CODE SECTION: Sec. 1716 contains Oregon amendment, exception 3, which says: "Intericr guardrails within individual dwelling units or guest rooms of Group H occupancy may riot be less than 36" in heig�it." (emphasis added) BACKGROUND: Amendment was proposed by Washington County due to complaints that 42" guardrails are unnecessarily high and interfered with the enjoy- merit of homes and apartments on view lots. They observed that 36" rails had severed well for years with no unusual accident record. ANSWER: The question revolves around the word "interior". "interior" was intended by the exception writer to mean the area controlled by the tenant I� behind a locked door to which the tenant has a key. Therefore, an open-air (exterior) balcony which may be reached only by passing through the tenant's locked door is an "interior" balcony, and guardrails may be not less than 36" high. An exit balcony open for public use, however, would require 42" height.
