When the Phase 11 buildings were initially laid out, the configuration of Building No. 1 was different from that just built. The initial building was shown to be about 65' from . the east property line, whereas the building constructed varies in distance from about 3' to about 5' from the subject property line. I The glazed openings in the northeast corner of the building should dictate that the distance between the building and the property line be at least 201 . Because the building was cunstructed closer to the property line than the Uniform Building Code would normally allow, it was decided that a permanent deed restriction easement be created 'between Building Nos. 1 and 3, as shown on the attached sketch. That easement would alto- the existing parking and landscape areas to remain and would allow future additional parr and landscaping to be added, but would prohibit any future construction to be added to the east side of Building No. 1 and/or the west side of Building No. 3. In essence, the easement will be satisfying the intent of the Code regulations by insuring that there will always be a clear space of about 55 feet between the buildings. This easement needs to be written, notorized and recorded with Washington County, and a copy should be sent to the City of Tigard and the Tualatin Fire District.
