The procedure now in effect .is very cumbersome from the developer' s point of view: we begin the process of getting our contractors paid by receiving bills around the first of a month for work performed the previous month. We must then verify the work done per the billings and submit a request for release of funds to your section of the City based on the billings. In the meantime we prepare disbursement requests for our lender also based on the billings. I assume the City is at the same time making an inspection of the work. Once your section of the City has verified the amount of ;cork done and hence an amount to be released from the City' s guarantee, the request must be submiLted for. City Council approval. It 4s this last step we would like to see eliminated. The entire process up to submitting the request for re- lease to the City Council would take approximately one week, d ieasondble amount of Lime. In order to make the Council 's schedul.:!d meeting on the second Monday of the month, we would need to be sub- mitting our request to the engineering section at least eight to ten days prior to the scheduled meeting not counting weekends. Most months that schedule would be very hard to meet . And that schedule only applies if nothing goes wrong. If, for some reason, we were not put on the second Monday Council agenda, we would have to wait another two weeks for approval. All this would be of no concern if the contractor did not need to be paid, at the very latest, by the fifteenth of the month. The contractor needs to be paid by then because a large portion of his cost is in materials he must purchase and pay for by the fifteenth. If not paid by then, he loses discounts on the materials billings. Those discounts are taken into account also when he makes his bid for the work. I am sure the City Council had reasons for setting up the pro- cedure in this way, but as I have pointed out in previous conversa- tions with you, no other jurisdiction we have been doing develop- ment work in has required elected officials to approve the requests for release. Most currently we are doing work in Tualatin, Beaverton, Lake Oswego, and Washington County. I am told that Washington County did follow this procedu--e until recently, but has since changed. If you are not able to begin actions to change this Ordinance, that is, if it requires some action on our part, please let me know at your earliest convenience. W I T N E S S E T H WHEREAS, Petitioner has applied to the City for approval for filing in Washington County, a subdivision plat known as BRITTANY ,SQUARE NO_ 2 Willamette Meridian, Washington County, Oregon; and WHEREAS, the City has approved and adopted the standard specifications for Public Works construction by APWA Oregon Chapter and the Unified Sewerage specifications for the sanitary sewers prepared by professional engineers for subdivision development ; and WHEREAS, the public improvements required to be constructed or placed in Petitioner's development are incomplete, but Petitioner has nonetheless requested the City to permit progressive occupancy and use of property in the subdivision, and the parties desire hereby to protect the public interest generally and prospective purchasers of lots in said subdivision by legally enforceable assurances that the public improvements will be installed as required and completed within the time hereinafter set forth. NOW, THEREFORE, in consideration of the foregoing premises and the covenants and agreements to be kept and performed by the Petitioner and its sureties, IT IS HEREBY AGREED AS FOLLOWS: (1) Petitioner s:iall proceed with the development, with the intent and purpose to complete all public improvements except sidewalks and street trees of said subdivision not later than two (2) years from the date of this agreement , and Petitioner is hereby bound to comply with all subdivision standards as set forth in said Subdivision Ordinance and the standard specification adopted by the City of li.gard, or as may be otherwise approved by the Public Works Department and to use only such material and to follow such designs as may be required to conform thereto. (2) To assure compliance with the City's requirements and the provisions hereof, Petitioner tenders herewith to the City a surety bond in form approved by the City, with liability in the amount of $_1.25.500.00 a copy whereof hereto attached and by this reference made a part hereof. (3) In the event that Petitioner shall fail, neglect or refuse to proceed with the work in an orderly and progressive manner to assure completion within the time_ limits, upon ten (10) days notice by the City to Petitioner and Petitioner's sureties, and such default and failure to proceed continuing thereafter, the City may at its option proceed to have the work completed and charge the costs thereof against Petitioner and Petitioner's sureties and in the event same be not paid, to bring an action on the said bond to recover the amount thereof. In the event such action be brought , Petitioner and Petitioner 's sureties promise and agree to pay, in addition to the amounts accruing and allowable, such sum as the court shall adjudge reasonable aF attorney's fees and costs incurred by the City, both in the Trial Court and Appellate Court , if any, or the City may, at its option, bring proceedings to enforce against the Petitioner and/or Petitioner's sureties specific performance of the contract and compliance with the subdivision standards and ordinances of the City of Tigard, and in such event, in like manner, the City shall be entitled to recover such sum as the court shall adjudge reasonable as and for the City's attorney's fees and costs, both in the Trial Court and Appellate Court , if any. (4) Petitioner, concurrent with the execution hereof, has deposited with the City an amount estimated to equal rental and maintenance fees with respect to the street lighting facilities within the subdivision, according to Portland General Electric_ Schedule #91, Option "9", together with a further sum equal to the estimated cost of providing electrical energy to energize the street lighting facilities for a period of two (2) years from the date of initial energizing of said lights. Said amount being $ 730.08 (5) The City agrees to make and provide periodic and final inspections which in the City's interest are desirable to assure compliance herewith, in consideration whereof the Petitioner has paid prescribed inspections fees.