If the top of the lateral pipe extends into the standard curb , the contractor should place 2 pieces of #4 rebar in the curb , longitudially , over the pipe to prevent the curb from cracking at that point . CULVERT The City of Tigard has a duty to maintain the culvert beneath S .W. North Dakota so as to allow storm water to run downstream through its natural course, including the duty to clear debris that may cause water to back up and damage upstream property. See generally, Lanninu v. State Highwi Commission, 515 P. 2d 1355 ( 1973 ) . The City of Tigard has been asked to issue a building permit to develop property upstream from the culvert (Jauch property) . The issuance of a building permit is generally considered to be a ministerial function. Cities are not immune from liability arising from a claim based upon' the performance of a ministerial function . See generally, ORS 30, 265 . They claim that a ditch has been filed in by adjacent property owners (set% at.tached) , I'm working with the City Attorney' s office, at Bill' s request, to answer certain legal questions. The Jauchs have also indicated that they may want to address the area problem, possibly through an L.T.D. They also want to know what the City' s plans are with respect to studying the drainage basin involved and identifying long--term drainage needs and routes. Can you identify our schedule for studying this arca and what that study might include? Tom Amberg, PI_, who represents the Jauchs, has designed a ditch/swale (see attached) that could be constructed downstream if easements are granted. Initially, we told them that an easement, if obtained, would have to be 15 feet wide (st:andard) . Now they are saying that one property-owner may work with them, while the other one won't. Given the interim .improvement proposed, could we obtain 7-1/2 feet now and the balance when the final improvement is placed? As you have stated, the City is withholding building permits and public improvemeit construction until problems with the downstream storm drainage system are resolved. Also as you have stated, these problems had arose after you were issued a public Improvement pe mit, which typically entitles you to a building permit. A construction hold was placed on the project on April- 27, 1987 due to the discovery of inaccurate information shown on the previously approved public improvement draw�.ngs. This information was critical to the approval of the storm drainage system. The approved plans shored that storm drainage from your development would be directed into an existing system heading west towards Greenburg Road, all contained within public right-of-way. After the permit was issued we discovered that this drainage eystem was non-existent. The only existing system was a culvert heading north under SW North Dakota Street which drains into what has been described as an "existing ditch" on private property. The existence of this ditch, even at the time of certain County approvals, Is questionable. It is also very difficult to determine whether or not the area was filled by adjacent property owners excepL maybe at the pipe outlet. Given this Information about the "actual" downstream drainage condition and evaluating the additional. run-off created by your project, the Engineering Section decided to place a hold on permits until the situation could be evaluated further. Upon further evaluation, the Engineering Section determined that certair, downstream (off-site) improvements would be required and need to be assured before construction could proceed. .John Hagman of the Engineering Section met with you, your engineer and land surveyor on May 5, 1987 at the site to discuss the situation and talk about alternatives. At least three alternatives were discussed, all of which you verbally rejected. These included: 1. Constructing a line west along North Dakota to an existing ditch within public right-of-way. 2. Working with the owner of the Tamaryn development to utilize their closed storm drainage system, 3. We are still. waiting for you to present a solution, and will not allow construction to proceed until the Engineering Section approves that proposed solution. I think it's important to note that the Engineering Section's current requirements of your project are consistent with what is squired of other developments in similar. situations. If we had been made aware of the actual downstream situation at the time of public improvement plan submittal. or even at the pre--app meeting, our position would be the same as it is today. I must also respond to certain statements you have made about John Hagman and myself. Most, if not all, of these are either out of context or not true at nII. Of particular concern are statements identified in your letter which supposedly occurred on May 5, 1987 and May 19, 1987. Those supposedly made by John Hagman on May 5, 1987 did not occur and those supposedly made by myself on May 19, 1.987 have been stated out of context. The Engineering staff ins not dntl-development and has not held up your project without just cause. We want to see the project go ahead with adequate provision for public facilities, including storm drainage. Should you desire, we can work with you to refund any permit fees or bond deposits until this matter is resolved. However, we would have to re-issue the permits and collect the necessary fees and bond deposits again should the project go ahead. Please give me a call should you have further questions or concerns. According to our records, plans were approved