later than one (1) year from the date of this agreement , and Petitioner hereby agrees to comply with standard specifications adopted by this City, or as may otherwise be approved by the Department of Public Works and to use only such material and to follow such designes as may be required to conform thereto. 5 2. To assure compliance with the City's requirements and the provisions thereof, Petitioner agrees to abide by the terms of the agreement between the City and the Petitioner, dated June 26th and July 27th, 1978, a copy of which is attached hereto. 3. Petitioner, concurrent with the execution hereof, will deposit with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities of the roadway, according to Portland General Electric Schedule #91 , Option B, together with a further sum equal to the estimated cost of providing electrical energy to energize the street light- ing facilities for a period of two (2) years from tA%.da,te of initial energizing of said lights, in the sum of $ 4. The City agrees to make periodic and final inspections as in the City's interest and judgment are necessary to assure compliance herewith, in consie,eration whereof the petitioner is to pay the prescribed inspection fee of 1-1/2% of the total estimated cost of the construction, being 796.58 , 5. The City agrees to installation of street identifications and traffic signs for said street, in consideration of payment in the amount of $ 74.45 6. The Petitioner shall provide written certification from his engineer to the City that all workmanship and materials therein- regard said installation are in accord with the best practices and are of high grade, prior to City final acceptance of the improve- ment(s) . 7. Within one year of acceptance of the public improvements ti,e petitioner agrees to place a one (1) inch asphaltic concrete Class overlay on the roadway. B. At such time as all public improvements have been completed in accordance with the City's requirements, petitioner shall be required to notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the petitioner will submit to the City a good and sufficient maintenance bond, it not already provided with the performance bond, in form approved by the City in a sum equal to twenty per cent (2010) of the contract price to provide for coriec:ion of any defective work or maintenance becoming apparent of arising within one (1) year after final acceptance of the public improvements of said street by the City . 9. Upon receipt of certification by the Department of Public Works that all requirements have been met and a one (1) year maintenance bond, the City Council agrees to accept the pubic improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth. The owner and buyer do hereby give and grant to the District a non-exclusive perpetual right-of-way and easement for road, street and utility purposes on, across, within, along, over and under the Southwest Katherine Street Extension East as described on the attached sheet entitled "Legal Description" marked Exhibit "A" and by this reference made a part hereof, to enable the District to award a bid for the construction of said Southwest Katherine Street Extension as a means of public access to the West Tigard School site. 2. CITY OF '1IGARD ORDAINS AS FOLLOWS: Se, tion 1: That Section 10.28.130 of the Tigard Municipal Code, relating to locations where parking is prohibited at any time, be and the same is hereby amended and supplemented to add thereto a new subsection reading as follows: "10.23.130 Irohibi.ted at any time. No person shall at any time parkor leav? standing a vehicle of any kind or character, whether motorizedor not , and whether attended or unattended, within the following definedportiong of public streets and highways within the City: Within the westerly Half of the right-of-way of 115th Aven-e extending from the intersection with SW (;aarde Street northerly to the intersection of SW Fonner Street. Section 2: That the City Administrator be authorized and directed to cause to hove the areas in which parking is prohibited as above set forth suitably Poster' in the mar.rer provided by law. Section 3: Inasmuc' as this parking prohibition is necessEry to provide ade ,liate site distance and safe vehicle movement clearance and it is necessary Lo protect the nealth, safety and general welfare of the public and in particular, pedestrians on said strut, an emergency is recognized to exist and is hereby declarLd and this ordinance shall become effective immediately upon passat.c! anu approval by tte City Counc41.
