The Tigard Planning Commission reviewed the above applications at a hearing on July F, 1986. The public Commission based its decision on the facets, findings, and conclusions noted below: A. FACTS 1 . General Information CASE: Variance (V 14-86) REQUEST: To raise the 2.0% limit on commerical uses in 'the I-P zone to 25%. Background The Koll Business Center has been partially developed as thFa .esult Of several Cit y approvals (ZC 23--78, ZC 26-78, CU 33"-70, and SDR 8-80) . Twelve buildings have been constructed within Phase I of the project. Plans were approved for construction on the subject site, but nothing materialized. Site Development Review approval was granted in 1985 (SDR 2-85) for the main building near the southern end of the property. A second Site Development Review approval (SDR 5-86) was _granted in 1986 fo,• a 3,700 square foot restaurant near the Scholls Ferry/Nimbus intersection. Site Information and Proposal Description The property is presently undeveloped and the applicant has begun to construct the business/retail building and the proposed drive--in restaurant. The entire project will include 24,093 square feet of floor area in the main buildings and 3,700 square feet for the restaurant totaling 27,743 square feet for the entire project. The I-P zone allows 20 percent of the total square footage of a development to be devoted to convenience sales and personnel services, day care facilities, eating and drinking establishments, personal service facilities, and general retail sales. All uses above this 20 percent limit must be limited to the other permitted, or conditional uses allowed in the zone. The applicant is proposing to exceed this standard by allowing approximately 25 percent of floor space to be utilized by eating and drinking establishments, convenience sales, and personal services . It is indicated that present lease agreements will commit approximately 14 percent of the floor area to these uses and a proposed restaurant/deli of 3,039 square feet would raise this percentage to about 25 percent. 5. Agency and NPO Comments NPO 117 appeared at the hearing and indicated tha`. it: was opposed to the request. B. FINDINGS AND CONCLUSIONS The criteria to be applied when reviewing a variance request are contained in Section 1P , 134.050 of the Community Development Code: 1 . The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2 . There are special circumstances that exist which are peculiar to the lot size or, shape, topography, or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3 . The use proposed will be the same as permitted under this Code and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms, or parks will not: be adversely affected any more than would occur if the development were located as specified in the Code; and 5. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. FINAL ORDER 86- -9X PC - V 14-86 - PAGE 2 The Planning Commission concludes that the proposed variance is not consistent with all of the criteria for the following reasons which are addressed in the same sequence as at �ve: 1. The applicant is correct in noting that the purpose statement for the I-P zone calls for a combination of ". . . light manufacturing, office, and complementary related commercial uses . . ." However, the applicant uses this as a partial justification for allowing one additional commercial tenant. The 20 percent limit in the Code in affect defines to what extent these "complementary commercial uses" are to be permitted in the I-P zone. After surpassing the 20 percent limit, these are no longer permitted uses and are viewed in a similar manner as a variance to allow a commercial use in an I-L (Light Industrial) zone where commercial uses of this type are not permitted. Approval of such a "use variance" would be contrary to the intent of the I-P zone and the Comprehensive Plan, 2. There are no peculiar circumstances related to this property or the proposed development which justify the variance. The I-P zone and the limitation on commercial uses applied to the subject property prior to the submission o,° current development proposal. The applicant proceeded with the project with an awareness of this Code provision. 3 . As noted in number 1 . above, once the 20 percent limit for, commercial uses is exceeded, they are no longer viewed as permitted uses in the I-P zone. 4. Physical or natural systems will not be affected by the approval or denial of this request. 