NOTICE OF DECISION
�i1'IE DEVELOPMENT REVIEW SUR 10-84
APPLICATION- Request by Green Valley Development for Site Development Review
approval to construct. a 12,640 square foot industrial building and related
facilities on property zcned 1-P ( industrial Park) located at !+460 SW Tigard
Ave. , 'ligard (Wash. Co. Tax Map 251 23D, Tax Lots 1000 and 1800).
DECISION: Notice is hereby given that the Planning Director for the City of
Tigard as APPROVED the above described application subject to cert.ain
conditions. The findings and conclusions on which the Director based his
decision are as noted below.
A. FINDING OF FACT
1. Background
A Site Development Review application (SUR 25-78) was approved
allowing the construction of a warehouse building on the property
immediately north of the subject property. Conditional Use
approvals were granted (CU 25-78 and CU 9-79) to allow additional
storage spare and activities conducted in the building. Sensitive
Lands Permit (SL 2-84) was granted in March, 1984 to allow
excavation and till work within the floodplain to accommodate the
building and parking lot proposed in this application. Approval
was subject to the following conditions:
1. Additional information including the location and affect on
the U.S.A. sewerline .long the Creek; the location of the
flordway on the property; and complete topographic and cross
section data documenting the amount of excavation and
filling involved shall be submitted to the Engineering
Division for review and approval prior to the commencement
of excavation and filling.
2. All unused lands remaining the thr 100-bear floodplain shall
be dedicated to the City prior to issuance of any permits.
The dedication document shall be recorded with Washington
county after i.t is approved by the City.
3. A Site Development Review application must be reviewed and
approved by the Planning Department prior to construction
of the proposed building.
4. If required by the State of Oregon or the Army Corps of
Engineers, a joint application to the Division of State
Lands and the U.S. Corps of Engineers shall be approved
prior to any excavation or filling.

2. Vicinity Information
The zoning to the northwest and southeast is also I•-P. Tigard
Street and Oregon Electric R.R. are northeast and the west side of
Fanno Greek is zoned R-12 (Residential, 12 units/acre).
3. Site Information
This property is undeveloped and located between Tigard Street and
Fanno Creek. The Fanno Creek floodplain is designated on the
Comprehensive Plan for open spare use.
4. Proposal Description
The applicant proposes to develop the property with a 12,640
square foot industrial building with a 39 space parking area.
Access to S.W. Tigard Street will be furnished by the existing
driveway which services the building and parking lot to the
north. Landscaping will be provided in front of the building and
around the perimeter of the parking area in the rear.
5. Agency Comments
The Engineering Division has the following comments:
a. Tigard Street is a collector route which requires a 60-foot
wide right-of-way. The applicant should dedicate additional
right-of-way from centerline to meet the 30-foot standard.
b. 4alf-street improvements should be provided.
C. A joint access agreement should be provided because the
subject property and the parcel to the north share a common
access and parking and loading area.
d„ Connection with the public sanitary sewer and a storm
drainage outfall to Fanno Creek is necessary.
e. Prior to issuing building permits, additional information
should be submitted regarding the location of utilitieF that
are within or adjacent to the property.
f. Depending upon the type of trucks that will be present on
the site, there may not be sufficient maneuvering space
between the proposed building and the building to the
north. Relevant information nhould be submitted to the City
Engineer for review and approval as per Section 18. 106.090
of the Code.
The Building Inspector and NFU # 2 have no objection to the
proposal.
Comments have not been received from the lualatin Rural Fire
Protection District.

B. ANALYSIS AND CONCLUSION
The proposed use is consistent with the intent of the 1-P zone and the
setback and lot dimension requirements have also been met. Including
the land in the floodplain that will be dedicated as a condition of the
Sensitive Land Permit (SL 2-84) , the development will comply with the
maximum lot coverage requirement of 75 percent.
'lhe lane ;caping to be provided is adequate except for the west end of
the property. Because of the adjacent R-12 zone, a 20-foot wide
landscaped buffer with screening (e.g. fence or hedge) is required.
However, in the floodplain area fences or hedges are not advisable and
additional trees along the western property line would be a preferable
alternative. Section 18. 100.080 A.4. f. allows for alternative methods
to achieve the equivalent buffering effect.
Parking standards are met except for the entrance to the rear parking
area which is 19 feet wide instead of 2.4 feet and ;he southernmost
parking space in front does not have adequate room for backing out. One
handicapped parking space must be provided.
This development will eliminate a significant number of parking spaces
which are used by the building to the north. In order to determine the
total number of parking spaces required, the applicant must submit the
total number of employees for the largest shift for both buildings.
The conditions of approval for SL 2-84 and the Engineering Division
comments noted above should be followed.
C. DECISION
The Planning Director approves SDR 10-84 subject to the tr.11owing
conditions:
1. the conditions of approval for SL 2-84 shall be met prior to the
issuance of building permits.
2. Additional. right-of-way shall be dedicated to the City to meet the
standard width of 30 feet from centerline. Legal descriptions anti
deeds shall be approved by the Engineering Division prior to
recordation with Washington County. The necessary documents shall
be recorded prior to issuance of building permits.
3. The location of existing utility lines within and adjacent to the
property shall be submitted in conjunction with the information
necessary for the Engineering Division noted in 4. , 5. , and 6.
below.
4. Connection with public sanitary sewer and n storm drain outtall to
Fanno Creek will be required.

3. Standard half-street improvements including sidewalks, curbs,
street lights, and driveway aprons shall be provided along the
Tigard Street frontage.
6. Nine (9) sets of plan-profile public improvement construction
plans and one (1) itemized construction cost estimate, stamped by
a registered civil engineer, detailing all proposed public
improvement shall be submitted to the City's Engineering Division
for review.
7. Construction of propoced public improvements shall not commence
until after the Engineering Division has issued approved public
improvement plans (the Division will require posting of a 1.00%
perormance bond) , the payment of a permit fee and a sign
installation/streetlight deposit. Also, the execution of a street
opening permit or construction compliance agreement shall occur
prior to, or concurrently with the issuance of approved public
improvement plans.
8. A reciprocal easement or other suitable agreement which will allow
joint access and maintenance rights for the subject property and
parcel to th- north shall be reviewed and approved by the Planning;
Director and recorded with Washington County prior to issuing
building pe�riits.
9. Prior to issuing building permits, the following information and
site plan revisions shall be submitted for the Planning Director's
approval :
a. All driveways shall be a minimum of 24 feet in width.
b. Additional maneuvering space shall be provided for the
southern parking space in front.
C. One handicapp^_d parking space shall be indicated as close to
R building entrance as possible.
d. Based upon the number of employees f,3r the proposed building
and the building to the north, adequate parking spaces will
be available.
e. The proposed loading area shared by the two buildings shall
be reviewed by the City Engineer as per Section 18. 106.090
of the Community Development Code. The applicant shall
submit information to the types of vehicles using this area
and the estimated frequency of use.
f. The landscaping plan shall be amended to show addition
lanc'scaped buffering along the west property ii.ne.
10. All landscaping material shall be installed before an occupany
permit is issued..

11. This approval is valid for the period of one year from the final
decision date noted below.
