Also a variance request to exceed the maximum allowable height by two inches and the average height requirement of ten feet by 10 inches. Location: 7460 SW Beveland. (WCTM 2S1 1AB Lot 2703) . DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above application subject to certain conditions. The findings and conclusions on which the Director based his decision are as rioted below. A. FINDING Of' FACT 1 . Background No previous applications have been reviewed by the Planning Division staff with respect to the subject property. 2. Vicinity Information Properties to the north, east and west are also zoned R-3.5. The property directly south of the subject parcel is zoned C•-G (PD) (General Commercial, Planned Development) and is occupied by the Phil Lewis Elementary School . 3 . Site Information and Proposal Description There is presently a 1584 square foot residence, a concrete dog run and an open concrete patio to the rear of the house and a small tool storage shed on top of the patio The shed is less than 120 square feet in size. The applicant proposes to construct a 500 square foot accessory structure to be used as a garage and will be behind the patio. Eleven hundred and seventy five square feet of asphalt will be laid to connect the building to an existing driveway. The applicant states that he will relocate the tool storage shed to the southwestern area of the property south of the dog run but within the 5 foot required rear and side yard setback areas. The proposed structure will be 22.75 Fart from the rear property line. 'The property is not connected to City sewer but rather is serviced by a septic tank. The applicant knows of no easements attached to the property and all utilities ar•e in the front yard area. The average height of the structure will be 10' 10" and it will measure 12'2" at its highest point. NOTICE OF DECISION - M 87-09/V 87-17 - CANUTT - PAGE 1 4 . Agency and NPO Comments -Che building Inspection Division has reviewed the proposal and has the following comments: If the house is served by a septic tank, the location of the tank should be confirmed so that the proposed building will riot be constructed over it. No other comments were received. B. ANALYSIS AND CONCLUSION Section 18. 144.070 of the Community Development Code contains the approval criteria to be used when approving an accessory use. The proposed structure will meet the setback requirements of the R- 3 .5 zoning district as well as the minimum five foot side and rear yard setbacks for accessory structures. 'Ihe proposed building meets the maximum allowed area of 500 square feet for accessory structures on parcels less than 2.5 acres in size; the structure will be located in the rear yard and not the front yard; the structure will not encroach upon or interfere with the use of any adjoining property or public right-of-way. Section 18 , 144.070(b)(10) requires an accessory structure not to exceed an average height of ten feet ten inches and a maximum height of twelve feet. In an R-3 .5 zone, the maximum allowable height for a house would be 30 feet. The side yard setback is a minimum of five feet and the rear yard setback is a minimum of 15 feet. The proposed accessory building will meet the five foot side yard setback and exceed the rear yard setbacks normally required for an accessory building (5 feet minimum) and a residence (15 feet) . The rear yard setback for the building will be 22.75 feet. Therefore, the small increase in height will not affect surrounding properties in that the accessory structure will meet or exceed setback requirements and will be eighteen feet lower than a residence could be:, Staff recommends approval of the variance request. The applicant will be required to obtain building permits prior to construction of the building and to submit proof that the proposed building location will not interfere with the property's septic tank drainage field. Should the proposed building location conflict with the drainage field, then the applicant will have to work out a new location with the Building Division and Washington County Department of Health and Sanitation. The new location would have to meet the setback requirements for accessory structures in an R-3 .5 zone. they are: Front yard = 20 foot minimum Side yard - 5 foot minimum Rear yard = normally a 15 foot minimum but for accessory structures a minimum 5 foot rear yard setback is required. (Section 18 . 144.070(b)(5)) . NOTICE OF DECISION - M 87-09/V 87-17 - CANUTT - PAGE 2 i C. DECISION The Planning Director for the City of Tigard hereby approves M 87--09 and V 87-17 subject to the following conditions: 1 . UNLESS OTHERWISE NOTED, ALL CONDITIONS SHALL BE MET PRIOR TO THE. ISSUANCE OF BUILDING PERMITS. 2. The applicant shall. provide written documentation of the location of his septic tank drainage field and proposed accessory building will riot conflict. 3 . The applicant shall erect the building exactly as shown on the submitted plot plan, unless there is a conflict with the dr•aini:ige, field. If this is the case, then building setbacks for the R-3 .5 zoning district must be maintained. 4. The applicant shall apply for building permits from the City Building Division. 5. This approval is valid if exercised within one year of the final decision date noted below. D. PROCEDURE 1.