* (6) The City agrees to install street identification and traffic signs within the said subdivision, in consideration of payment in the amount of $ 281.00 (7) At such time as all public improvements except sidewalks and street trees within the subdivision have been completed in accordance with the City's requirements , Petitioner shall notify the City of the readiness for inspection and upon certification by the Department of Public Works that the requirements of the City have been met, the Petitioner will .submit to the City a good and sufficient maintenance bond if not already provided with the performance bond, form approved by the City, in the sum of t__25,100.pQ_ to provide for correction of any defective work or maintenance becoming apparent or arising within one (1 ) year after tentative acceptance of the public improvements by the City. Upon receipt of certification by the Department of Public Works, that all requirements have been met, and a One Year Maintenance Bond, the City Council agrees to tentatively accept the public improvements subject to the requirements for correction of deficiencies and maintenance for a period of one year as hereinabove set forth. (8) That in addition to or supplementary of the requirements of the City's Subdivision Ordinance and the provisions hereof, Petitioner binds itself to conform to the following requirements , scheduling and limitations: *Project Fee $_3, 77,'.uU Sewer Fee $ 340.00 -2- y (a) None of the lots of Petitioner's subdivision as described may be occupied for residential purposes until an occupancy permit is issued under authority of the City and no occupancy permit shall be issued prior to the acceptance of tl►e subdivision and to the time that the sidewalk paralleling the street for each developed lot proposed to be occupied, is installed as a part of the development; provided that all sidewalks as required by the plans and subdivision code shall be installed throughout said subdivision not later than 3 years from the date of this Subdivision Improvement Contract. (b) All landscaping trees on that portion of each lot between the public sidewalks and the curb (parking area) as required, shall be planted and in place prior to final inspection and issuance of occupancy permit for each such lot in the subdivision. Provided that final inspection and applicant for occupancy permit occurs within any calendar month from October to April of any year, such plantings may be deferred until the next following growing season. In any event, all landscaping and trees in all areas shall be planted and in place within the entire subdivision within three (3) years from the date of this subdivision improvement contract. (c) After tentative City acceptance of the public improvements , the Petitioner agrees to place a one (1) inch asphaltic concrete Class "C" overlay on all roads within the development; placement scheduling to be approved by, the City. (d) Compliance with all terms and provisions specified theretofor said subdivision development by the Council and the Planning Commission of the City of Tigard, Oregon, in regard to variances allowed from the subdivision ordinance, conditions specified by the zone use classification and, also, on the approved' plat(s) and plans(s). (e) Petitioner agrees to provide for correction of any defective work and/or maintenance becoming apparent or arising during the guarantee period as hereinabove set forth. (9) At such time as all publi,: improvements have been completed in accordance with the City's requirements, Petitioner shall notify the City of the readiness for final inspection and upon certification by the Department of Public Works that all requirements of the City have been met, the Council agrees to accept said improvements for operation and maintenance responsibility, thereinregard , and release the Petitioner's guarantee bond. (10) The parties hereto hereby adopt the form of performance bond, copy whereof is hereto attached and by reference made a part hereof, and Petitioner agrees to cause to have said bond executed and filed with the City concurrently with the execution of this agreement at or prior to the time this agreement is executed on behalf of the City. My understanding is that Mr. Krueger's development was approved May 20, 1980, by the Tigard City Council . There was no city requirement to improve SW 135th Avenue, which is a county road. Our records do not indicate that Washington County formally required any improvements be made to SW 135th Avenue. At that time, the Urban Growth Management Policies had not been adopted. Because of the past approval , this Department has no objections to issuance of building permits for Winterlake development. However, we will require that approval of future developments that access SW 135th Avenue either directly or indirectly be conditioned to assure the improvement of SW 135th Avenue. One way to achieve this is through the successful formation of the on-going local improvement district (LID) proposal . Lacking these assurances , we will likely not permit future access to SW 135th Avenue. We appreciate Mr. Krueger's and the City of Tigard's support of the LID proposal and hope to proceed to ,joint public hearings on the LID in late June. Oregon. stated the zone change planned development had been i approved by City Council by Ordinance 80-56. He