WHEREAS, the City of Tigard Subdivision Ordinance requires installation of streets, sidewalks, streetlights, storm sewers, curbs, sanitary sewers, underground utilities and other public facilities for the development of sub- divisions; and WHEREAS, the City further required the payment of fees and execution of a Compliance Agreement, which stuipulated that: "Upon receipt of certification by the Department of Public Works that all requirements ha-,e been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements subject to the requirement for correction of deficiencies and maintenance for a period of one year . . . and WHEREAS, the City Council received conditional certification from r_he Department of Public Works and the maintenance guarantee, and WHEREAS, the City Council accepted said improvements, subject to correction of specified deficiencies during the maintenace period, via Council Resolution No. 79-47, and WHEREAS, the Department of Public Works has now certified that it it�d deficiencies have hcen r.orr,c:ted, and all public improvements the•re— itiregard said subdivision are compLerc, and IMEREAS, the required one year maintenance period has passed N0W, THEREFORE, BE IT RESOLVED that the City Council of the City of Tigard, Oregon, Hereby accepts all public improvements constructed within Cloud Cap Sub- diVLSion b%ing recorded in Book 40 on Page 4 in Washington County, Oregon, Plat Records, AND FURTHER, hereby authorizes release of the mai.nten.ince guarantee bond. W I T N E S S E T H : WHEREAS, Petitioner has applied to the City for approval for filing in Washington County, a subdivision plat known as CLOUD CAP located in Section II , Township 2 South, Range 1 West Williamette Meridian, Washington County, Oregon; and WHEREAS, the City of Tigard Subdivision Ordinance requires the subdivider to install streets, sidewalks, street lights, storm sewers, sanitary sewers, underground utilities and other public facilities for the development and requires the payment of fees; and WHEREAS, the City has approved and adopted the standard specifications for Public Works construction by APWA Oregon Chapter and the Unified Sewerage specifications for the sanitary scwers prepared by professional engineers for subdivision development; and WHEREAS, the public improvements required to be constructed or placed in petitioner's development are incomplete, but petitioner has nonetheless requested the City to permit progressive occupancy and use of property in the subdivision, and the parties desire hereby to protect the public interest generally and prospective purchasers of lots in said subdivision by legally enforceable assurances that the public improvements will be installed as required and comoleted within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing premises and the covenants and agreements to be kept and performed by the Petitioner and its sureties, IT IS HEREBY AGREED AS FOLLO'.4S: (1) Petitioner shall proceed with the development, with the intent and purpose to complete all public improvements except sidewalks and street trees of said subdivision not later than two (2) years from the date of this agreement, and Petitioner is hereby bound to comply with all subdivision standards as set forth in said Subdivision ^rdinance and the standard specifications adopted by the City of Tigard, or as may b, otherwise approved by the Public Works Department and to use only such material and to follow such designe as may be required to conform thereto. (2) To assurF compliance with the City's requirements and the provisions hereof, Petiticner tenders herewith to the City a surety bond in form approved by the City, with liability in the amount of $ 57,424 .20 a copy whereof is hereto attached and by this reference made a part hereof. (3) In the event that Petitioner shall fail, neglect or refuse to proceed with the work in an orderly and progressive manner to assure completion within the time limits, upon ten (10) days' notice by the City to Petitioner and Petitioner's sureties, and such default and failure to proceed continuing thereafter, the City may at its option proceed to have the workeanpleted and charge the costs thereof against Petitioner and Petitioner's sureties and in the event same be not paid, to bring an pc tion on the =aid bond to rmcover the amount thereof. In the Event such action be brought, Petitioner and Petitioner's sureties promise and agree to pay, in addition to the amounts accruing and allowable, suth sum as the court shall adjudge reasonable as attorney's fees and costs Incurred ry the City, both in the Trial Court and Appellate Court, if any, or the City may, at its option, bring proceedings to enforce against the Petitioner and/or Petitioner's ,sureties specific performance of the contract and compliance with the subdivision standards and ordinances of the City of Tigard, and in such event, in like manner, the City shall be er:titled to recover such sum as the court shall adjudge reasonable as and for the City's attorney's fees and costs, both in the Trial Court and Appellate Court, if any. (4) Petitioner, concurrent with the execution hereof, has deposited with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities within SEETIEmi i the subdivision, according to Portland General Electric Schedule #91, Option B, together with a further sum equal to the estimated cost of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of initial energizing of said lights. Said amount ::::ing $ 208.08 (5) The City agrees to make and provide periodic and final inspections and in the City's judgment are necessary to assure compliance herewith, in consideration whereof the Petitioner has paid prescribed inspection fees. * (6) The City agrees to install street identification and traffic signs within the: said subdivision, in consideration of payment in the amount of $ 123 . 50 (7) At such time as all public improvements except sidewalks and street trees within the subdivision have been completed in accordance with the City's requirements. Petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public. Works that all requirements of the City have peen met, the Petitioner will submit to the City a good and sufficient maintenance bond, 'f not alrfady provided with the performance bond, form approved by the City in the ',um of $_ 28, 712. 