Provided that final inspection and applicant for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season. In any event, all landscaping and trees in all areas shall be planted and in place within the entire subdivision within three. (3) years from the date of this subdivision improvement contract. (c) After tentative City acceptance of the public improvements the petitioner agrees to place a one (1) inch asphaltic concrete Class "C" overlay on all roads within the development ; placement scheduling to be approved by the City. (d) Compliance with all terms and provisions specified theretofor said subdivision development by the Council and the Planning Commission of the City of Tigard, Oregon, inr.egard to variances allowed from the subdivision ordinance, con- ditions specified by the zone use classification and, also, on the approved plat(s) and plan(s) . (e) Petitioner agrees to provide for correction of .1ny defective work and/or maintenance becoming apparent or arising during the guarantee period as here- inabove set forth. (9) At such time as all public improvements have been completed in accordance with the City's requirements, petitioner shall notify the City of the readiness for final inspection and upon certification by the Department_ of Public Works that all requirements of the City have been met, the Council agrees to accept said improvements for operation and maintenance responsibility,tttereinrcgard, and release the petitioner's guarantee bond. We have no objections to these substitutions as long as the city has utilized -the proposed substitutions on similar projects and feel comfortable with their use. The only possible concern that we have is utilizing sand in lieu of 2"-0 crushed rock trench backfill on steep pipe slopes. If excessive amounts of water are allowed to flow through the trench, sand is possibly more susceptible to shifting down stream in the trench, causing settlement. Of course rock will react the same depending on the volume of water. However, we feel that with proper care in construction, sand would be an acceptable substitute for the rock. We also feel Ko--N-Seal Assembly connections to manholes is preferable to grouting, and the 1'k"-0 rock substitute for 2"-0 rock 1.9 acceptable and apparently a common substitute in the area. The Council adopts the following substantive findings: A. That this application is in conformance with the R-7PD "Single Family Residential Planned Development lstrict" designation on the NPO N6 Plan which is a portion of the adopted Tigard Comprehensive Plan, and B. That the proposed zoning is compatible with the surrounding neighborhood as determined by the Tigard Planning Commission. SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the Tigard Municipal Code, this request for an amendment to the Zone Map of the City of Tigard is hereby approved subject to previsions of Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits "A", "B", and "C" attached and made a part of this Ordinance. The zoning designation of the subject property is hereby changed to City of Tigard R-7PD "Single Family Residential Planned Development District. Exhibit "A": - Legal Description, Exhibit "B": - Tax 14ap, Exhibit "C": -• Staff Report And Further subject tc the following conditions: 1. Planning Commission to dictate specific density for Stage II. 2. . Lot 116 to be presented before the Planning Commission at a later date. ORDINANCE NO. 13. Public water service and sanitary service shall be installed to this site prior to the issuance of building permits. 14. All existing or proposed utilities shall be placed underground. Street lighting installations shall be approved by the Public Works Director. 15. No building permits shall be issued until the expiration of the twenty (20) day appeal period from the date of approval. 16. That a bike path shall be constructed connecting Pick's Landing with Cook Park. 17. That minimum front yard setback shall be 24 feet from curb to front of garage for all appropriate units in Stage Two.. SECTION 3: This ordinance shall be filed with the recording office of Washington County. This ordinance is not effective until so filed according to ORS 92.048 (4). SECTION 4: This ordinance shall be effective immediately after its passage-by the Council and approval of the Mayor.
