Specifically, the problem can be identified as inappropriate action on the part of fire district officials in waiving portions of fire regulations as promulgated by the City of Tigard. An orderly process must be established if the needs and rF!.3uirements for fire protection are to be met. ( The normal. route for an individual desiring to build is to make inquiries and/or application at both the city and water dis- trict. The planning staff of the city routes the application to the fire district (s) which, then, makes a recommendation to the city about requirements to meet the _`ire code. Concurrently and independently, I , personalty, determine the fire protection needs, in accordance with the city code, as well as regulations as established by the water district . In all cases, water district regulations are more stringeit than t ose of the city. The applicant is advised of fire protection requirements, including number and location of fire hydrants. (I do not delve into fire sprinkler requirements) . ■r 4r ■r � aa► i■r Re: Fire protection requirements for new developments Obviously, both the fire district (s) and water district must abide and comply with the fire code if there is to be any consis- tency or continuity in enforcement. This consistency is seriously interrupte,_ when one party or the other grants waivers, lessening requirements, without coordinating with the other party. As a result, two governmental agencies are placing different require- ments upon the applicant . The obvious answer is coordination . If a waiver for any reason is being considered, then a simple telephono call to the other party is deemed appropriate and the is. te discussed. Over the years, I have been able to establish this type of relationship with Gene Bi.rch.ill. New comes a situation with Assistant. Fire Marshall Rex Jeffries in which he arbitrarily makes a decision that the require- ment for a fire hydrant is not required to serve a new industrial building located at SW Tigard and Tiedeman Streets. Fie states that "While the location (of the existing fire hydrant) is not within the letter of the ordinance, it falls within the intent and is, therefore, acceptable as fire regulations apply. (See attached letter dated August 19, 1987) . Note, also, that a copy of this profound decision was not forwarded to this office. Again, there was absolutely no communication or coordination with the water dis- trict on this matter. I had previously advised the applicant that a fire hydrant was regt1ired because the existing fire hydrant was more that 250 feet from the proposed building (the distance to the rear of the building is 350 feet) , and to fight a fire in that lo_ation would require laying hose lines across two important thoroughfares; namely: Tiedeman and Tigard Streets. Tigard Water District has always had very high standards in ensuring that fire pro' -�ction requirements are met. We have spent millions of dollars to build a water system that meets those high standards. In every category, Tigard Water District excels and was instrumental in obtaining a Class 3 fire insurance rating for the fire districts. As you are aware, 39% of that rating applies to the water system. Under no circumstances will those standards by lessened by arbitrary decisions . Developers must be made to install adequate facilities to protect the public ; otherwise, in subsequent years, as deficiency surveys are conducted by the fire district (s) , the water district (not the fire district or city) gets saddled with incurring the cost of installing new fire hydrants. I Re: Fire protection requirements for new developments So, how do we correct the problem? First, rescind the waiver as granted by Rex Jeffries because, in no way, does such waiver fall within the "intent" of the fire code. Lastly, advise your subordinates to coordinate any propos^d changes in enforcement of the fire code so that all governmental bodies will be together on the issues. Please advise if you desire to discuss this issue further. Tigard Street A fire and life safety plan review was conducted on the above- captioned project for compliance with the 1989 editions of the Uniform 'iuilding Code (UBC), Uniform Mechanical. Code (UMC), and the Uniform Fire Code (UFC) as amended by Washington County Fire District's Ordinance 86-1. The plans are not approved. Correct the following items and resubmit for approval by this office. This building is being reviewed as a type V-N construction housing group 14-11 shops and B-2 office areas. 1. Exit Doors: Exit doors shall swing in the direction of exit; travel when serving any hazardous area. (UBC Sec. 3304) 2. Exterior Wall Openine,_Protection: Door located on the west Te of the :3outh shop adjacent the property line shall be 45- minute fire resistive :pelf-closing assembly. (UBC Table 5A) 3. Firefighting Water Super: Fire hydrants shall be installed within 250 of all portions of the building as accessed by emer- gency apparatus. Where juildings are provided with automatic sprinkler protection, hydrants may be placed at a distance of 500 feet from all portions of the building. (UFC Sec. 10.301 (c)) 7. Exit Door hardware: All doors shown on the drawings must be openable from the inside for immediate exit at all times without the use of a key, special knowledge or effort. (UBC Sec. 3304) 8. Exte-ior Exit Door: Hardware for the exterior doors and key- operated deadlocks may be permit..., where there Is a sign posted on or over the door, reading, '•THIS DOOR MUST REMATN UNLOCKED DURING BUSINESS HOURS" in letters not less than one inch in height on a contrasting background. (UHC Sec 3304) NOTE: This would only apply to the main entry door into the office area. 9. Firestopping: In all wood-framed wall and partitions, fire- stopping consisting of 2-inch nominally-sized lumber