The purpose of this memo is to provide guidelines for applying the regulations to these homes in a reasonable and consistant manner. Your notification of where these facilities are that need inspection will come from the Childrens Services Division either directly, through the Salem office, or in some cases you will be directly contacted by the care provider. Try to respond to inspection requests with the least disruption of your normal work schedule as possible. DEFINITIONS 1 . C.S.D. Childrens Services Division, Department of Human Resources '. Foster Fami'iy Home means any home maintained by a person who has under leis/her care any child unattended by parents or guardian for the purpose of providing such child with care, food, and lodging. 3. Foster Child is any child placed in a foster home. 4. Family is an individual or two persons related by blood or marriage or a group of not more than five persons unrelated by blood or marriage living together in a dwelling unit. 5. I-1 as defined in the 1979 Uniform Building Code. 6. SR-1 as defined in the 1979 Uniform 3uilding Code. 7. SR-2 as defined in the 1977 Uniform ,uilding Code. The words "ambulatory" and "non-ambulatory" do not always apply In some cases , a resident's mobility may be such that, under strict interpretation, he would be classified "non-ambulatory" when in fact, he suffers "limited mobility," and may nonetheless demonstrate the ability to zvacuate the building in a reasonable time frame. The following guide may be helpful in determining mobility. I10BILE Capable of readily rising from bed and taking self- protecting actions at approximately the same rate as a healthy adult. i.IMITED MOBILITY These persons who 'nave all of the capabilities of a mobile person except that their rate of travel will be significantly less and they may need the aid of crus -es, walker, wheelchair or other device. They must be capable of using such aids unassisted. IJOT MOBILE Not capable of removing themselves from danger exclu- sively by their own efforts. The mobile or not mobile person should be easily recognized. A person who is not mobile is not a suitable resident in an SR-1 or SR-2 home. It is the person with limited mobility that will require the grentcst degree of individual judgement. It may be possible to place a person wiih limii:ed mobility in an SR-1 or SR-2 se`.ting by adding features of protection such as : ( 1 ) placing the person in a sleeninn -aam with direct exterior egress ; or, (2) moving the person from the seconb floor to the first flcor; nr (3) adding a ramp, etc. (This would be in additicn tr, normal safety features for the occupancy group. ) We believe that most facilities for over five persons will fall into the SR-2 occupancy group. Without a long definition, a home classed as SR-2 will require a smoke detection system installed in accordance with national Fire Protection Association (NFPik) Standards No. 72A and 721, 1979 Edition. This particular system would qenerally cost around $2,000 or $3,000. A home classed as SR-1 will also require this same smoke detection system but may also require a partial sprinkler system. The decision on what protection would be necessary will leper ' on the fire prevention inspector. Memo--Foster Home Regulations 11/15/82 Page 3 ESTABLISHING COMPLIANCE TIME FRAMES Because these are new regulations being applied to existing facilities, it is reasonable that the fire authority apply them with a degree of flexibility. The item of greatest impact to most homes will be the installation of fire alarm and smoke detection systems. This will most probably require estimates and/or bids being requested and a review of the successful bid for compliance with applicable rules. This process will require that some time will pass between the discovery of the deficiency and the acceptance of the finished syster�. Due to these conditions it will be necessary for the fire authority to estab- lish minimum time periods and, in some cases, interim safety measures until compliance. The exercise of careful professional judgement will be required. What constitutes a reasonable time to install a detection system will depend on the size and complexity of the installation and could range from GO days to 6 months. Any interim safety measures needed could include tempror•ary use of single station detector units and 24-hour fire watch, occupancy limits, etc. Foster family homes having five or less Foster children continue to be exPnpt from our regulations; however, since C.S.D. does have a responsibility for safety of children that they place, they will continue to look for assistance from fire officials in assuring a reasonable degree of fire safety in thQsE! smaller homes.
