Adjustment to transfer 0.52 acre from an adjacent parcel to the subject property. This adjacent parcel involved in the adjustment is zoned T--P (Industrial Park) . Location: 7342 SW Kable Lane (WC'TM 2S1 12DC, tax lot 200. Tax lot 201 is the parent parcel of the area involve(' in the Proposed lot: line adjustment) . DECISION_: Nct.icQ is hereby given that the Planning Director, for, the City of Tigard Fas APPROVED t-ho above described applications subject I-o certain conditiors. The findings and conclusions on which the Director based his decision are as noted below. A. FINDING OF FACT 1 . Background Tax lots 200 and 201 were created from the same parcel through a Minor Land Partition (MLP 117-08) reviewed by the Planning Division in September, 1987. The zoning for tax lot 201 along with adjacent tax lots 500 and 600 was changed from I-L (Light Industrial) to I-P (Industrial Park) by Planning Commission action in February, 19118 (ZC 87-23) . The zoning fur tax lot 200 was not affected by this action. ? . Virinity Information Properties to the north and east of the subject property are zoned I-L and are developed with various light manufacturing and distribution uses. A railroad spur is located immediately east of tax lot 200. The remainder of tax lot 201 and tax lots 500 and 600 are located south and east o, the subject, property, are zoned I--P, are vacant, and are currently under conside, ation through a separate Site Development Review application for incorporation with the adjacent Carman Center, office/commercial centor and fur development: of two additional buildings (SUR 88-09, V 88-09) . West of the subject property is a 30 foot wise vacant street right--of-way, t-ho 50 foot wide Southern Pacific Pailroad right--of--way, railroad tracks, and vacant parcels lucatpd along SW 74th Avenue. This area is zoned I--P. 3 . Site Information and Proposal Description The parcels are vacant-, hovel, and cleared. Access to tax lot 200 is provided by Kable Lane, a 40 foot wide, fully improved 300 foot long local street terminating in a cul--do-sac . The southerr half of the cul-de- sac fronts tax lot 200. NOTICE OF DECISION - Pacific Realty Associates - SDR 88-08, V 88--08, M 88-06 PAGE I 7 The applicant, proposes to develop a 96,000 square foot distribution canter on the site. The building will be encircled by an access drive and parking areas. The drive will enter- Kable Lane at: the west end of ' the cu) -de--sac alone Lhe site' s northern property line, turn south, and enter a large paved area adjacent to loading ramps serving 20 loading doo-s. The drive would continue around the south end of the proposed building, turn north between the building acid the rai.lspur, and re-enter Kable Lane on the south side of the cul-de-sac. Four overhead doors would be located at. grade along the eastern side of the building. The drive would be a minimum of 30 feet wide, widening to between 96 feet and 114 feet along the building' s west side providing a truck maneuvering area to serve the loading ramps . The drive would allow passage onto 1he driveway and parking area of the adjacent. proposed Carman Conte~ expansion. Parking for the proposed distribution center would be provided at the north and south ends of the building. One--hundred-fourteen park irig spaces including one designated handicapped parking space are proposed . Thu landscaping plan calls for 17 maple trees to be located along Kable Lane and the western access drive to the site. Parking lot islands would include a variety of shade trees . The western odge of the site would be lined with Hogan Cedar and Vine Maple tree Hogan Cedars would also be planted along the eastern side of the building, Over, thirteen percent of the site would be landscaped. The I- L zone requires that-, 15 percent of the site be landscaped . The applicant has requested a Variance to this standard. Additionally, the applicant has held preliminary discussions with the City to obtain a licensing agreement. to use the 30 foot wide right-of--way to the west for enlarging the truck maneuvering area and providing additional landscaping. The applicant also proposes to adjust the southern pr•uperty line of Lax lot 200 by transferring a 76 foot by 300 foot area to it from tax lot 201 . This area would, at present, remain zoned I-P This area would be mostly pavpci, serving as a 42 space parking area and driveway. Two islands containing shade tree;, are incorporated into the parking area. 4. Agency and NPO Commert.s The Engineering Division reviewed the proposal and offered the following comments : 1 . The submitted site plan shows a proposed 96,000 square foot 'Building 217' with access from two locations off Kable t_arie and a joint use access to the property to the south, the properly to Lhe south is a proposed multi--tenant development 'Carmen Center, ' submitted simultaneously by the same owner as this development . 2 . One access located on the west and of Kable t —, is proposed as a joint access with the existing building to the north. the second access off Kable Lane is proposed to be adjacent to the railroad spur, tracks located on the east property line. Improvements Alsu include sidewall.s and streetlights . 