5. The hardship, if there is one, is self-imposed and the proposed relief is riot consistent with the intent of the Code or Comprehensive Plan. If the situation in this area has changed as the applicant has indicated, the appropriate avenue to follow to allow for more commercial uses would be a request for a Comprehensive Plan Amendment and Zone Change rather than a use variance. C. DECISION Based upon the above findings and con,.:lusions the Planning Commission upholds the Planning Director' s denial of V 14-86. I lost them . Anyway , our modus operandi is on a crisis basis around here due to the ex- ceptional amount of new construction underway within our fire district . Nevertheless , I have now indeed reviewed the preliminary plans and as a result , I am herewith listing applicable requirements �•:;lich will be pertinent initially and , as time goes by , during the course of development of Nimbus Center . In the first instance , the preliminary drawings relate only to the construction of the building shell . We will , of course , want to review the plans for all interior development prior to the start of construction for all interior spaces . ( Ref . Sec . 303 U I a(-, ) Secondly , and as in the rase of interior development plans , complete mechanical and electrical system plans must be submitted to , reviewed and approved by a representative of this office prior to the installation of any HVAC equipment and its attendant duct work . Also , exits and the wa_v-of-access must be well - indicated by exit signs and must be illuminated to an intensity equal to one- foot candle measured at the floor . ( Ref . Sec . 302 UMC , 3313 and 3314 UBC ) As mentioned in our telephone conversation of December 12 , those portions of the exterior wall which are located ten feet from the south property line are required to be one-hour fire-resistive construction . (Ref . Sec . 405 UBC ) STOP FIRES—SAVES LIVES Mr . Rick Tiland December 13 , 1985 Page 2 In all wood- framed walls and partition , fire- stopping consisting of two- inch nominal lumber is required at all ceiling lines and the attic space must be subdivided into section, of not more than 9 ,000 square feet in area by draft- stop partitions extending from the upper surface of the ceiling below to the roof deck above . Draft- stop partitions may be constructed of 3/8" plywood , 1/2" gypsum b%clyd or material of an equivalent fire resistance and resilier.ce . (Ref . sec . 2516 UBC ) Building insulation must have a flame-spread rating of not-to- exceed 25 aid a smoke-development classification of not greater than 450 as .neasured on the Steiner tunnel test scale referred to as UBC Stand,rrd No . 42- 1 . This requirement includes breather papers rind vap,:r harriers which are not in contact with ceiling or wall surfaces . (Ref . Sec . 1713 UBC) Since the building will be provided with full automrtic sprink- ler protection , the firefighting water supply required 3t the site is 1 ,000 gallons per minutes at a minimum residual pressure of 20 psi , and this from a fire hydrant (one is shown on the drawings ) which is located within 500 feet of portionF, of the building . Howevt•r . as I mentioned in our telephone conversation of December 13 , one required fire hydrant must be within 70 feet of the fire department connection to the automatic sprinkler system (R�,f . Sec . VII Ordinance 83- 1 Washington County Fire District No . 1) Regarding the automatic sprinkler protection , plans , therefore , must be submitted to and approved a representative of this office prior to installation . Additionally , the sprinkler system must be electrically supervised and tied into an approved central alarm station . Currently , there are four central alarm-receiving stations approved by Washington County Fire District No . 1 . They consist of American District Telegraph , Honeywell Protection Service , Briggs Security Systems and Security One , Inc ./ 3-M . ( Ref . Sec . 10 . 308 UFC and 3803 URC ) Fuel - fired furnaces and boilers fitted with burners having a !iTIJ input rating of 400 ,OOC or greater must be " fire- isolated" from the remainder of the building by an occupancy separation of not less than one-hour fire- resistive construction . Provisions must be made for the introduction of combustion and draft- hood di - lution air into such spaces pursuant Section 601 through 607 of the Uniform Mechanical Code . (Ref . Sec . 708 UBC ) Mr . Rick Tila ' December 13 , 1985 Page 3 Architectural finish hardware for all door assemblies must be of the simple type , the method of operation being obvious . Gen- erally , doors must be openable from the inside at all times for immediate exit without the use of a key , special knowledge, or effort . However , exterior doors may be fitted with keyed dead locks if they are of the " indicating" type ; being readily distinguishable as being locked when in the locked position . Where this option is exercised , a sign must be posted on or over the door reading "This dour must remrin unlocked during business hours" in letters not less than one inch in height on a contrasting background . ( Ref . Sec . 