Magnuson: Please refer to the utility plans submitted to this office for the construction of Tech Center Two at Tigard adjacent to Southern Pacific Transportation Company right.-of-way near Mile- post 750 .0 . At the north end of the project you show extending an exist- ing 24 inch storm drain and connecting a new 15 inch :Line. This will then outlet to an 18 inch pipe under the railroad. We be- lieve this pipe is at present overtaxed due to unaLthorized use from storm sewers in the street and other recent development to the north . At the south end of the project you show a 15 inch pipe ot;t- let: directly on to railroad property which you say will connect to art existing; ditch . In fact there is no drainage ditch at this point , only a low area that would most likely hold water and flood during a heavy s•_orm. Southern Pacific Transportation Company has had a long stand- ing policy of not accepting additional anJ/oi accelerated storm drainage from adjoining property owners . Our railroad side ditches and cross drain culverts are designed only for draining our own roadbed. It is not the, railroad' s responsibility to accept the additional burden and liability of anothers drainage, therefore these Plans are unacceptable . If your drainige must flow toward the railroad' s right-of- way, we suggest you design a system to carry it in a new struc- ture under the tracks . This will have to be encased and bored under track and meet all other railroad specifications . If your plans meet with our approval we will prepare an agreement where the structure will be owned and maintained by otrners . Box 23397 Tigard, OR 9722.3 CITY OF TIGARD NOTICE OF AMENDED DECISION SITE DEVELOPMENT REVIEW SDR 13--86 APPLICATION: Request by Western International Properties to allow the construction of two industrial buildings totaling 68,800 square feet and related facilities on property zoned T-L (Light Industrial) and I--H (Heavy Industrial) and located on the south side of Tech Center Drive adjacent to the Southern Pacific Railroad (WCTM 2S1 IDC, TL. 1100 9part) and 4000) . DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVr.D the above described amended application subject to certain conditions . The findings and conclusions on which the Director based his decision are as rioted below. A. FINDING OF FACT 1 Background Lot Line Adjustment (M 16-85) was approved and recorded which enlarged the subject property. The former eastern property line coincided with the ba,irdary between the .T.-L. (Light Industrial) and I-H (Heavy Industrial) zones . "'ince the zone designations were not changed, the eastern 256 fe -t of the property is zoned I-H and the remainder is zoned -L. The Planning Director released a decision which did not. reflect City policy which requires nearby property owners to agree to participate in a local improvement district (LID) to construct a railroad crossino for Tech Center Drive, The conditions of approval have beHn modified to obligate the applic-Ani: to participate in a future LID. 2 . V:tc. inity Information The properties on the north side of Tech Center Drive are developed and zoned J.--P (Industrial Park) . The area to the south and ekst is zoned I-h and the land west of the railroad tracks is zoned I-L. Tech Center Drive is designated as a ninor collector stree+. and it is intended to cross the tracks and provide a connection to Bonita Road and possible future. street extensions to the north leading to Hunziker Street and Hall Blvd. 3 , Site Information and Proposal Description The property is undeveloped and is covered primarily by tall grass. The applicant proposes to grade the site and construct two industrial buildings totaling 66,810 square fent. The two buildings will share a common central loading area with parking located around the huilding ;perimeter. Storm drainage will be directed toward the railroad right-of-way to the west. NOTICE OF DECISION ­ SDR 13-86 - PAGE 1 4. Agency and NPO Comnn!nts The Engineering Divi-tion has the following comments: a. The public storm sewer line crossing the northwest corner of the property must be within a publi+. easement. As a condition of approval for M16--95, the majority of this easement was dedicated. Confirmation of the recording of this easament should be provided arid any remaining portion of this line without an easement should have a public easement recorded as a condition of approval for this development. Written verification shall be provided indicating that Southern Pacific Railroad approves of any necessary drainage improvements to be made within the railroad right-of--way . C. The method for disposing of stormwater runoff has been determined previously for the Tech Center Drive area and therefore a Sensitive Lands review is not necessary for the Proposed public storm sewor line which crosses the subject: property . The Building Inspection Division and the Tigard Wate- Di ,trict have no objections to the request. The Tualatin Rural Fire Protection District indicaes that all portions of the building must by within 2.50 feet of a fire hydrant. No other comments have been rezeived . B. ANALYSIS AND CONCLUSION This proposal is consistent with Community Development Code requirements related to building setback and height, maximum lot coverage, access, visual. clearance, and landscaping. Additional discussion is warranted relating to parking, storm drainage, signs, arid allowed uses. 1 . Parking The Code requires that one parking space be provided for, each 1,000 square feet of floor area for many industrial uses. Based upon the proposed size of the buildings, 56 spaces and one handicapped space are required. The applicant is proposing 276 spaces and two handicapped spaces This will allow sufficient flexibility to accommodate the few uses permitted in the I-L zone which have higher par' *ng requirements. The Code standard for parking space dimensions is 9 by 19 feet. All of the spaces shown on the site plan are 19 feet in depth and the widths vary between 9 and 9 feet. The Code permits the use of compact spaces (9-- 1/2 x 1@. feet) for 25 percent of the required number of spaces as well as any spaces provided above the required amount. Based upon the above :standards, the site plan must be NOTICE OF DECISION _. SDR 13-96 -- PAGE 2 amender+ so that a minimum of 50 spaces are a minimum of 9 feet in width wil-h the minimum width for the remainder to be 8-1/2 feet wide. A wheel atop o- equivalent is required three feet from the front of all parking zpaces located on the perimeter of the property. Also, a landscaped strip of at least three feet should be provided between the street right-of.-way line and the parking lot. These standards can be met by simply moving the curb two or three feet in from the property line and expanding the landscaped area devoted to ivy. Low landscaping material or a sidewalk can be located in the front three feet of a parking spare. Finally, the Code requires that one secure bicycle parking space be installed for every 15 required parking spaces. This project must: have five bicycle spaces with the location and design to be. approved by the Planning Director. 2. Storm Drainage The previous lot line adjustment approval required the dedication of a public: easement for the anticipated storm sewer line located in the northwest corner of the property. An easement was submitted which included most of tha necessar-y easemert area. Since the construction of the storm sewer line was not necessary until the site was developed, the dedication of the remainder of the public easement was postponed to the site development review stage. 3 . Signs The applicant intends to place one sign no-ir each driveway entrance whicF will direct traffic to the apprispriate driveway. The signs will be approximately six square feet in size per side. Given the nature of the project and the need to provide directional :.nformation at; the entrances, these signs are appropriate. A. Allowed Uses The project is a continuation of the development on the north side of the street. It should be noted that the permitted uses are not identical because of the different zoning districts which apply . The applicant should review these differences with the Planning staff. C. DECISION The Planning Director approves SDR 13-86 subject to the following conditions : 1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS.