4 . The submitted site plan dues riot show the necessary sanitary sewer or storm drainage improvements . However, the site plan previously submitted showed the improvements connecting into existing facilities . Washington County Fire District e,1 commented that the fire department connection for the sprinkler system must be located within 70 feet of a fire hydrant. General -telephone commented that the applicants 1-hould contact them i,i order to coordinate the telephone point of Access for the building. the Building Division, Southern Pacific Railroad and the Tigard Water District reviewed the proposal and offered no comments or objections , No other- comments were received. r,. ANALYSIS AND CONCLUSION Site Development Review The proposal conforms with Community Development Code Site Development Review standards for access and circulation, visual clearance at intersections, and with I-L zone requirements for use, building height, and building setbacks. The proposed site development plan does riot comply with certain off-street parking requirements and the L- L zone' s requirement that 15 percent of the site be landscaped. The applicants have requested a Variance to the lanoscaping area requirement. This request is discussed below. The site development plan provides for 114 parking spaces including one designated handicapped parking space. Community Development Code Section 18. 106.030(d) requires that storage and distribution uses must be provided with one space for every 1,000 square feet of gross floor area. The proposed building will be 96,000 square feet in area. Therefore, at least 96 parking spaces must be provided. This standard is satisfied, Section 18. 106 .020(n) requires that one handicapped parking space be provided for, every 50 standard parking spaces . Therefore, at, least two designated handicapped parking spaces must be provided . Iii addition, Section 16 . 106.020(p) requires that one bicycle, parking space be provided for- every fifteen parking spaces . The site development plan does riot provide for bicycle parking spaces . The site development plan, therefore, must baa revised to irovide fur appropriate numbers and locations of both handicapped parking spaces and bicycle parking spaces . Variance - landscaped Area -the proposed landscaping plan would provide for 13 .8 percent of thc, sitcl to be landscaped whereas Secl.ion 18. 70,050(6) of the Community Development Code requires that 15 percent of a development. situ in the I L zone bo landscaped. The applicant has requested that a Variance to this requirement be granted. Section 18 . 134 .050 )f the Code provides that. The proposedva riar,ce will not be material detr imental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policios and standards; and to other, properties in the same zoning district or vicinity; 2. There are special circumstances that. exist which are peculiar to the lot size or shape, topography or other circumstances over, which the applicant has no control, and which are riot applicable to other properties in the same zoning district; 3 . The use proposed will be the same as permitted under, this Coda and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the land; 4. Existing physical and natural systems, such as, but riot limited to traffic, drainage, dramatic land forms or parks will not be adversely affocted any more than would occur if the development were located as specified in the Code; and 5. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The primary purpose of the landscaping requirement is to present an attractivi site development to surrounding properties and adjacent. roadways. This purpose would not be detrimentally affected if the requested variance is gran'-ed because the landscaping plan calls for ample landscaping along the site' s frontage along Kable Lane, the most visible portion of the site. In addition, the plan as presently proposed, provides for a row of trees along the western edge of the site along the unused street right.-of--way and the railroad tracks . Other areas ( f the site are not readily visible, except to adjacent similar uses . The site' s limited visibility, because of its orientation, is a special circumstance applicable to the site which helps justify the variance but which dors not. generally apply to ul:her properties within the I-L zone. The use proposed, distribution and storage, is a permitted use .in the zone end is not: at all affected by the variance requested. Physical and natural systems which will support the development of the site will nit be impacted by the variance since land usage and development intensit;r will not be altered. Although some degree of economic hardship could result: by requiring a minimum landscaped area of 15 percent, the Code is not intended to address economic issues . The landscaping standard of 15 percent has applied to this property fur many years and the applicant was or should have been aware of this standard when the property was purchased. The staff finds that tho hardship criteria has not boon satisfied. In addition, the applicant has held preliminary discussions with tho City of Tigard regarding a licensing agreement for use of the vacant right-of- way west. of the site for expansion #J the truck maneuvering areia and increased landscaping. The Iicons iriq agreement would allow for Pacific Realty' s use of the area for a specified period of time or until the City determines that the right-of--way is needed for transportation uses. NOTICE OF DECTSION - Pacific Realty Associates -- SDR 88--08, V 88-08, M 88-(16 PAGE 4 The area that would be subject t:u the licensing agreenm nt would