or other approved materials must be installed at all floor and ceiling levels. Penetrations in this prescribed firestopping to accom- modate wiring, plumbing and other similar utility runs must be packed with noncombustible materials in an approves' manner so as to prevent the passage of flame. (UBC Sec. 2516) 10. Insulation Flame Spread: The insulation, including breather, papers and vapor barriers which are not in contact with the upper surface of the ceiling and under surface of the floor, as the case may be, must have a flame spread rating of not to ex- ceed 25 and a smoke developn -�nt classification of not greater than 450 as measured on the ;teiner Tunnel Test scale referred to as UBC Standard No. 42-1. (UBC Sec. 1713) 11. Landings at Doors: There must be a floor or landing on each side of all doors. The floor or landing must not be more than one inch lower than the threshold of the doorway unless serving as access for the physically handicapped. Unless electric baseboard heat is employed, complete mechanical system plans for the 11VAC equipment and duct work must be submitted to and approved by this office prior to installation. (UMC Sec 302) 13• Mechanical Equipment Approval: All heat producing and elec- trical equipment and appliances installed in conjunction with the construction or occupancy of this project must be approved by Underwriters Laboratories, Inc. or other nationally recognized testing agency and installed in accordance with the testing agency's specifications. (UMC Sec. 502) 14. Address Required: The tenant space number must. be prominently displayed on the street front where it is readily visible to drivers and officers of responding fire apparatus and other emer- gency vehicles. (UFC Sec 10.280) 15. Fire Extinguisher Requirements: Not less than one (1 ) approved fire extinguishers with rating of not less than 2A1OB:C shall be provided for each 1 ,500 square feet of floor area or fraction thereof. The travel distance to an extinguisher from any portion of the building shall not exceed 75 feet. (UFC Standard 10-1) NOTE: Where flammable or combustible liquids are used, an addi- tional BC-rated fire extinguisher shall be installed in accordance with Uniform Fire Code Standard 10-1 or National Fire Protection Standard No. 10. 16. Approved Plans on Job Site: One set of approved plans bearing the stamps of the Tigard Building Department and this office must be maintained on the project site throughout all phases of con- struction and must be made available to building and fire inspec- tors for reference during required construction inspections. (UBC Sec. 303) 1'l. Inspections Required: Inspection and approval of construction by a representative of thij office is required: (a) prior to the cover of any new framing elements following the installation of all utility runs which will be concealed within wall and partition cavities; (b) upon completion of construction and prior to occu- pancy of the tenant space. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1 . Background This parcel was originally created through a Minor Land Partition (MLP 6-82) by Forrest Cowgill . When the partition was recorded, only two lots appeared on the assessor's tax maps. After reviewing the partition in 1980 , the original three lots were recognized as valid and the third lot was officially .reated. In 1986 a Site Development Review (SDR 19-86) was requested to allow construction of three 4500 square foot buildings to be used as general office, light manufacturing and construction services businesses. Approval with conditions was granted for SDR 19-86 but the applicant; never pursued the project. 2. Vicinity Information The zoning districts around this property are R•-4.5 (Single Family Residential, 4.5 units per acre) to the south across SW Tigard Street; R-12 (Multi-Family Residential, 12 units per acre) to the west and north across Fanno Creek; and I-P to the east and northeast. Development in the general vicinity is mixed with single family residences on both small and large lots located along SIJ Tigard and both light and heavy industrial uses occurring to the north along SW Tiedeman. West of the site and across Fanno Creek, the property is us,,d for pasture and grazi�ig. y 3 . Site Information and Proposal Description The subject property is currently vacant. Since the eastern property line follows the channel of Fanno Creek, a portion of the lot is below the 100 year floodplain. The site is completely covered with vegetation, dominated by brambles and brush interspersed around medium sized trees and several large firs . Other than proximity to Fanno Creek, no development limitations are apparent. NOTICE OF DECISION - SDR 87-10 - DON 6 MARILYN SCNAEFER - PAGE 1 W W i W W W fff the applicants are proposing to develop the property in two phases. the first phase will involve the construction of a 4641 square foot building to serve a parking lot and street cleaning business; the second phase would acid a 600 square foot building to be used as an automobile tune--up facility. 