This agreement is entered into this //rl/ day of October 1989, by and between
the City of Tigard, Oregon ("City") , Gene Wyatt.
Recitals
1. ;err, Wyatt, is the owner in fee simple of certain real property located
at 10755 S.W. Tigard Street, Tigard, Oregon and as mora particularly
descries by the Washington Count_ Tax Assessor as 1S1 34D() 00300.
2. The city has determined that Mr. Wyatt must pay a $3,000 sewer
assessment fee. Mr. Wyatt has requested to pay such fee :_n
insta l l.ments.
Agreerent
Now, therefore, the parties hereto agree as follows:
1. Mr. Wyatt agree--s to pay the balance due of $3,000 over a period of five
years at nine percent interest to the City. Such amortization results
in monthly payments of $62.27. The first scxh payment will be due on
'w( l e 989, and each subsequent payment will be. due on the

- l lowing month.
2. A -late charge of $5 will beed on all
��Y3 payments not paid within 10
days of the due date. In the event that any payment beccmvs more than
30 days past due, the entire unpaid balance will become due arra payable,
and will be collected in the following manner.
The unpaid portion of the assessment and any interest accrued thereon
will be collected through procedures for delinquent as_s��sments under
ORS 223.505 and following.
In such event, City shall be entitled to an award of reasonable attorney
foes and collection costs, even if no suit or action is filed herein.
In the event a suit or action is filed, the amount of such reasonable
attorney fees shall be fixed by the eormt, or courts in which the suit
or act.icxi, including any appeal therein, is tried, heard, or decided.
4. All parties hereto have read, understand, and represent that they
voluntarily enter into this agreement and that this agreement, :-.tid any
documents referred to herein, constitute the entire agreement between
the parties.

Dear Mr. Wyatt:
It has come to the attention of the Washington County Department of Public
Health that sewage and/or waste water is discharging on the surface of the
ground because of a malfunctioning of the sewage disposal system at the
above noted address. This is in violation of Oregon Public Health Laws
and regulations governing the disposal of domestic sewage and other
household wastes.
Gerhard Matheis. Sanitarian conducted an investigation and substantiated
the violation referred to above on March 29, 1989.
You are respectfully requested to correct this public health hazard by
establishing hook-up to the public sewer available to this residence. For
information on sewer hook-up, contact City of Tigard 639-4171.
Since the above is a safety hazard as well as a Public Health Violation.
we must request correction within 30 days from the date of this letter.
Please call or write the Department of Public Heaith as soon as correction
has been accomplished.
If a satisfactory correction has not been completed in the time allotted,
we will have no choice but to refer this problem to the Department of
Environmental Quality for enfa, -ament.
