The findings and conclusions on which the decision is based are noted below. i Ar f'INDING OF FACT 1. Background The existing house was probably constructed in 1957 and was annexed to the City during its original incorporation in 1961. No previous applications have been reviewed w. , h respect to the subject property. I 2. Vicinity Information Properties immediately to the east and west are also zoned C-P. Properties immediately to the north and south are zoned R-12 (Multi-Family Residential, 12 units/acre). Properties to the northwest and further west of SW Lincoln Street are zoned and deve'oped as R-4.5 (Single Family Residential, 4.5 units/acre) . 3 . Site Information and Proposal Description The site presently contains a 1300 square foot, single story, single family residence which fronts SW Greenburg Road. The property is basically flat. Two very large evergreen trees are in the front yard and three smaller trees are in the back yard. Some tall deciduous trees lie on or near the rear property liner A small accessory structure and a gravel driveway lie along the western property line. The applicant proposes to convert the structure to an orthodontic (dental) clinic and, therefore, this site development review is ' required 1., ensure that: City standards are met for new development .in the C-P Z-2. Eleven parking spaces are proposed to go behind the residence; two are planned for the front yard, SW Greenburg Road is classified as a major collector street with an existing 60 foot long public right--of-way area along the SW Greeriburg Road frontage. Agency and NPO Comments The City Building Division and Portland General Electric have reviewed ` the proposal and have no objections to it. The City Engineering Division has reviewed the proposals and has the following observations : L a. No additional right-of--way will be. required as the site already has an exist-rig right-of--way of 60 feet along the SW Greenburg Road frontage, b. The City plans to construct street; improvements for Greenburg Road during 1990, including the frontage of the site. Consequently, half-street improvements will riot: be required. C. the applicant's proposed site plan shows a pdrking lot and driveway to SW Greenburg Road. Sanitary sewer service will continue to be provided by the existing private system. No public improvements are proposed, The Consolidated Fire and Rescue District has concerns relating to the j Uniform Building and Fire Code, namely: a. Hydrants: Hydrants shall be located no further than 2.50 feet from all portions of the building exterior and along fire department access roads . b. Fire Resistive Construction, firestopping the exterior exit door, landings at doors, interior finish, required mechanical plans and equipment approval and several other UBC and UFC requirements will be inspected by the City Building Division and the Fire District j prior to occupancy of the structure. ANALYSIS AND CONCLUSION The Planning staff has reviewed the proposal and has deterrlined that it is consistent with the relevant portions of Tigard' s Community Development Code (CDC), however, additional discussion regarding the following development standards is warranted: Access, Egress and Circulation Section 18. 100.080 of the CDC specifies a 2.4 foot minimum driveway width for commercial uses. The site plan submitted by the applicant only shows a width 0 of 2 feet for access onto SW Greenburg Road. The initial 09 feet � of this drive is proposed to transgress 0 feet into the adjacent property to the north. The Code requires that service drives shall be designed and constructed to facilitate the flow r)f traffic, provide maximum safety of triaffic access and egress, and maximize safety of pedestrians and vehicles on the property. It also says that groups of three or, more parking spaces 1 shall be served by a service drive. One space in the rear will be designated as handicap parking. Section 10, 106.030 of the Code sets forth the minimum parking requirements. A medical or dental services clinic is required to provide one parking space for every 200 square feet of parking. Thus, in this j case a minimum of seven parking spaces is required, .staff questions the � desirability of the two spaces in front- because they pose somewhat of an on--'site traffic hazard to vehicles exiting the site. Motorists exiting the rear parking area will not have a clear view of vehicles backing out Y• of the two front yard parking spaces. Staff recommends that these two spaces be eliminated , The Code also requires that at least one bicycle parking space be provided 1' for every 15 required parking spaces. Since only seven vehicular spaces are necessary, no bicycle parking is required but the provision of some bicycle parking is recommended. Landscaping and ScreeningA In the Commercial--Professional zone, 85 percent of a site can be covered by buildings and impervious surfaces (e.g. , walkways, parking lots) . Approximately 27 percent of this site will be landscaped, which is well over- the Code—mandated 15 percent minimum. Of the two fir trees along the front of the property, both are proposed to be removed, as well as two of the three deciduous trees in the rear yard. Staff sees no justification for removal of the larger fir tree on the southeast corner of the property other than to improve visibility of the building. Staff recommends a tree removal permit be required prior to removal of any trees on the site. Finally, should the two parking spaces 1 in front be retained, staff recommends installation of shrubbery or other vegetation to block the glare from car headlights along the southern edge of the two spaces. Signage No drawings have been submitted in conjunction with this application other than a notation on the plan showing a proposed location for a freestanding • sign. This location is within the driveway's vision clearance area and as