4. Agency and ^IPO Comments the Tualatin Rural Fire Protection District (TRFPD) reviewed the proposal. and stated that they saw no provisions for, fire hydrants in the proposed plans. It is thereby assumed by TRFPD that fire hydrants will be provided at least within 250' from the structure arid , if a sprinkle protection system is required, a hydrant shall be no more than 70 feet from a sprinkler, connection. General Telephone reviewed the proposal and commented that the developer must furnish a 1 -4 inch P.V.C. from the terminal room to GTE's point of access . The Engineering Division has reviewed the proposal and provided recommendations as follows: Streets: Street improvements alona the property's frontage on SW Tigard are not recommended because of the proximity of the bridge over Fanno Creek . Storm drainage: Drainage should be no problem because of the site' s direct access to Fanno Creek. Open space: Consistent with the open space plan, all the land within the 100 year floodplain should be dedicated to the public as greenway. Sanita-Ar The site can be served by either the existing 60" Fanno Cr:aek trunkline or by an existing 8" mainline with SW Tigard Street. The Building Division reviewed the proposal and have no objections to it. No other comments were received regarding this proposal. B. ANALYSTS AND CONCLUSION Both of the proposed businesses are considered permitted 'uses under the definition of Section 18.68.030 of the Community Development Code (CDC) . Development standards for the site are discussed below: Parking The parking requirements for, a use classification of Building Maintenance Services specifies one space for each 500 square feet of gross floor arela under Section 18. 106.030(c)(8) of the CDC. This would amount to a minimum of ten parking spaces to be provided in association with the first phase of development, one of which would be an 18' x 9' :pace reserved for handicapped parking. As propoged by the applicant, only five spaces are intended in the first phase of development: . NOTICE OF DECISION - SDR 87--10 - DON & MARILYN SCHAEFFR - PAGE 2 On the site plan submitted with this application, an additional ten spaces are to be provided with future development. Since the proposal will not meet CDC standards for parking, at least five more spaces must be incorporated into the initial phase of development. These may come from the area intended for the future parking area or result from altering the site design to accommodate the increased parking stalls. It should be rioted thnt the second phase of development, an automotive repair, operation, will require at least- three parking spaces when i� is constructed . Landscaping and Screenin The landscaping requirement in the I—P zone is a minimum of 25%. Since at least half of the property is within the !=anno Creek floodplain, it will be left as an undisturbed natural area. The site pian also shows landscaping to be put in place around the developed portion of the site along SW Tigard Street. The CDC requires one street tree for every seven parking spaces in the development. These trees must have at least a 1-1/2." caliper prior to planting. Section 18.100.130 of the CDC must be addressed in this proposal. This has to do with the buffer matrix requirements when development occurs on contiguous properties that are in different zoning districts and classifications (residential and industrial) . In this case, screening at least 20 feet from the property line common to the two districts must be put in place. This requirement will be achieved to the north and west by allowing the flooda.ay to remain an undisturbec natural area with existing vegetation providing sufficient screening from residentially zoned areas. To the south, screening must be. provided on the developed portion of the property. As shown on the site plan, the landscaping strip along SW Tigard is insufficient to screen the site as required. Therefore, a revised site plan will have to be provided that assures adequate screening. Such a plan must also identify ground cover in the newly landscaped areas. Access, Egress and Circulation Access for the site will occur on SW Tigard . The applicant .is providing a 2.4' paved driveway apron at the intersection with the street and this meets the minimum requirement of the CDC. However, internal circulation on—site is only provided for by a 20' driveway where the CDC requires a 24' minimum. Therefore, a revised site plan will need to provide for, *aii minimum, a 24' driveway and circulation system interna; to the developed area%of the property . The s to plan indicates an area identified as "gravel (future asphalt)" . It should be noted that the CDC prohibits gravel covering except when granted a variance. In the absence of a variance, the applicant must rover this area with asphalt or leave it in a natural state for the time being. Tree Removal Section 18 . 150 of the CDC addresses the City's desire to prohibit the unnecessary removal of trees on undeveloped lots prior to development. In addition, a cluster of five fir, troos with calipers ranging from 7.4" to 36" are listed as "may be removed." By slightly altering the site plan, preservation of all of these trees can be achieved. It should be noted that no ramoval of these trees may occur without prior justification and staff «pproval through a tree removal permit. Open t, ace A significant portion of this property is within the 100 ,year floodplain of Fanno Creek , The applicant has indicated that the area within the Floodplain will remain in an undisturbed natural. static. To ensure the preservation of the floodway and open space, this area of the property should be dedicated to the City since it is a component of the proposed Tigard Greenway System. Hours of Ope�_ation When the previous development proposal was requested (SDR 19-86) a nearby property owner had concerns about noise impacts and hours of operation. According to the applicants' statement. describing the proposed uses, it was stated that sweeping units will typically leave the shop site at about 9 PM every night and return the following morning from between 6:30 to 7:00 AM. Daytime operations on the site will consist of administration of business and maintenance of vehicles. Other daytime operations will involve related types of parking lot maintenance such as parking lot painting and striping and asphalt re-sealing. These activities will occur approximately betwen,-. the hours of 8 AM to 6 PM. It Is anticipated that an automobile tune-up fa,:ility would maintain similar operating hours of 8:00 to 6:00. C.
