Box 23397 Tigard, OR 97223 Re ; Enforcement of Subdivision Bonds I'lear Mr. Davies: This office has reviewed the subdivision bonds for the Barbee Court Subdivision, the Exodus Subdivision and the Anton Park Subdivisiorl. It is our opinion that the subdivision bonds for Barbee Court and Exodus may not be enforced by the City. This is because there is a 6-year statute of limitations on actions for contracts. The time period for enforcing the Barbee Court bond expired no later than February 9, 1987 . The time period for enforcing the Exodus Subdivision bond expired no later than October 27, 1987. Therefore, the City is barred from bringing an action to enforce these bonds. The City may enforce the bond for the Anton Park Subdivision. The statute of limitations will not run on this bond until April 15, 1994 . However, I understand that the bank has released the performance bond originally provided to Custom Homes by Dave, Inc. Because the time period for enforcing the bond for Anton Park Subdivision has not yet run, the City may pursue this matter. The City may pursue either Anton Park 's developer or the surety, Washington Federal Savings Bank. The subdivider, Custom Homes by Dave, Inc. , is not currently registered with the Construction Contractors ' Board (but it i.3 still an active corporation) . As to the bank, the performance bond provided that the hold-back funds were to be released to Custom Homes by Dave, Inc. only when "the City of Tigard has provided certification acknowledging completion of any or all work pursuant to the above itemized schedule of Lnpro• ments. " The City may be able to bring an action against *:,e bank for negligently releasing the funds. If the City decides to pursue an action against either or both parties in this matter, I would recommend that we first contact the developer to see if we can persuade him to install the improvements. Failing that, we would have to proceed against the corporation. As to the bank, I would recommend contacting them first and investigating why they released the hold- back funds. As I understand it, the work which is in question is a one inch (1") overlay and "any items related to the overlay that have deteriorated. The original bond was posted on February 1, maintenance bond was posted on January 28, 1981 and the work was 1980 the 81 accepted by the City Of Tigard on February 1 19an Although the acceptance may have been conditioned on The Tiburon Company completing the over work, there can be no dispute that thn work at the time of the acceptance was substantially complete. The statute of limitations applicable to surety bonds is six years. ORS 12 . 08J(1) . There is also an ultimate statute of repose which. provides that any action arising from the construction, alteration or repair of any improvement "shall be commenced within ten years from substantial completion Of such construction, alteration or repair of the improvement to real Mr. Christopher R. The statute defines substantial completion as "the date when the contractee accepts in writing the construction, alteration or repair of the improvement to real property or any designated portion thereof as having reached the state of completion when it may be used or occupied for its intended purposes. " ORS 12 . 135 (2) . Accordingly, any claim that the City of Tigard might have had against Industrial Indemnity is now time barred. If you disagree with our reasoning, we would appreciate an explanation on why the City's claim is not now time barred. This negative impact can be reduced in some cases and eliminated in others by reducing the 2 : 1 slope to 111: 1 slope. The existing house on the easterly side of S.W. Greenburg Road at SW 92nd Court has a concrete sidewalk and brick paved patio which would be under- cut and require removal if the present 2: 1 slope is maintained. By re- ducing the slope to 1'x: 1 the sidewalk and brick paved patio would not be disturbed. The existing house on the westerly side of S.W. Greenburg Road and S.W. 92nd Court has trees , shrubs, and a grape arbor which would have to be removed by excavating at the present 2. 1 slope. The grape arbor and some shrubs would be saved by reducing the slope to 1'2: 1. We request you to review this matter and agree with our recommendation that the slopes be reduced to Ilz: l along the sideyards of the existing house at S.W. The location is approximately 78 feet easterly from the east line of S,1 92nd Ave. A nail and red marking located about 7.2 feet southerly from the north line of Greenburg Rd. are "b 7,11I" and are referenced b- a hub and tack 6' north. A lath guard stake is marked "Strm. P,iH. - C 2.90 In. " I discussed this matter with a nentleman in the City engineering Division on Friday, 4uly 18. He was unable to find an,,, plan which indicated a manhole at the described location. However, the t ,-pe of guard stale seems to tie it to the development now underwa$ south of Greenburg; Rd, concern with the possible construction_ is that the roof drains from my property enter the storm sewer about 6' east of the proposed center of manhole. The drain was placed about ^0 tears ago (before Tigard as a city) and was held at an elevation below the house basement. This allowed any dr._Xinage at basement floor level to go into the storm system instead of the sewer s;rstem. :hen the bic:,cle path and storm drain was built the City inspector had the new drain connected to the existing roof drain, It seems to be working satisfactorily. If the proposed manhole construction interfupts the present flow, flooding of the basement and extensive damage will result. A sample truckload of this material was inspected by me and Mr. Bob Thompson of your office on July 14, 1980. The material appeared to be suitable for use as trench backfill . Wilsey & Ham will continue to review the suitability of material being delivered to ensure that trench backfill is done properly. I have notified Mr. McLaughlin that several in-place density tests in the trench areas will be required to satisfy all parties that adequate compaction of trenches has been obtained. These density tests will be done at Random locations and the results will he made available to the City. On the basis of an on-site review of the proposed material , and requirements imposed for in-place density tests of trench backill , we recommend approval of the use of the "2-inch trench gravel " for trench backfill at Barbee Court subdivision. Code to subdivide a 2.88 acre parcel into fifteen lots in a R-5 "Single Family" zone. Previous Action: On August 27, 1979 the City Council approved the zone change on the subject site from City R-7 to City R-5. 1. Findings of Fact: 1. The subject site is presently zoned R-5 "Single Family Residential" (5,000 sq. ft. lots) and is designated the same on the NPO 412 Plan. 2. The applicant is requesting preliminary plat approval in accordance with Section 17.16.100 of the Tigard Municipal Code. 3. Applicable policies of the NPO 412 Plan for residential. development are as follows: "Public Improvements" - Policies 2 and 3 (page 13) "Single Family Character for the Area" - Policy 6 (pa`e 16) 4. The topography of the site slopes from north to south at an approximate 5% grade. There are single family units on lots 2800 and 25,10 fronting SW Greenburg Road with vacant area to the :nuth. Traffic circulation for the site will be SW Greenburg Road fronting on the north. In the future an extension of a street created by this subdivision will extend out to SW 95th through the salvage yard. The intersection of the internal street to SW Greenburg Road is at a 900 angle and aligns with SW 92nd creating a four way intersection. SW Greenburg Road is designated a collector street. It is in substandard condition having inadequate paving width with no curbs on sidewalks. The proposed internal streets have fifty feet of right-of-way with 34 feet of paving and a cul-de-sac. Il . Conclusionary Findings: 1. The applicant's proposal is in keeping with the staricl.rd subdivision ordinance and density of the Tigard Municipal Code. 2. SW Greenburg Road needs improvements to collector street standard with a stop sign at the intersection of the internal street and Greenburg Road. 3. Sewer and water service is available. Ill.