15 to provide for correction of any defective work or main- tr:nance L•ecoming apparent or arising within one (1) year after final acceptance of the public improvements by the City. I (8) Upon receipt of"certification by the Department of Public Works that all requirements havr. been met and a One Year Maintenance Bond, the City Council agrees to accept the public improvements, subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth. (9) That in addition to or supplementary of the requirements of the City's S,bdivislon Crdinance and the provisions hereof, Petitioner binds itself to conform to the fallowing requirements, scheduling and limitation3: a. None of the Lots of petitioner's subdivision as above described may be occupied for residential purposes until an occupancy permit is issued under authority of the City and no occupancy permit shall be issued prior to the acceptance of the subdivision and to the time that the sidewalk paralleling the street for each developed lot pro- posed to be occupied, is installed as a part of the devElopment; provided that all sidewalks as required by the plans and subdivision code shall bL installed throughout said subdivision not later than 3 years from the date of this Subdivision Improvement Contract. *project fee $571. 37 sewer fee $150.00 -2- 3 b. All landscaping trees on that portion of tach lot between the public sidewalks and the curb (parking area) as rLquir.ed, shall be planted and in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and applicant for occupancy permit occurs within any calendar month form October to April of any year, such plantings may be deferred until the next following growing season. In any event, all landscaping trees in all areas -hall be planted and in place within the entire subdivision within three (3) years from the date of this subdivision improvement contract. c. Within one (1) year of acceptance of the public improvements the petitioner agrees to place a one (1) inch asphaltic concrete Class "C" overlay on all roads within the development. d. LOCATION: S .W . 97th Avenue , north of S .W . hlurdoc.k Street (Wa . Co . Tax Afap 2S1 3CDC, Tax Lot 700) . APPLICANT: Waverly Construction/Harris-P:1cMonagles Associates 1 . BASIC FACTS : 1. The site is designated "Urban Low Density Residential" on the Tigard Community Plan and zoned "R-7, Single Family Re- sidential" . 2. S .W. 97th Avenue, S .W. Murdock Street , S .M . Pembrook Street are all designated local streets on the Tigard Community Plan . 3. This request was initially heard by the Planning Commission on January 4 , 1977 and tabled. The mat{ _- was reheard Feb- ruary 1, 1977 . On February 14 , 1917 the City Council deter- mined that the variance to the street width i)ad been improp- erly granted and remanded back to the Planning Cornmission for .further action . The Planning Commission on March 15 , 1977 approved the subdivision and recommended the City Coun- cil approve the variance with modifications to the require- ments of the variance section of the Tigard Municipal Code . This item is scheduled for hearing on April 25, 1977. The applicant has stated his wish to begin construction and re- submitted a preliminary plat without a variance request . II . FINDINGS : 1 . The applicant is requesting to create a 14 lot subdivision with minimum lot size of 7, 500 sq . ft . in R-7 zone and ex- tending S .W . Pembrook Street- to S .W . 97th Avenue . 2. The site slopes up from southeast to northwest over the property with an approximate 40 ft . change in elevation . The site is presently being used as a pasture area with a small stand of large Douglas fir and deciduous trees in the northwestern area of the site . The existing house har er- roneously been left off the plat . i STAFF REPORT • • AGENDA 5 . 5 TIGARD PLANNING CONIMfSSION April 5, 1977 Page 2 3 . The surrounding land use is subdivision size lot residential area to the west and south with a large lot to the north and Twality Junior High to the east . 4 . The present traffic circulation pattern shows a majority of the traffic on ":he local streets in the area go the S.W. 97th- S .W. Murdock Street-S .W. 98th Avenue route, which is presently inadequate and requires two 90 degree angle corners with the only stop sign tieing on S .W. Murdock Street and S .W. 97th Ave- nue . It should also be noted that the driveway into Twality Junior High would be the extension of S .W . Murdock Street . The staff h?.s •eceived numerous complaints during the investi- gation of this subdivision concerning the confusing situation where many peiple have assumed that the driveway was t,i exten- sion of S .W. Murdock Street , rather than making the 90 degree corner on S . W . 97th Avenue . On January 4 , 1977 Planning Com- mission considered an alternative to the pre:ient street sys- tem and rejected any realignment proposal . 5 . Tri-Met b-.is service is available to the site . 6 . The lotting pattern as proposed envisions a continuation of S ,W. Pemb.rook through the site to connect with S .W . 97th Ave- nue . This proposal conforms with the Tigard Community Plan in that dead ,ending the street would exceed the 400 ft . cul-de- sac limitation specified in the Plan . The proposal also will help to more evenly distribute vehicular traffic through the neighbor, l and with the addition of sidewalks along both sides of , J. . Pembrook extended, thus increasing pedestrian access to Twality Junior High and Templeton Elementary School for the children living to the west of the school site . The proposed design of the street incorporates a small curve in the eastern end of the street . This will help to reduce visibility down Pembrook from S .W, 97th Avenue and reduce speed on S .W. Pembrook, thus maintaining the quiet atmosphere of the adjacent residences . 7 . Tax Lots 7 and 8 lack the minimum 7 , 500 sq . ft . requirement of the R-7 zone . 8 . Frei access for Lot 9 is a potential. hazard . The best point for access would appear at the northern edge of the property or with a combination of access for Lots 8 and 9. S .W . 97,,h Avenue and S .W. Murdock Street are not constructed to city standards . A half-street improvement along the peri- meter of the property would bring these up to city standards . 11 . S .W. Murdock Street lacks the necessary right-of-way at the western edge of the unnumbered lot . A 5 ft . dedication in this area would satisfy the right-of-way requirements of the Tigard Community Plan and the Tigard Municipal Code . III . (c) Mayor volunteered to establish committee. Pembrook and 97th Ave. Planning Director advised Council that the Planning Commission, on Feb. 1st, approved a variance for a 670 foot long cul-de-:ac shown on the preliminary plat. 3 - City Council Minutes - Special Meeting/Study Session - February 7, 1977 Director stated City Street Code does not allow dead end streets over 600 foot limit. Director further stated Tualatin Rural Fire District supports the City Street Code. Discussion by Council and staff followed. Legal Counsel advised that there is a 10 day period - from time of approval to appeal decision. Coancil took no action regarding matter. (c) Councilman Cook advised Council a number of people, in the Ames Subdivision area expressed interest in annexatirg to the City.