such may interfere with pedestrian or motorist vision. Staff recommends a monument sign no higher than three feet or a pole sign with an eight foot tclearance. n Sign location and sign dimensions will be reviewed in greater depth upon application for sign permits, which are required for all signage on the site. To avoid light; spilling into nearby residences and creating undesirable impacts, it should be emphasized that such lighting must be entirely focused internally on the property. Such an arrangement will maximize security for the clinic and minimize external i.mpa::ts on an area of Tigard that contains a concentration of residential development next to arid within a C—P zone. Variances The applicant has requested approval of two variance requests: 1) to 4 allow an access drive of 20 feet: in width where 24 feet is the minimum required by the Code; and 2) to reduce the landscape buffering requirement in the site' s rear yard to three feet when 10 feet is ndr•mally required between uses in C—P and the R-12 zone (Multi—F"amily Residential, 12 units per acre) . 1 a. Access Width Variance j Section 18. 108. 150 of the Code contains standards whereby the Director i or his designee can approve, modify or deny a request for an access variance, They are: .' a (1) It is not possible to share access; (2) There are no other alternative access points on the street in question or from another street; (3) The access ieparation requirements cannot be met; d' (1) The request is the minimum variance required to provide adequate access; I (5) The approved access or access approved with conditions will result in a safe access; ane; (6: The visual clearance requirements of Chapter 18. 102 will be met. It is not possible to share access with the adjacent property to the north because its access drive '.s further to the north and serves as a private residential driveway. There are no other alternative access possibilities for access onto Greenburg Road — the southern side yard , is only nine feet wide. An access onto Lincoln Avenue would require an easement: through residential property which is not permitted by the Code. (Access is required to be provided directly from a city street) . Access separation requirements also cai►not be met because the residential property to the north does riot have a sufficiently kk wide side yard. It is unlikely that there is sufficient space between the subject building and the one to the north. If the two parking spaces in the front yard are removed as suggested by staff, the access and parking area will be safe and meet all other parking dimensional requirements. finally, the Engineering Division has determined that i vision clearance will riot be hindered by this variance proposal, Also, a 2.4 foot wide access will be provided at the entrance to provide adequate room for turning movements to and from the site. Staff therefore recommends approval of this variance subject to the requirement that an access easement: be executed for use of the adjacent property for a portion of accessway , i b. Buffering Variance Code Section 18. 100.080 requires a minimum of a ten foot buffer consisting of at least one row of trees and ground' cover for the remaining area. The applicant is requesting relief from this Code buffer requirement between the C--P and the R-12 zones at the rear- of the property . Section 18, 100.080(a)(4)(F) slates that in lieu of these standards a detailed landscape plan may be submitted for approval by the Director which pro-fides the same degree of desired buffering utilizing alternative designs. Code Section 18. 134.050 contains the standards for approval, modification or denial of a variance request by the Director or his designee. They are: 1 . The proposed variance will not be materially detrimental to the purposes of this Code, be in conflict- with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2. There are special circumstances that exist which are peculiar to !' the lot size or shape, topography or other circumstances over- which the applicant has no control, and which are not applicable to other properties in the same zoning district; 3. The use proposed will. be the same as permitted under this Coin and City standards will be maintained to the greatest extent that is reasonably possible, while permitting some economic use of the � land;; r }° A . Existing physical and natural systems, such as but not limited to traffic, drainage, dramai;ic land forms or parks will riot be adversely affected any mt)Me than would occur if the development were located as specified in the Code; and 5. The addition of trees along this rear area should satisfy this I requirement, C. Vision Clearance and Fir Trees Moth fir trees in the front yard are proposed to be removed by the applicant. The northern fir tree sits immediately adjacent to the proposed driveway. it is the opinion of the Engineering Division that it may not survive construction of the driveway and the remodeling because the tree's roots will either be compacted or cut in the process. In addition, the northern fir tree sits within a vision clearance area, in which no object between 3 and 8 feet can interfere with motorist or pedestrian vision. The Engineering Division does not think the northern tree will pose a vision clearance problem especially if the branches below eight feet are removed, .. `+ The Code mandates that trees with a caliper of 6 inches or greater be conserved on undeveloped property. The applicant wishes to remove the tnorthern tree arid yet no specific justification for it3 removal has been .,: given. (Although this property contains a structure, it is considered to be "developing" under the site development review provisions because of a change in the use of the land) . Neither the access width provisions nor the vision clearance area requirements are contrary to the continued life of this tree.
