WHEREAS,, the City executed a Subdivision Compliance Agreement dated June 25, 1984, with Titan Properties Corporation to facilitate installation of public street, storm and sanitary sewar and streetlighting facilities to City standards and specifications; and W11L.REAS, said Compliance Agreement stipulated that: "At such time as all public improvements have been completed in accordance with the City's requirements, Petitioner shall notify the City of readiness for final inspection and upon certification by the Department of Community Devalopment that all requirements of the City have been met, the Council agrees to accept said improvements, for operation and maintenance responsibility, and release the Petitioner's guarantee bond;" and WHEREAS, Department of Community Development staff verifies that all requirements of the City have been met; and NOW, THEREFORE, BE IT RESOLVED by the Tigard City Council that: Section 1 : The Tigard City Council hereby accepts the public. improvements known as Colony Creek No. 2 subdivision public improvements. Fanno Creek Drive; I'm afraid that without a formal waiver, in accordance with T.M.C. 18.164.070(a), it must be constructed using concrete. It is only in areas of limited street improvement (.i.e. no sidewalk and curb) that a driveway approach may be constructed of the same material that is used for surfacing of roads and driveways; T.M.C. 15.04.090 is quite clear about that. (b) All landscaping trees on that portion of each lot between the public sidewalks and the curb (parking area) as required, shall be planted and in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and applicant for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be leferred until the next following growing season. Co. Tax Map 2S1 12BB, Tax Lots 101 , 102, 3600 and 3700) . DECISION_: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the proposal subject to certain conditions. Tile findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1. Background No other land use cases have been reviewed by the City on this property. 2. Vicinity Information Phase I1 of the proposed Colony Creek development abuts this property -n the northeast, east , and southeast. Single family residences are located to the south and on the west side of Hall Blvd. The R-7 zone surrounds the property except the area to the south which is zoned R-12 (Residential , 12 units/acre). 3. Site Information and Proposal Description The property to be divided is not. developed. The applicant is proposing to create two flag lots and one lot with 90 feet of frontage on Hall Blvd. Fifteen foot wide access strips are proposed to connect the Lwo flag lots with Hall Blvd. A lot line adjustment is also proposed to transfer the 10.24 foot wide ac,.ess strip for T.L. 3700 to the southern boundary of the three proposed lots and remove approximately 2045 square feet along the eastern and northeastern section of the eastern flag lot. This latter adjustment will increase the depth of Lots 56, 57, 58, 61 , 62, and 63 of Phase 11 of Colony Creek Estates which has received preliminary plat approval. Single family residences are proposed along with a common driveway serving all the parcels. During the construction of Colony Creek Phase 1I, a temporary access is to be constructed through this property which coincides with the driveway location for the three lets. NOTICE, OF DECISION - MLP -84 - PAGE 1 4. Agency and NPO Comments The Engineering Division has the following comments: a. Additional road right-of-way should be dedicated to increase the right-of-way width from centerline to 45 feet. b. A potential problem occurs if the access strip to T.L. 3700 is eliminated as intended with the lot line adjustment, and Phase II of Colony Creek .lois not materialize. C. The proposal should be reviewed in conjunction with Colony Creek Estates Phase Il. d. The proposal should comply with City survey requirements. The State Highway Division states Lhat engineering drawings consistent with Engineering Division specifications for the driveway access should be submitted to the City for review. Upon acceptance by the State and City, an approach road permit may be issued. Any additional residences using this access will require another permit from the State Highway Division. The Building Inspection Office notes that additional height and/or setback requirements apoly to flag lots (Se-. 18.98.030). Comments have not been received from NPO #5. B. ANALYSIS AND CONCLUSION The proposed partitioning and lot line adjustment conforms with the lot size requirements of the R-7 zone. After the required right-of-way dedication along Hall Blvd. , the lots will exceed the 5000 square foot minimum. It appears that the only legal accese to tax lot 3700 will be eliminated by adding the access strip to the three proposed lots. Evidence should be provide3 showing that legal access will be retained via an easement or other appropriate means. The applicant intends to develop three detached single family residences using a zero-foot side yard setback. Through an apparent oversight , the new Community Development Code only allows this building technique in subdivisions and planned developments. It is the Planning staff 's opinion that it was not intended to exclude partitioned land. The City is presently receiving a number of modifications to the Code that will be presented to the City Council for approval on April 23, 1984. A change to make partitioned land eligible for zero-lot line development will be included on the Council agenda. Unless this change i approved by the Council , the proposed zero-lot line proposal will require a variance. Windows 15 feet or more above grade shall not face dwelling unit windows or patios on any abutting lot unless the proposal includes an agreement to plant trees capable of mitigating direct views without loss of solar access to any dwelling unit, or that such trees exist and will be preserved. B. Where an agreement is made to plant trees capable of mitigating direct views, the dareement shall be deemed a condition of approval under the provisions of Section 18.32. 250 (F).
