DECISION_: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1 . Background The City recently granted partitioning approval (MLP 8--85) for the larger parcel (Tax Lot 800) . 'The applicants dropped this proposal because of conditions of approval related to the extension of 108th AvenUO. 2 . Vicinity Information All of the surrounding properties are small acreage homesites which are zoned R-4 .5. The exception to the development pattern is the Doreen Court subdivision which lies directly north of the subject property . Phis development includes nine lots in the 7,500 to 9, 100 square foot range on both side of 108th Avenue which begins at North Dakota Street and ends at the northern boundary of the subject property . 3 . Site Information and Proposal Description The larger parcel is a flag lot with 50 feet of frontage on Tigard Street. The larger parcel contains one house near the north end of the property and a house is centrally located within the smaller lot. The applicant proposes to shift the northern boundary of the small i-arcel 98 .6 feet to the north. This action will result in a 12,309 square foot reduction in the size of the larger parcel . 4 . Agency and NPO „omments The Engineering Division indicates that Tigard Street is a minor collector which requires a 60 foot wide right--of-way . The additional right-of-way dedication should be required. ANALYSIS AND CONCLUSION The proposed lot line adjustment is consistent with City standards for lot size and b-ailding setbacks . The applicant proposes to divide the property into two flag lots of 0.58 and 0,9 acres. The smaller parcel will contain the existing buildings and the larger lot is vacant. Both parcels will have a 25 foot wide access strip to Tigard Street . 4 . Agcncy and NPO Comments The F.ngineering D`.vision has the following comments : a. An extension of SW 108th Avenue to the property is not indicated ,m the City of Tigard Comprehensive Plan; but due to the lace; of north-south connecting roadways (between SW North Dakota and 5W Tigard Street) it would be in the best interest ,f the Community to extend the partial connection of SW 108th through to Tigard Street, NOTICE OF DECISION - Mi.P 8-85 -- PAGE 1 The Building Inspection Office has no objection to the proposal but it is noted that the proposed sewer easement will reduce the buildable arca within the 0,58 acre lot. B. ANALYSIS AND CONCLUSION The proposed division is consistent with the applicable standards in the Community Development Code for minimum lot size (7,500 square feet.), minimum lot width (50 feet), building setbacks and access. However, as mentioned in the comments from the Engineering Division, this proposal does not provide for the extension of 108th Avenue. When Doreen Court subdivision was platted, it was clearly the intent that it wnuld be extended to Tigard Street when development occurred to the south. The alignment of 108th Avenue suggests a street extension that would straddle the property li.ne between the subject property and the property to the east. C. DECISION The Planning Director approves MLP 8--85 subject to the following conditions-. 1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHAD BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS. 2. Standard half-street improvements including sidewalks, curbs, driveway aprons, storm drainage, and utilities shall be installed along the SW Tigard Street frontage. Said improvements along SW Tigard Street shall be built to City lncal street standards and conform to alignment: approved by the City' s Engineer 3 Seven (7) sets of plan-pr, file public improvement construction plans and one (1) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Section for approval. 4. Public mainline sanitary seo,ier plan-profile details shall be provided as part of the public improvements plans. 5. Construction of proposed public improwtments shall not commence until after the Engineering Section has issued approved public improvement plans . The Section will require posting of a 1.00% Performance Bond, the payment of a permit fee and a sign installation/streetlight fee. Also, the execution of a construction compliance agreement shall occur prior to, or concurrently with the issuance of approved public improvement plans .