continued that the biggest problem with this development was its size. Originally. City Council has requested that 3.8 acres of land be dedicated for a parks now start to requesting the park to be - developed. They had expected to install water and sower with Phase I. which consists of 26 lots. However, park improvements could increase cost to as much as $88.000.00. He did not real this is what the City Council had intended and requested that the Planning Commission delete this condition. or for the requirement to be placed on Phase II an Phase I does not come near the park. He requested that Condition Number One be changed from building permits to occupancy permits. Streets would be developed with Phase II along with the sewer. This way construction could be accomplished but would allow time for warmer weather to pour concrete. Oregon, stated he was the owner of the property and had spent considerable time to get the property annexed and zoned into the City. During this whole process, nothing was said about improving the park. He felt this was an unfair burden to place on the developer. especially because of the economic conditions. CROSS EXAMINATION AND REBUTTAL e Discussion followed between Commissioners, applicant and staff as to which lots were included in Phase I of the development, what was expected as far as development of the park. what was expected to be completed as far as public improvements before issuing building permits, what was City Council's intent as Par as dedication and development of park area. and difficulty of bonding for such a large development. e Commissioner Moen questioned it the multi-family portion would be coming bet'-3re thio Commission. Staff responded that the multi-family portion would be handled through the Site Design Review Process, which the Director or (Planning and Development makes approval. e Commissioner Speaker questioned it there wasn't a park development charge that the developer had to pay for the development or parks. Director of Planning 6 Development Monahan responded that there was, however, the Cit;j did not have enough funds for development of parks. e Commissioner Spanker questioned the applicant when he would be constructing Phare II. The applicant stated that construction for Phase I would happen in the spring and Phase iI would be the end of nest year, but mare than likely the following spring. He stated previous developers were not expected to complete full street improvement in Phase II of the development prior to construction of Phase I. He agreed with the applicant that bonding for public improvements would be difficult. He did fool that grading the park area would be appropriate. • John Morris. 11900 S.W. Morning Hill. Tigard, questioned if 130th Street was included to be improved with this development. Discussion followed regarding how much of 130th would be improved. Mr. Morris was concerned with the amount of congestion on 130th Street to Scholls Perry Road. • Mr. Kruger stated that 130th was included in the LID study along with 135th, Walnut. Scholls Perry. and Murray Road. PUIBLIC HEARING CLOSED PLANNING COMMISSION DISCUSSION AND ACTION • Commissioner Bonn questioned if there were going to be additional lots. The applicant responded there would only be minor changes, such as adjustment of side lot lines. There would be no increases. e Commissioner Bonn felt there could be some kind of trade off for park improvement, basic grading and seeding. Park improvements are to be done when the development is 75% completed. • There was further discussion regarding bonded and park improvements. • Commissioner Leverett had problems with the improvement being done in one fatal swoop. He favored grading and seeding the park area. It did bother him if the City Council intended one thing to happen and they did another. • Commissioner Moen stated in the past public improvements were completed in phases. Park improvements were being requested by staff to be bonded. He didn't feel the commission was in a position to decide what the intent of the City Council was. The applicant has the right to appeal. He suggested the staff and applicant get together to seo what the Master Park Plan calls for. He questioned if the Planning Commission would be mooing Phase II. Staff stated they would not because of the Site Design Review process. • President Tepedino commented when a development moves forward the developer takes risk going through the process, with the burden on the developer. He Celt there was a lack of standards as to what a park is. He was concerned with what is the developer's requirements. He Celt this was the Park Board's problem. Staff confirmed it was correct. The applicant stated all lots would be approximately 5.000 square Peet. e Commissioner speaker moved and Commissioner Leverett seconded to approve Subdivision S 6-82 based on staff findings and recommendations with modification to conditions a■ follows: (discussion followed regarding appropriate changes in conditions) CONDITIONS: 1. Public improvements for each phase shall be constructed prior to the issuance or any occupancy permits. 2. A dedication document including a legal description shall be recorded with Washington County for the 3.4 acre park land. The dedication document will be reviewed and approved by the City prior to recording. 3. The developer shall submit an application for site design review for Phase II prior to issuance of any Buildings Permits on Phase II. 4. The applicant shall submit a plan for park improvements prior to / issuance or any building permits on Phase II. The park plan shall be approved by the Director of Planning and Development in accordance with presently established park standards. In addition, all park Improvements ■hall be completed or bonded for 100% or the cost thereof prior to issuance or any building permits on Phase II. Motion carried six to two by Commissioners present.