consist of approximately 23,01.0 square feet. Presently, the need for this right-of-way to be used for access appears to be highly unlikely . The right-of-way is not maintained and is a potential eyesore. It would be in the City' s interest to have this area maintained in conjunction with t:he proposed use The Planning Division finds that, increasing the site' s landscaping using a portion of the area proposed fur• the license agreement, would be supportive of Plan policies and Code provisions related to landscaping in the I-L zone, and could satisfy the 15 percent area landscaping requirement for the proposed distribution center- if the area as a whole is considered, rather than solely the tax lot on which the building will be located. Lot Line Adjustment The proposed lot line adjustment to include an additional 22,800 square feet within tax lot 200 meets the approval standards for lot line adjustments set forth in Section 18. 162.060 of the Community Cevelopment Code. Both parcels would rrymain larger than the minimum lot size for• their respective zones and all other• dimensional and setback requirements will be satisfied. C. DECISION The Planning Director a.ppr•oves Site Development: Review SDR 88 08, Variance V 88-08, and Lot Line Adjustment M 88 06 subject to the following conditions : PRIOR TO RECORDING THE LOT LINE ADJUSTMENT WITH WASHINGTON COUNTY, THE FOLLOWING CONDITIONS SHALL BE MET: 1 . A final lot line adjustment survey map and legal descriptions for both U parcels involved in the lot line adjustment shall be reviewed and approved by the Planning Director. The primary access shall be via Kable Lane as shown on the submitted site plan. Joint access for truck and trailer traffic access through the Carmen Center site to 72nd Avenue shall be reviewed in conjunction with SDR 88-04. 3. The applicant shall provide for roof and parking lot rain drainage to the public storm water drainage system. Storm drainage run -off shall be di:,charged into the existing drainage ways without significantly impacting the proper•t.ies downstream. A . The applicant. shall provide connection of proposed builuings to the public sanitary sewerage system. A connection permit is required to connect to the existing publicc sanitary sewer system. Joint use and maintenance agreements shall be executed and recorded on City standard forms for all common driveways. Agreements shall be referenced on and become part of all applicable parcel Deeds , The agreement shall be approved by the Engineering Section prior to recording. A licensing agreement for use of the right--of--way to the west of the site shall be submitted to the City of Tigard for approval . If this agreement is not approved, the applicant shall provide a minimum landscaped area on the property of 13 .0 percent. 0. All landscaping material shall be installed as per thea approved landscaping plan. 9. A sign permit shall b,2 obtained prior to the erection of any sign. The submitted site plan dated March 8, 1988, by Mackenzie Engineor•ing, shows a proposed 96,000 square feet 'Building 2.17' with access from two locations off Kable Lane and a joint use access to the proporty to the south, The property to the south is a proposed multi--tenant development 'Carmen Center, ' submitted simultaneously by the same owner as this development. 2 One access located on the west end of Kable Lane is proposed as a joint access with the existing building to the north. The second access off KeF ie Lane is proposed to be adjacent to the railroad spur tracks located on the east property line. 3 Kable Lane is a City of Tigard cul-de-sac street paved to 40 feet wide with a 50-foci, radius cul--de-sac . Improvements also include sidewalks and streetlights . 4 . The submitted site plan does not Show the necessary sanitary sewer or storm drainage impr•uvem,,nts . However, the site plan previously submitted showed the improvements connecting into existing facilities . I Conditions : 1 . Access shall be allowed as shown on the submitted site plan. An additional driveway Cut onto SW 72nd Avenue should 6^ 4iscouraged. It would be possible to arrange for access in a westerly direction to SW 74th Avenue and crossing the railroad right-of.-way. ANALYSIS AND CONCLUSION Section 10. 162.030 of the Community Development Code contains the provisions pertaining to approval of minor land partition requests. The proposal conforms with the City's comprehensive plan and other City ordinance requirements and regulations, the proposed lots coofer:n to the size and dimensional requirements (if the Code and those contained in the 1-L zoning district, adequate public facilities are available to serve the proposal and City and applicable agency standards will be met for public improvements once all conditions of this approval have been met (see section "C. DECISION" below) . Since we are discouraging curb cuts on SW 72nd Avenue riot only with respect to the number of curb cuts but also to their location, it is reasonable to require that the location of the proposed easement be approved by the Engineering Division prior to Irecording the partition with the County, Planning staff recommends ap,aroval of this request. C. DECISION The Planning Director for the City of Tigard approves MLP 07-00 subject to the following conditions: I . UNLESS OTHERWISE NOTED, ALL CONDITIONS MUST BE MET PRIOR TO RECORDING THE PARTITION WITH THE WASHINGTON COUNTY ASSESSOR'S OFFICE. 2.