3303 U90 The foregoing comments and stipulations saver major requirements which seem to be worth mentioning at this time . Landscaping Because all of the surrounding parcels are also zoned I-P, there are no specific buffering standards which apply to the periphery of the project. However, section 18.120.180(4) of the Code requires that screening be installed as necessary between different types of .land uses. the back of the building will face Fanno Creek and the residences to the south and it will. vary in height between 18 and 40 feet. The landscaping plan indicates the placement of English Ivy and four Douglas fir trees along the 382 foot length of the buildirig. The landscaping plan should be amended to provide additions buffering along the rear of the structure. 4. Fenno Creek Flood Plain The buildinv location includes a small. amount of land which is presently within the 100 year flood plain of Fanno Creek. The Sensitive Lands approval (SL 5-84) noted above, allowed for regrading work to be done along the northeastern edge of the flood plain. This modification will fill some areas and excavate others in a manner that will not cause the flood elevation to rise. The City Code provides that after the regrading is completed as approved, all land above the 100 year flood plain elevation can be developed in accordance with the applicable zone. The applicant intends to regrade the property as approved by the City and after this work is completed, the entire building site will be above the 100 year flood plain. C. DEM;ION The Planning Director approves SDR 2-85 subject to the following cond:i tions: 1. UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO ISSUANCE OF BUILDING PERMITS. 2. Standard improvements including concrete sidewalks, wheelchair ramp, streetlight , driveway aprons, sign and utility relocation shall be completed along the SW Nimbus Avenue frontage. Said improvements along SW Nimbus Avenue shall be built to City standards and conform to the alignment of existing adjacent improvements. 3. Four (4) sets of plan-profile public improvement construction plans and one (1 ) itemized construction cost estimate, stamped by a Registered Professional Civil Engineer, detailing all proposed public improvements shall be submitted to the Engineering Section for approval . Agency and NPO Comments The Engineering Division indicates that this development will be responsible for completing the remaining half street improvements along Nimbus Avenue. Tile development must comply with the conditions of approval for last year's Sensitive Lands approval (SL 5-84). The State Highway Division indicates that direct access to Scholls Ferry Road will not be allowed. When the Division acquired the right-of-way along this frontage between Fanno Creek and the Southern Pacific Railroad, access was restricted to the Nimbus Avenue intersection. The Building Inspection Office and Washington County Fire District No. 1 have no objection to the request. The District has discussed methods of fire protection with the applicant 's architect. Written comments have not been received from NPO 2 and NPO 11 7 has expressed concern relating to the location of the building the flood plain. B. ANALYSIS AND CONCLITSION The proposal is basically consistent with the applicable provisions of the Community Development Code. However, several aspects of the development that warrant further discussion are noted below: 1 . Street Access Because of the refusal of the Highway Division to allow direct access to Scholls Ferry Road, the site plan must be revised accordingly. The Code only requires one driveway access for a project of this size. 2. Parking The Code permits the area behind a wheel stop for a parking space to contain low landscaping material. However, if this area is landscaped, it may not be used to satisfy any landscaping requirements since it functions ns a portion of the parking space. The Code required that all landscaped areas within and on the perimeter of parking lots must be a minimum of three feet in width. After the parking space dimensions are accounted tor, several landscaped areas do not meet the three foot standard. NOTICE OF DECISION - SDR 2-85 - PAGE 2 4. A revised landscaping plan shall be submitted for Planning Director approval which incorporates additional buffering along the rear of the building. It is recommended that the applicant discuss this requirement with Keith Liden prior to submission of the revised plan. 7. Landscaping improvements shown on the approved plan shall be installed prior to occupancy. B. All conditions of Sensitive Lands approval SL 5-84 shall be met. 9.
