W. Greenburg Road and Tieceman Avenue. Tha installation took more time and material than usual, pertly because the main was so deep. An extension had to be in- stalled to get the fire hydrant to the proper height. Fittings, alone, totaled over $1, 000. With labor and equip- ment , the final cost exceeded $1, 800. I cannot, honestly, charge you that much. Therefore, the district ;�►4.11 absorb one-half the labor and equipment charges. Final billing to you is : $1, 427. 21 Thank you very much foragreeing to make this installation. Hopefully, the fire hydrant will never have to be used, but w1.11 always be available if necessary. DEVELOPMENT REVIE'.J SDR 3-84/VARIANCE V 4-84 APPLICATION: Request by Edward Lilly and Joseph Nogrn to constrLct two warehouse buildings and related improvements and to vary the rear yard setback when adjacent to residential zones from 50 to 43 feet. The property is zoned I-P (Industrial Park) and is located s� 11225 SW Greenburg Road, Tigard (Wash. Co. Ta, Map ISI 35CA, Tax Lot 700). DECISION: Notice is Hereby given that the Planning Director for the City of Tigard has APPROVED the Site Development Review and Variance subject to certain conditions.^ The findings and conclusions on which the D;.rector based his decision are as noted below. A. FINDING OF FACT I. Background No previous proposals have been reviewed by the City in the subject property. 2. Vicinity Information Properties to Che west and north are zoned I-P and developed with warehouse uses. The R-12 (Residential 12 units/: cre) zone and multiple fami '•y developisenL lies on the cast side of Greenburg Road and to the south. Ti.edeman Avenue borders the northern property line and its intersection with Greenburg Road is located at the northeast corner of the parcel. 3. Site Information and Proposal Description The parcel is developed with teu residential units situated along the southern property line. Driveway access is established on Greenbi.srg Road, approximately 35 to 40 feet north of the south property line. A row of 15 to 20 foot tall evergreen Lcees aie located along the southern boundary of the property. A 5•-foot retaining wall is immediately south of the trees. The applicant proposes to remove the existing structures and construct two warehous.- buildings of 3, 150 and 7,600 square feet. A maximum number of employees per shift will be approximately 12 for both Buildings. The basic location of .the existing driveway is to be retained and a new driveway is proposed on Tiedeman Avenue across from the N. Dakota Street intersection. A packing and loading area will lie between the two buildings. Sections 18. 100.070 and 18. 100.080 require that a landscaped buffer area consisting of a combinrtion of high and low growing vegetation be provided. Because of the existing retaining wall , NOTICE OF DECISION - V 4-84 - PACE I +ss III the applicant contends that low vef,etation will not be an effective buffer. Additional trees ire proposed in lieu of shrubs. Section 18.100.080 A.4.F. allows 'he Planning Director to approve alternative landscape designs which provide the same degree of desired buffering . As a part of this proposal, a variance is requested to the rear yard setback requirement for the I-P zone when .-idjacent to a residential zone. The smalle • building is proposed to be located 43 feet from the southern property line instead of the required 50-foot setback. The closes= apartment building is approximately 48 feet south of the southern property line. 4. Agency and NPO Comments The Engineering Division has the following comments: P. Due the cure along Greenburg Road, no trees should be planted along the street frontage. Only low growing plantings should be allowed. b. The loading area near the driveway to Tiedrman Avenue should be moved because of its potential for blocking the entrance and subsequently backing traffic onto the street. C. Plans for sanitary and storm sewer installation are not shown. Said plans should be reviewed and approved by the Civirion prior to 'building permits. d. Strcet improvements along the Greenhurg Road and TiedLman Avenue frontage, including a bike lane, will be required. However, the final alignment has riot been determined and a noir-remonstrance agreement should be signed for a future street local improvement district (LID) in lieu of immediate street improvements. The Tualatin Rural Fire Protection District notes that the turning space within the parking area is inadequate. The handicapped parking space should he relocated to allow for an inside turning radius of at least 32 feet. The Building Inspection Office has no objection to the proposal. No written comments have been received by NPO #2. S. ANALYSIS AND CONCLUSION The proposed development of the property is in• conformance with the applicable regulations in the I•-P zone (setback issue aside) . Minor modifications and additions to the site design should be made prior to issuance of building permits. The landscaping plan should be modified to eliminate the street trees along Greenburg Road and more specific information should be presented regarding the required 20-foot wide landscaped buffer along the southern property line. The applicant ' s NOTICE OF DECIS16N - V 4-84 - PAGE 2 proposal to substitute some or all of the required shrubbery for additional trees appears appropriate, subject to Planning Department approvtil. Sectio-: :8.134.050 of the Development Code requires that a variance request meet several criteria. The purpose of the additional 50-foot setback for buildings in the I-P zone when adjacent to residential zones is to prevent large imposing buildings and potentially noisy activities in close proximity to residential development. The 19-foot tall building is substan, ially lower than the 45-foot height limit of the I-P zone. The land elopes upward to the south so that the apartment buildings are 5 to 10 feet higher and a total of 90+ feet away from the proposed warehouse. This relationship, in addition to the existing and supplemental landscape buffer, should maintain compatibility between the two properties. The Lr,t size is an irregulcr shape making it difficult to locate two wareho-ise buildings on the site. the warehouses will be placed upon the property in a manner which sill maintain the greatest possible distance from the southern property line while still meeting other setback requirements. The applicant has asked for the minimum setback variance to minimize the hardship. Both the Site Development Review (SDR 3-84) and the Variance (V 4-84) requests are appropriate subject the conditions noted below. C. DECISION Site Development Review (SDR 3-84) and Variance (V 4-84) are approved subject to the conditions below: 1. Prior to issuance of building permits, a landscape plan (including the buffer area) conforming to Chapter 18. 100 (applicable section er,'!losed) shall be submitted to the Planning Director for approval. The street trees along Greenburg Road shall be eliminated. 2. The 3,150 square foot warehouse shall be no closer than 43 feet to the southern property line. 3. A revised site plan showing the relocation of the southern loading area and the landscaped parking spare, a3 well as the storm drainage and sanitary sewer installations, shall be submitted to the Planning Director for review and approval , prior to the issuance of b ,ilding permits. 4. A City of Tigard approved Non-remonstrance Agreement must be recorded with Washington County and returned to the Planning Director before building permits are issued. 5.
