Background A conditional use approval (CU 4-83) was granted on February 2, 1984 by the Hearings Officer to allow a mini-mart/service station subject to the followi►,g :onditions: 1. The applicant shall apply for a sign permit and a City of Tigard Business License. 2. The building shall be inspected by the City's Building Inspector and meet all Uniform Building Code and Fire, Life and Safety requirements for occupancy. 3. Vicinity Information Land to the north is zoned I-L (Light Industrial) and is vacant. Property to the south and east is zoned I-L and is occupied by the Oregon Basiness Park. The area to the west is zoned I-P (Industrial Park) and is vacant. 4. 8i.te Information. The property contains a gas station with access and egress drives onto 72nd Avenue and Carmen Drive. The applicant intends to remodel the existi:ig service station to include a mini-mart. The service station/mini-mart building will be approximately 1300 square feet. in addition, there will be one island in front containing four pumps and a secor,d island south of the building with one pump. Ten parking spaces are proposed along the eastern side of the property. A lawn area is proposed near the corner of 72nd and Carmen. B. APPLICABLE PLANNING POLICIES The relevant sections of the Code for this request are the 1-L zone (18.70, Additional. Yard Area (18.46) , Landscaping and Screening (18.100) , Visual Clearance Areas (18. 102) , Off-Street Parking and Loading (18.106) , Access and Egress (18.108) , and Signs (18.114). The proposal is in conformance with Section 18.70. Adequate setbacks, as required by the I-L zone and Section 18.96.020 and Section 18.102, are provided with the proposal. Sections 18. 100.030 and .035 require the plant-ing of street trees for all development projects which have more than 100 feet of street frontage. The site plan submitted shows a new lawn area adjacent to the street corner and several planter boxes. The applicant should submit a revised site plan indicating the type and location of the street trees. The Code requires four. PaL&jUL svaces and ten are proposed. A vehicle aisle is intended between the back of the building and the packing spaces. The width of this accessway is 20 feet, however, a 24-foot width is required for two-way traffic. Since there is more than sufficient parking, the most northerly space could be eliminated to provide thL necessary aisle width. Section 18.106.060 requires service stations to provide a vehicular reservoir of three . nates for each gas pump. AGENCY C0MMENTS The Tualatin Rural Fire Protection District has no objection to the proposal. The Engineering Division indicates that the existing driveway on Upper Boones Ferry Road should be replaced with a concrete driveway apron, 30 feet in width. Also, a 5-foot wide sidewalk should be provided along the entire street frontage, including a wheel chair ramp for the pedestrian crossing at the intersection. RECOMMENDATION Planning sta ft recommends approval if SDR 16-83 subject to the following conditions : 1. Plans and location for signs shall be reviewed and approved by the Planning Director prior to the issuance of any building permits. 2. The northern parking space shall be moved or eliminated to provide an aisle width of at least 24 feet. 3. The applicant shall obtain a Street Opening hermit from the City Engineering Division for the sidewalk and driveway imp,-ovements noted in Section C. above. To receive this permit, the applicant must submit plans for the improvement along with a 100% bor,d. 4. Information regarding the type and location of street trees shall be provided for review and approval by the Planning Director. The applicable guidelines in the Code are enclosed.
