In March, 1986, a Site Development Review application for construction of a 22,775 square foot business/retail building and the 3700 square foot Burger King restaurant was approved subject to certain conditions . Site Information and Proposal Description The Burger King restaurant is situated at the northeastern corner of the property. The b•ailding does not directly face either SW Scholls Ferry Rd. or SW Nimbus Avenue but rather it forms an angle with both streets . Burger King was granted a sign permit for a 36 square foot: gall sign on the southern building face in early December, 1986. Last week a 72 square foot Burger King tenant sign was erected along SW Scholls Ferry Road (Sp 103--86) . FINDINGS AND CONCLUSIONS The applicant is requesting an exception to Section 1.8. 1.14 .070(h) which states : "Roof signs of any kind are prohibited, including temporary signs , " The applicantnotes that such a :iqr; is customary for Burger King restaurants. The relevant approval criteria in this case are contained in Section 18. 114. 145 of the Community Develcpment Code. In order to justify an exception to the sign code, one of the following three criteria (CDC 18. 114. 145) must be satit; �ed: a. The Proposed sign cede exception is necessary because a conforming building or sign on an adjacent property would limit the view of a sign erected on the site in conformance with the sign code standards. b. The proposed exception to the height limits in the sign code is necessary to make the sign visible from the street because of the topography of the site. There is an access drive which services the business or service from a street other than the street on which the business is located , After reviewing this application, the Planning Commission concludes that the proposed sign is ju:,t:ified for two reasons. First, the appli-,ant indicated that drawings for the proposed sign were included as part of the building plan submitted and the Wilding plans were subsequently approved by that division in April, 1986. Therefore the applicant interpreted this to mean that they could put a sign on the roof. Second, the Planning Commission believed that the proposed exception to the height limitations in the Sign Code is necessary to make the sign visible from the street because of the topography of the ,ite as allowed by criteria b. above. C. DECISION Based upon the findings and conclusions above, the Planning commission approves SCE 12--86 subject to the following conditions. 1 . The sign size shall not exceed 34 square feet in area;. 2. A City of Tigard-approved sign permit shall be obtained prior to erection of the sign. 3. The sign will be erected exactly as shown on plans submitted to the Commission on the northeast roof face to the right of the drive--in canopy . 4. This approval shall expire if not exercised within one year of the final decision date noted below. With the design change that covered this ar 9, this wall is now a non-bearing wat, and serves only in a minor function as a shear wall. A nominal slab thickening to receive sole plate anchorage is all that is required and, in fact , the thickened slab of .a size similar to foundation number two repreaents a value far in excess of that required. A simple thickening of 8" wide by 12" thick would suffice. T expect in future revisions that this modification will be included in the stock plan. The findings and conclusions on which the Director based his decision are as noted below. ^,. FINDING OF FACT 1 . Background The Koll Business Center has been partiall;, developed as the result of several City approvals (ZC 23-78, ZC 26-78, CU 33-78, and SDR 8-80) . Twelve building have been constructed within Phase I of the project. Plans were appro%led for con:t.ruction on the subject site, but, nothing materialized. Site Development Review approval was granted in 1985 (SDR 2-85) for the main building for this project near the southern end of the property . The site plan submitted for this application indicated that a second building would be constr•uct(!d within the development immediately adjacent to the Scholls Ferre Road/Nimbus Avenue intersection. 2 Vicinity Information Phase I of Koll Business Center is on the east side of Nimbus Avenue and a separate tract intended for greenway purposes lies to the south and west between the subject property and Fanno Creek . Residences within Englewood Subdivision are south of the creek. The City of Beaverton is directly north of Scholls Ferry Road. 3 . Site Information and Proposal Description The property is presently undeveloped and the applicant has begun to construct a 22., 775 square foot business/retail building in t:he southern portion of *he property . The proposed drive-i.n in restaurant will be situated on the opposite side of the parking lot near thF intersection. 4 . Agency and NPO Comments The Engineering Division has the following comments: a. The Building Inspection Division and the Tigard Water District have no objection to the request. The State Highway Division indicates that no direct access is permitted to 3cholls Ferry Road. Hn O.S.H.D. permit is required for any work within the right-of-way such as landscaping. No street improvements are required by the Division. No other comments have been received. B. ANALYSIS AND CONCLV; ION The proposal is basically consistent with the applicable provisions of the Community Development Code. however, several aspects of the development that warrant further discussion are noted below: 1 , Street Access Because of the refusal of the Highway Division to allow direct access to Scholls Ferry Road, the site plan must be revised according. 2 . Parking The original plan that: was approved as part of SDR 2-85 contained 108 parking spaces. The parking spares indicated in this application total 96. The main building will be 22.,775 square feet in size and the ' restaurant will have a 573 square foot dining area. The uses intended for the larger building wil' have a parking i requirement of one space per 200 to 500 square feet of gross floor area and the majority of the -Alowablo uses are subject to a ratio of one space per 350 square feet. Restaurants must provide one spare, per 50 square feet of dining area plus one space for every two employees . Building Setback The plan notes a 20 foot setback from Scholls Ferry Road and Nimbus Avenue but the scale distances are between 16 and 18 feet. The Building Inspector will require a 20 foot setback for the restaurant. 4 . Landscaping The landscaping plan for the entire center was approved in conjunction with SDR 2-85. 14owever, one modification will be necessary to address the concern regarding headlights of cars using the drive-up window. Some type of buffering, such as a low hedge, should be empl3yed to mitigate this problem. 5. Allowable Uses The I--P Zone permits the following uses provided that separately or in cimbination they do not exceed 20% of the total square footage o� the development complex: -- convenience sales and personal services -- day care facilities - eating and drinking establishments personal service facilities general retail sales. The entire center including the restaurant contains a gross floor area of 26,475 square feet and a maximum of 5, 295 square foet may be devoted to the five uses listed above. After the size of the restaurant is deducted, only 1,595 square feet 47f the main building may be utilized for any of the above uses. C.