and two half-street improvements were constructed on North Dakota Street in the vicinity of 9715 S.W. North Dakota Street in the late 1970's. Both sets of plans show a cross culvert running to an existing ditch along the west property line of 9715. When the half-street was constructed on the south side, the cross culvert was realigned on the south end in order to install a catch basin. The approved plans show a stub in the catch basin for future drainage connection to the east. I understand the outlet end of the cross culvert has since been plugyed and the drainage ditch has been filled in. Oregon drainage laws are very clear that upland property owners have a right to use artificial drainage systems to drain surface waters from their land onto lowlands through natural channels. The laws also state that lowland property owners may not allow drainage ways on their property to plug causing water to back up and flood upland properties. The upland property owner, or in this case the jurisdictional authority for the road, can bring legal action against the lowland property owner to get them to abate the drainage blockage (ORS 368.251). Background No previous land use applications have been reviewed by the Planning Division for this property . 2 . Vicinity Information This parcel is surrounded on all sides by R- 12 zoning. Development in the vicinity consists of mostly single family residences except for a 20 unit apartment complex to the west. In the general vicinity are several other multi--family residential developments, most of which are oriented along SW Greenburg Road to the west 3 . Site Information and Proposal Description Presently, the subject property is developed with a single family residence with a fenced in yard. The back portion of the lot (facing SW North Dakota) contains the last trees of an old apple orchard, Access to this parcel occurs from SW 97th Court, an unimproved private road twenty feet wide. This drive is shared with several residences in the immediate area. The applicants propose to develop the property with the phased construction of a 12 unit apartment project. 4 . Agency and NPO Comments The Building Division reviewed the proposal tend made the following comment: The existing house, if on a septic system, should have the drain field located so it can to determined if any development „n the lot will disturb the system as well as the storm drainage. N(:iICE OF DECI£TON - SDR 87-02 JAUCH PAGE 1 The Tualatin Rural, Fire District reviewed the proposal and made the following comments : 1 . Extend driveway system through to SW 97th Court., 2 . Fire hydrant protection required within 250 feet of all portions of a building as accessible by a fire engine. 3 . The proposed outside turning radius of 45 feet and inside of 25 feet: the existing turning radius is inadequate The Engineering Division reviewed this proposal and made the following comments : 1 . Applicant will have to extend the existing storm line in SW Nor•t.h Dakota Street across the property' s frontage to the east boundary line; this will be addressed on the public improvement construction plans at the time of their submittal . 2. . Applicant will have to construct a pavement taper• at the east boundary of this improvement of SW North Dakota Str•eat for transitioning traffic safely; this also will be addressed on the public improvement construction plans at the time of their submittal . General Telephone (GTE:) reviewed the proposal and has no objections to it. No other comments have been received . D. ANALYSIS AND ('.ONCLUSION I . Parking The required number, of parking spaces for this development is 7 spaces for each unit with each unit having one covered parking space. According to the site development plan presented, the number• of parking spaces proposed goes beyond the minimum requirement. Chapter 19. 106 of the Community Development Code (CDC:) also specifies that all parking areas which contain over 5 required spaces shall be provided with one handicapped parking space for every 50 standard parking spaces . In accordance with applicable state and foderal standards, designated handicapped parking spaces must: be at least twelve feet wide and eighteen feet long. The applicant must provide one handicapped space to meet. this provision. 2 . Access and Egress The existing access onto this property from SW 97th Court will not be permitted with this development. Applicant has indicated that ingress/egress will occur on SW North Dakota Street via a 24 foot wido concrete apron. A 10 foot right -of way dedication, atony with half--street improvements (including a 5 foot sidewalk) arc, Nl+.o incorporated into this application. NOTICE OF DECISION - SDR 67--02 JAtlCtl - PAGE 2 As a condition of approval, access to SW 97th Court will have to be discontinued since it is a private drive. Restricting access can be achieved by either an earthen berm, a fence, or by extending the laurel hedge which presently grows on the property along SW 97th Court as shown on applicant' s landscape plan. 3 . Landscapinq and Screening The landscaping plan submitted is adequate to meet the 20% requirement specified in Chapter 18. 120 of the CDC. This plan combinf?s street trees, a laurel hedge at the rear of the development abutting SW 97th Court and rhododendron bushes to screen off and separate residential units. As proposed, landscaped portions of the property allow for sufficient vegetative cover and open space. 