The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FAIT 1. Background No other land use cases have been reviewed on this property . 2. Vicinity Information The properties to the east, north and west are also zoned I-P and the land to the south is zoned R-4.5 (Residential, 4 .5 units/acre) . Single family residences are south of Tigard Street and a variety of industrial uses are situated to the east and northwest. The property is surrounded by railroad tracks to the east, Tiedeman Avenue to the northwest, and Tigard Street to the south. Tiedeman Avenue and Tigard Street are designated as major and minor collector streets respectively in the Comprehensive Plan. A bicycle lane exists along the Tigard Street frontage and one is proposed for Tiedeman Avenue, 3 . Site Information and Proposal Description The property is presently undeveloped and except for one large fir tree in the northern section of the parcel , no significant vegetation exists. The applicant proposes to construct 16,974 square foot warehouse which is situated near the railroad right-of-way . A parking and Ading area will be on the north and west sides of the structure and one driveway will. be provided for both Tiedeman Avenue and Tigard Street. Landscaping which includes earth berms, lawn and deciduous trees is proposed along the entire street frontage. The applicant has also requested to be relieved of the responsibility of providing half street improvements as a condition of development. A non-remonstrance agreement to participate in a future street improvement project is proposed in lieu of building the public facilities now. The landscaping plan should be modified to allow for improved traffic visibility at the driveway and street intersections . b. The sidewalk requirement along Tigard Street may be waived, but all other street improvements should be installed as a condition of development. C. The sidewalk along Tiedeman AvenuQ should be adjacent to the property line to allow from pedestrian-vehicle separation. d. The segment of Tiedeman Avenue is under Washington Country jurisdiction and a street opening permit: may be required from the County . The Building Inspection Office and NPU N2 have no objection to the regw�st. Tualatin Rural Fire Protection District has not commented on the application. B. ANALYSIS AND CONCLUSION The proposed development is consistent with the applicable provisions of the I-F zone related to building setbacks, height, and lot coverage. With the modifications noted below, the proposal will be in conformance with otbc- Code requirements related to access, landscaping, visual clearan,e, and street improvements . The landscaping concept is appropriate except for the trees located near the two driveways. The Engineering Division is concerned about the immature trees restricting sight clearance. Large trees with brached no lower than 8 feet could be installed near, the driveway . It is also recommended that some evergreen vegetation be incorporated to provide visual buffering for the residences to the south during the winter months. The request for waiving the installation of half street improvements has been reviewed, and eliminating the requirement for a sidewalk along the Tigard Street frontage is appropriate. Due to the presence of the railroad on the Fast side of Tigard Street, a sidewalk will be of little or no value now or in the future. the other standard half street improvement requirements should be installed as a condition of development. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS. 2. Standard half-street improvement including sidewalks, curbs, street lights, and driveway aprons shall be provided along the Tiedeman Avenue and Tigard Street frontage's to collector street standards prior to occupancy. The improvement of Tiedeman shall conform to the alignment of the plat of County Road No. 2439. 3 . The applicant shall not be obligated to install a sidewalk along the Tigard Street frontage. 4. Seven (7) sets of plan-profile public improvement construction plans and one (1) itemized construction cost estimate, stamped by a registered civil engineer, detailing all proposed public improvements shall be submitted to the City's Engineering Section for approval. . 5. Storm and sanitary sewer details shall be provided as part of the public improvement plans . 6. Construction of proposed public improvements shall not commence until after the Engineering Section has issued app;^oved public improvement plans (the Section will require posting of a 100% performance bond), the payment of a permit fee and a sign installation/streetlight deposit. Also, the execution of a street opening permit shall occur prior to, or concurrently with the issuance of approved public improvement plans. 7. A revised landscaping plan which is consistent with the visual clearance section of the Code (18 .102) shall be approved by the Planning Director. 8. Landscaping improvements shown on the approved plan shall be installed prior to occupancy. 9.
