Gene Wyatt owns the lot west of the proposed private drive tract and south of proposed lot 4. He testified with questions about landscaping the excess area on the west side of the accessway tract; about rights he may have to maintain an accessory structure that is situated on a portion of the subdivision site; about preserwition of a mature cottonwood tree situated on the subdivision site; and about suggestions in the Staff Report that the applicant convey excess land from the accessu-y tract to Mr. Wyatt. 4. Mr. Harker responded that the app�icant plans to grade and seed the excess area of the accessway trac4; that the apl-1Want may be willing to consider an exchange of property; and that it appears the cottonwood tree in question is outside of the likely buildable area of lo►4 and therefore can be preserved. The City of Tigard Engineering Department has reviewed the proposal and offers the following comments: a. Streets - S.W. Tigard Street is classified as a minor collector by the City of Tigard'e Transportation Plan Map; current standards for a minor collector are: right-of-way of 60 feet, 40 feet of pavement, and 5 foot sidewalks on both sides of the road. The applicant is proposing to access the site from S-W. Tigard Street with a private drive. Currently, S.W. Tigard Street in front of the site has 20, feet of right-of-way from centerline with full street Improvements ea^ept a sidewalk; therefore the applicant should be required to dedicate 10 feet of additional right-of-way and install a sidewalk and privata street apron across the site's frontage. The private drive, as illustrated by the applicant, is 30 feet in width, with 24 feet of pavement and curbs on both sides. A sidewalk along the private drive will also need to be provided. In addition, the private drive has a standard hammerhead. b. Sanitary sewer Sanitary sewer service is available from an existin-7 line south of the site in S.W. Tigard Street. The applicant is proposing to extend the Dublic line from S.W. Tigard St. up the private dri, 7 within a public easement to serve the four proposed lets. C. Stem drainage The applicant is proposing to direct storm drainage down the private drive into the e—i.sting storm drainage system that exists in S.W. T'_gard Street. The Unified Sewerage Agency has established and the City has agreed to enforce, Resolution 90-43 Surface Water Management Regulations, requiring construction of on-site water quality facilities or fees in- lieu of their construction. Requiring surface water quality facilities on small sites would result in numerous facilities that. would becom, a maintenance burden to the City. Furthermore, the applicant has not proposed any such on-site water quality facility. Regional faclliti-ups, funded by fees-in-lieu of construction of these facilities, would provide the required treatment with improved reliability and lees maintenance.
