I am hereby applying for a permit from the City of Tigard to build the gabien wall assuming the US Army Corps agrees to allow the project. As I told you in a previous letter, Brownstone Homes, LLC is the owner of record of Tract S. An easement was recorded yesterday from Brownstone to my wife and I to allow for work in the creek with all the necessary approvals. 1 will provide you with a copy of the easement once our copy is returned. In addition, I would like to make a request from the City of Tigard for access from City property abutting ours to allow for this work. It seems other people just use it without permission. Also, I would like to have a discussion with you regarding the installation of a drain line along our joint property line to make sure there is a way for water to make it to the creek during heavy down pours, or if there is another leak in the detention pond. As you may or may not be aware, we experienced a substantial leak last year along the private drive in Tract U serving the four homes. That leak was never fixed, however, the City has since filled the leaking detention pond and piped all the water to the last detention area which means more retention in that pond. will schedule an appointment with you in the near future to review the information enclosed and discuss any suggestions you may have regarding this project. Sihce ty# i Richard K. Brown Ms. Lori Warner, Field Operations Manager June 19, 2002 Division of State Lands 775 Summer Street NE, Suite 100 Salem, Oregon 97301-1279 Dear Ms. Warner Re: State Application Number 24994-NSP Enclosed is a request to the US Army Corp of Engineers for a modification of our original request to retain any further erosion at 13001 SW Gallin Ct., Tigard, Oregon. The new request only changes the method of constniction of the wall from boulders to a gabien wall indicated on the attached engineering drawings. After discussing the project with numerous engineers it seemed a consensus that this type of wall would do a great fob and be less invasive into the stream area. Based on your January 28, 2002 letter I am assuming I need no further permission or permits from you. If I am incorrect, please contact me and let me knew what additional information you need. The Division of State Lands requires a permit if you plan to remove, fill or alter 50 cubic yards or more of material within the banks of most waters of the state. State designated Esser.tial Salmon Habitat Streams and State Scenic Waterways are exceptions in that any amount of removal, fill or alteration typically requires a permit. Based on your application, your project involves removal or filling of less than 50 cubit; yards of materiel IN WATERS THAT ARE NOT CURRENTLY DESIGNATED Essential Sa;rron Habitat of State Scunic Waterways; therefore, a Slate removal-fill permit is not required. You must also receiva authorization, when required, from the U.S. Army Corps of Engineers and local planning department before beginning construction. Brown Erosion Army Corp Case#2002-00060 During the past several weeks I have reviewed my situation with a number of engineers to try and determine the best method to stop the erosion and yet be as non- invasi✓e to the stream area as possible. In the past you received a proposal from Bill Parks which was submitted to both the Division of State Lands and to the Army Corp. 'rhe original proposal was a boulder wall. At this time 1 want to change the method of erosion control to a gabien wall, which details and engineering are attached . Therefore, this information is a modification to the proposal prepared and submitted for me by Bill Parks. Since time is an issue to get.this approved and built during the dry season, 1 am sending/submitting a copy of the proposal to DSL for their file and information and the City of Tigard to obtain a permit. 1 have also enclosed a copy of a letter from DSL which states that I do not need a permit from them. I hope that the information that 1 have provided is adequate for the intended purpose.