4. Density computation As initially discussed in a pre—application conference, applicant proposed 14 residential units . However, staff advised that 12 units would most likely be allowed. Chapter 18 .92 of the CDC provides for a density computation based on specific property characteristics and how it will be developed. In this instance a 3050 square foot minimum lot size is required per unit. Using the density computation, applicant could be allowed an additional unit providing all other conditions of approval are satisfied. In order to add the extra unit: a revisod site plan will be required. f„ DECISION 1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALI BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS. 2 . The applicant shall provide for roof rain drainage and parking lot drainage to the public stormwater system. 3 . The applicant shall provide for connection of proposed buildings to the public sanitary sewerage system. A connection permit is required. 4. Tom Amberg, PE, who represents the Jauchs, has designed a ditch/swale (secs aLtachod) that could be constructed downstream if easements are granted. Browning, 9715 S.W. North Dakota Street, Tigard, approximately April 7, 1978, and referred tle letter to this department. North Dakota Street in this vicinity is a deCicated public road, not a county road, and is immediately adjacent to but not within the city limits of Tigard (see attached map) . The owner of tax lot 307, Gurdon Carpenter, had applied to the City of Tigard for permission to construct an apartment development on his property. A condition of approval of the development was that Mr. Carpenter do certain improvements to North Dakota Street. Plans for the improvement were prepared by Alpha Engineering and submitted to this office. The plans as first submitted, did :,ot indicate a culvert, but the existing ground profile on the plans indicated sag and we asked whether or not a culvert should be installed at that locat;P.,,. 'There was no culvert prior to the improvement. The engineering firm inve-.;�igated the situation and resubmitted plans that did indicate a culvert to b•, constructed. The plans were approved and a permit was issued to Gordon Carpenter on August 2, 1977, to construct the road improvement and the cullert. This department did not visit the site as a part of its plan review and is our normal procedure riot to visit the site, relying on the design engineer to do this. Neither the county nor the design engineer had access to high quality topographic maps at the time of the plan review, though we have acquired a portion of the topoyra.phic map from the City of Tigard since that time. The topographic map indicates a very, very subtle swale at the location the culvert was constructed. This appears to be the same Swale as appears on the design plans. we do not feel a dangerous condition exists at the end of the culvert. It appears the proper solution to the situation is construction of a storm drain or ditch system from North Dakota Street northward to Ash Creek, about 600 feet north of North Dakota Street. . This could be done either through cooperation between the various property owners involved or through a City of Tigard local improvement district, as that area is within the City of Tiq.ir, This department has recently discussed the situation with Mr. Carpenter and lie indicated he would contact the adjacent property owners to try to work out a solution.. A check with the Planning Department has indicated a preliminary proposal for a multi-family development on the Webb property across the street from the Brownings. I have alerted that office of the drainage situation and my suggested solution. Attached is a copy of Mrs. Browning's letter, a topographic map of the vicinity, a copy of the permit issued to Mr. Carpenter, a copy of the tax assessor's map of the vicinity, a copy of the improvement plans, a copy of a letter from Alpha Engineering regarding the situation, and photographs of the area. On or about May 1, 1977 , we were requested to prepare construction plans for street and utility improvements for TAMARYN, a proposed apartment complex for Mr. Gordon Carpenter. The property is Tax Lot 300, Section 35, T-IS, R-lW. As you are aware, the property is within the City of Tigard and S.W. North Dakota is not in the City and therefore comes under the jurisdiction of Washington County. The City of Tigard, in approving Mr. Carpenter' s project required him to make street improvements to S.W. North Dakota St. Prior to designing the street, a centerline profile was run by our survey crew and is shown on Sheet 3, PLAN AND PROFILE - S.W. NORTH DAKOTA STREET. As you can see, there was a natural low point in the street. Field a*evations were as shown below: Station 25' Left (North) 25' Right (South) 0 + 50 West 183.4 1 + 00 183.7 181.7 180.7 1 + 50 181. 1 2 + 00 181.6 181. 1 180.8 2 + 50 181.4 3 + 00 182.4 182. 1. 180.5 3 + 21 '1 181. 3 The above dces dhow that there was a low area between station 1 + 00 and 3 + 00 both at centerline and north of centerline. This indicates that storm water runoff from ;:he area to the South would cross over Dakota Street rather than continuing West toward Greenburg Road. ,terry Morse Re: TAMARYN April 24, 1978 page two Field i»vestigation prior to construction revealed that there was no culvert existing at this low spot and that runoff was in fact crossing over the gravel roadway. Since the final design of the street grade resulted in some filling in this area, it was necessary to install a culvert at the low area to prevent any ponding from occuring on the South side of the new street.
